1.1 Statutory Understanding and Compliance.
1.1.1 Environment, safety understanding of the Contractor:
- Safety and health are very important element of the project
- The contrctor will continuosly implement safety measures regarding thepublic and alll personnel associated with the works
- The contractor will perform the work in full compliance with all safety andindustrial health legislation and regulations of the Socialist Republic ofVietnam
- The Contractor believes that safety is a ine responsibility and expectsindividual employees to be responsible for his own safety and health andthe protection of his fellow employees as well as the environment
- The Contractor believes that all accidents are proventable and noundertaking is so important that would endanger the life of a person.Regarding preventive measures, the Contractor will provide the propersafety devices such as safety handrails, safety nets, barricades, warningsigns, watchman etc
- The Contractor will also display safety and industry health posters to raisethe awareness of workers
- The Contractor will maintanin the existing pedestrian routes in a safecondition or provide alternative routes with the intension of seuring safety
of the local population
- The Contrctor believes that time and effort shall be spent for theadvancement of any operations and undertakings
- The Contractor will provide fully cooperate and assist in safety surveillancewhich will be carried out by the Engineer or the Employer

Besides the Government regulations, the Contractor will date the EMSTCPand apply other regulations, local regulations, local customs and other instructionsfrom Government Agencies, including:
- The use of cement from the dredging of off-shore coral reef resources isprohibited and shall not be used in the project;
- Although there are no known instances of unexploded ordnance (UXO)within the proposed work Sites, the possibilities of UXO can not beexcluded The Contractor shall, therefore, undertake consultations,historical reviews and surveys as warranted in regard to potential UXOissues as determined necessary in consultation with the SupervisingEngineer
- Before a contractor can begin work, the contractor shall submit to PMU-18ESU approval from the relevant Provincial
Department of Science, Technology and the Environment (PDOSTE) that all borrow materials from river floodplains have been subject to
environmental studies approved by MONRE or the relevant PDOSTE
- Contractor shall restore areas sitting temporary asphalt plants to theiroriginal condition on completion of Project works This shall include theclean-up of spillage and debris before leaving temporary constructionsites
In addition to the above, when there are any requirements from the Engineerfor project safety, these will be met by the contractor
1.2 Contractor Management
1.2.1 Updating information:

Regulations and documents relating to industrial health will always beobserved, updated and made known to all site staff
The approved environmental management, safety and traffic control plan will
be furnished to subcontractors to be considered as safety and environmentprotection documents The subcontractors are requested to conform to these plans
1.2.2 Management:
Sub-contractors are requested to assign a safety representative, who will be
on site at all time during the subcontractor’s execution of the works
The contractor will organize safety and environmental training programs forall site staff
- Primary program: for personnel, and workmen who work on site for thefirst time
- regular program (6month/time): for staff, inspectors, managers
The contractor will organize regular monthly meetings regarding safety andenvironmental issues to remind and inform all site staff
The contractor will organize inspections, testing and maintain safety equipment on site

3.2 Environmental and Safety Reports:
The following environmental and safety reports shall be submitted:
Initial Environmental baseline report: Report of environmental baseline dataincluded: air quality baseline, water-sediment quality baseline, noise baseline,…
Weekly environmental and safety reports: documented safety andenvironmental audits shall be undertaken on weekly basis Environmental and safetyreports summarizing the results of the audits shall be submitted on a monthly basis
Monthly report: Summaries of the weekly environmental and safety reportswill be included in the Project’s monthly progess report
3.3 Notification of accidents
The engineer will be notified immediately of any accidents which occurwhether on-site or off-site in which the Contractor, his personnel or constructionplant, or those of any subcontractors are directly or indirectly involved and whichresult in any injuries to any persons
Such initial notification may be verbal and shall be followed by a writtencomprehensive report within 24 hours of the accident
3.4 Communication with sub-contractors.
All site offices are fully equipped with fax machines, telephones, and there isalways someone on duty during office hours If the guard, or the duty andenvironment inspector are not present when an accident occurs, the site engineer orfore man will phone head offic
e for information and guidance
The environment & safety staff for the construction teams will report daily about environment/safety at site to the environment & safety officer
Trang 7In order to avoid adverse impacts, the following shall ahead to:
- The contractor will conform to the Socialist Republic of Vietnam’s Laws onProtection of Environment (NLEP) as well as and other relevant legislation;
- No debris will be deposited on public or private right of way as a result of itsoperations, or arising from the movement of Construction Plant or vehicles
- All existing stream courses and drains within, and adjacent to, the Site will
be kept safe and free from any debris and any excavated materials arising from theworks Chemicals will be prevented from going to the watercourses And washing ofconcrete agitators will not be allowed on existing watercourses
- All water and waste products arising on the Site will be collected, removedfrom the Site via a suitable and properly designed temporary drainage system anddisposed at a location, and not in a manner that will cause neither pollution nornuisance
- In the event of any spoil or debris from construction works being deposited
on adjacent land or any silt washed down to any area, then all such spoil, debris ormaterial and silt will be immediately removed and the affected land and areas will berestored to their natural condition
4.2 ENVIRONMENTAL OBSERVATION AND MONITORING PLAN
4.2.1 Standards and Required Equpment
- Air quality monitoring equipments: The equipments are checked according to theproducer’s at 90 dBA before measuring Lab-checked before and after going to thelocation

