SUMMARY ABOUT NEW CONCLUSIONS OF DOCTORAL THESIS
- The thesis clarifies some definitions of labor management, labor management
right of employers and law on labor management right of employers as well as issues
on nature, determination basis, legal contents and role of law on labor management
right of employers, and contributes to enrich fundamental theoretical system in labor
law science
- The thesis comprehensively analyzes and evaluates legal state as well as actual
state of applying provisions on labor management right of employers in Vietnam The
thesis also points out pros and cons of current law, then shows issues to amend and
supplement
- The thesis interprets requirements on completion of employers’ labor
management right law in Vietnam with the direction that state should expand
employers’ labor management right, simultaneously ensure harmony in benefit of the
involved parties (state, employers and employees) and appropriateness to international
law as well as economic condition of market economy in the context of current
integration
- The thesis suggests 22 proposals on amendment and supplementation of
provisions of the Labor Code 2012 on employers’ right to labor management, complete
the Labor Code’s provisions for effectiveness improvement in performing employers’
labor management right in units using employees in Vietnam
