This Addendum No 1 shall be construed as an integral part of the Tender Documents

ITT Item C1 Last paragraph:

“Any accompanying printed literature in other languages shall

be accompanied by an English and Vietnamese translation

All the Vietnamese translations shall be for reference only and English shall be the governing language in the interpretation of the documents comprising the Tender.”

ITT Item C 16.3 2nd Paragraph

The quoted 2nd paragraph shall be deleted in its entirety

ITT Item C21.2 “The Tenderer should note that all Guarantees, except

Advance Payment Guarantee, shall be executed prior to signing of the Contract.”

ITT Item C27.3 (Not existing in the present Tender Documents) Following new paragraph shall be added:

“C27.3 For the web-based information management

system, ACONEX shall be applied in the Base Tender However, the Tenderer can submit a proposal (technical and financial) for application of another system as Tenderer’s Alternative, in addition to his Base Tender.”

ITT Item E4.4 The whole text of Item E4.4:

“The decision of the Employer or the Employer’s Representative as to which of the tenders are not substantially responsive or have impractical /defective design

or construction technology shall be final.”

The whole text of Item E4.4 shall be deleted and substituted with the following:

“The tender which is not substantially responsive is the one which does not meet the conditions specified in Item 3 of Annexure 5 to Instructions to Tenderers.”

ITT Annexure 1, Item 5.2 Last sentence of Item 5.2:

“The Tenderer shall include in this statement a schedule of the main maintenance operations, for each major component, ventilation equipment, mechanical and electrical equipment, airconditioning, power supply systems fire-fighting equipment, etc including intervals between such operations, for all aspects of the required construction and of main spares and stores required and their rates of use.”

(b) the Works will, when completed, comply in all respects with the Employer's Requirements, the Contractor’s Technical Proposals, the Design Data and the intended use of the Works;

(c) the Works have been or will be designed, manufactured, installed and otherwise constructed and to the highest standards available using proven up-to-date good practice;

(d) the Works will, when completed, comply with enactments and regulations relevant to the Works;

(e) no Materials generally known to be deleterious or not in accordance with good engineering practice have been

or will be specified or selected or incorporated in the Works, by the Contractor

(f) the design of the Works and the manufacture of Plant have taken or will take full account of the effects of the intended manufacturing and installation methods, Temporary Works and Contractor's Equipment

The Contractor shall not, under any circumstance, have or

make any claim for additional payment or an extension of time or be relieved from any liability or obligation under the Contract, where the cause of delay, suspension, impediment

to or adverse effect upon the progress of the Works is due to any mistake, inaccuracy, discrepancy or omission in or between the Contractor's Technical Proposals, the Technical Design, and the Construction Design, or any failure by the Contractor to prepare any Design Data or submit the same to the Employer's Representative in due time