4.3 OTHER ENVIRONMENTAL PROVISIONS
2 The road base materials
During dry seasons, road bases will become dry and dusts will probably mix into theair by the wind To minimize these cases, appropriate watering will be performed onaffected areas
Trang 9- The access road will be wet by water during dry and windy season.
- The aggregates bin and yard will be wet during dry and windy seasons But itshould be coordinated with the quality control group for their mixed designadjustments
- Prevention of lubricants and fuels on the site coming from heavyequipments
- A water monitoring system will be provided if necessary
- Pollutants will not be discharged into watercourses
- Control of site
4.4.3 Unexploded Ordnance (UXO):
Prior to the commencement of construction, mine sweeping shall be carried outsurrounding the construction Site and confirmed for safety by the Defense Agencyspecializing in disarming of explosive ordnance
- Construction personnel, equipment and vehicles shall be confined to the work areas
as defined by site fences/hoardings erected at the boundary of the works
- All trees within the works boundaries shall be preserved if they are outside thepermanent works areas and do not interfac with construction or operation of theproject
- The loss of trees shall be minimized during site clearance

- Trees will be replaced at a ratio of one to one
4.4.5 Noise and Vibration:
The type of construction that will be used is equpment oriented hence thefollowing measures are recommended to minimize plollution from this type ofconstruction
Large machines (for breaking concrete, drilling concrete etc) shalll only beoperated during day time
- Scheduling of “too much noise activity” such as demolition of concretestructures, during daytime
- Equipments with uncommon noise will be dealt properly by properchecked up and maintenance
- Noise monitoring system will be provided if necessary
- noise barriers at schools and hospitals
to clean the tires of every truck that will be sent to dispose these materials
- For construction materials waste Waste will be collected and stored atone location on site When a truck form Sanitary Company arrives at sitethe Environmental Manager will assign some one to deliver wastes to thattruck which will be sent to an approved disposal area
- For other waste such as food scraps, etc Plastic garbage bags will beused and they will be placed daily at designated collection area by thegarbage collectors
4.4.7 Dangerous materials
With the advancement of science and technologies, a lot of materials havebeen introduced in the construction works Some of these materials will becomedangerous if improperly handled or used The following are steps to be taken whichwill help to minimize the effect of these materials;

