SUMMARY OF NEW RESEARCH FINDINGS OF THE DOCTORAL DISSERTATION
The dissertation is a scientific work at the doctoral degree involving continuous in-depth
research combining both theoretical and practical aspects of contracts for international carriage of
goods by sea and the issue of perfection of law of Vietnam
In theory, the Dissertation has clarified scientific grounds in both theoretical and
practical terms for contracts for international carriage of goods by sea and issues of
improvement of law of Vietnam The Dissertation has drawn unambiguous scientific
conclusions on issues of: the concept of contracts for international carriage of goods by sea,
characteristics of contracts for international carriage of goods by sea Besides, the Dissertation
has systematically analyzed sources of law applicable to govern contracts for international
carriage of goods by sea, nexus among types of law sources, especially the reflection on
present inclinations in development of law on contracts for international carriage of goods by
sea which are tendencies towards modernization and unification of legal regulations relevant
to contracts for international carriage of goods by sea
The Dissertation has centered on overall research and put forth analyses, comparisons
and assessments of the status-quo of legal rules of Vietnam and international conventions on
contracts for international carriage of goods by sea Based on that is the identification of
strengths and weaknesses of law of Vietnam on contracts for international carriage of goods
by sea
In practice, the Dissertation has analysed and evaluated several real cases through which
some experience lessons are drawn for Vietnamese businesses during processes of conclusion
and performance of contracts for international carriage of goods by sea, contributing to
enhancing awareness of the business community in dispute settlement for defence of their
legitimate rights and interests
With theoretical and practical analyses, the Dissertation has analyzed demands and
necessity of improvements in the legal system of Vietnam regarding contracts for
international carriage of goods by sea Based on that, the Dissertation has analyzed and
proposed concrete and feasible resolutions to perfection of law on contracts for international
carriage of goods by sea in Vietnam to facilitate national services development of
international carriage of goods by sea