- Education and Information
Describing, demonstrating and explaining all dangerous material toengineers, staffs and workers will play an important role on this matter Weshould always remember that awareness is always the key to prevention ofany tragedy
- Proper storage for these dangerous materials
All dangerous material and/or equipments shall be kept in the appropriatestorage
4.4.8 Environmental Emergency Procedures
When unforeseen environmental problem arise, the Contractor will informimmediately to the Local Authorities, the Employer and the Engineer
The Contractor will undertake all protection measure to minimize environmentaldamage on site under guidance of the Environmental Officer
4.4.9 General House Keeping
1/ Site Inspections
A joint inspection with a certified Environmental Manager will be conducted withthe contractor’s and Subcontractor’s site engineer to assure that the site iscomplies with the environmental standards
2/ Site cleanliness
After works, the workers will be given time to daily clean the site Wastematerials will be put on the garbage bins provided (as discussed previously)according to their classification
3/ General waste disposal
Waste is collected and stored at one place on site When a garbage truck fromthe Sanitary Company visits the site, the Environmental Manager will assignsome one to deliver garbage to that truck and wastes will be disposed at anapproved disposal area waste such as left-over food will be put in disposableplastic bags to be transported by the city’s garbage collectors for properdisposal
4.4.10 Protection of Irrigation System:
To avoid potential adverse impacts to historic and cultural resources, theContractor shall ensure irrigation channels diverted during the construction phasewill be returned to their original status Where this is not possible, or where channelsare irrevocably altered, consultation will be held with landowners to ensure that anadquate redesign is undertaken to ensure the irrigation channels are returned asclosely as possible to their former layout The Contractor will undertake all necessaryworks to achieve this status, including provision of labor
4.4.11 Protection of Historic and Cultural Resources
Trang 12- Not locate construction camps within 500 meters from cultural resources.
- Adhere to accepted international practice and all applicable historic andcultural preservation requirements of the Government of Vietnam
- In the event of unanticipated discoveries of cultural or historic artifacts(movable or immovable) in the course of the work, the Contractor shall takeall necessary measures to protect the findings and shall notify theEngineer/ESO and concerned provincial-level and central government levelsrepresentatives of the Ministry of Culture
4.4.12 Protction of Utilities.
To avoid potential adverse impacts to utilities, the Contractor shall:
- Ascertain and take into account in his method of working the presence ofutility services on and in the vicinity of the Site
- Take into account the periods requied to locate, access, protect, support anddivert such services, including any periods of notice required to affect suchwork in consultation with authorities operating such services
- Assume all responsibility to locate or to confirm the details and location of allutility services on or in the vicinity of the Site
- Exercise the greatest care at all times to avoid damage to or interferencewith services
- Assumen responsibility for any damage and/or interference caused by him
or his agents, directly or indirectly, arising from actions taken or a failure totake action, and for full restoration of the damage
- Wherever existing ground surfaces are to be disturbed for construction ofthe works, carry out full and adequate preliminary investigations to locate allservices in the area by means of hand-dug trial holes and trenches incombination with electronic and electro-mechanical devices, whereappropriate Each service thus exposed shall be identified Every service atrisk shall be fully exposed and adequately protcted and supported in situ ordiverted to the satisfaction of the appropriate authority prior to thecommencement of such construction
- When working in the vicinity of overhead power cables, ascertain and satisfyhimself about the safe clearances to be maintained from the power cables inconsultation with the authority operating the power line Where existingoverhead power lines, communications cables or other major utilities requirerelocation, the Contractor will use the services of specialist enterprises withthe necessary skills and technology to carry out the work
4.4.13 Reduction of Construction Operation Impact on Land Communication.

- Construction operations will be conducted in a manner to minimize theirimpact on land communications in and around the areaa of construction.Measures to accomplish this requirement shall include but not be limited tothe following:
- The loading of all trucks used for transporting materials and equpment andshall not exceed the legal limits as stipulated by the Government ofVietnam
- The speed for all trucks used for transporting materials and equipment shallnot exceed 60 kilometers per hour on highways
- The transportation of material and equipment and shall be in accordancewith the all relevant requirements and regulations
- The avoidance of loading and transportation of materials and equpmentduring rush hours to avoid aggravating conditions on road i the constructionarea
- The installation of proper and sufficient traffic signs
- The proper supervision of drivers to ensure awareness and adherence toregulations
- The control of drivers to prevent the use of alcool and drugs The Contractorshall stipulate that such usage shall be grounds for termination ofemployment on the Works
- The storage of constructon materials
4.4.14 Public Consultation and Complaints Procedures.
Prior to beginning construction at any road section, the contractors willconduct consultations with the local affected people to familiarize them with the work
to be done, the predicted impacts, and the mitigation measures to be used ProjectAffected Persons (PAPs) will be identified by the ESU and a schedule will be set bythe Engineer and the ESU for pre-construction consultation to be completed at least
28 days prior to start of construction

To maintain interactive communication between construction personnel andsafety staff, a safety meeting will be arranged once a month Site safety report will besubmitted and examined during the meeting
