“Trans-Pacific Strategic Economic Partnership Agreement (TPP)” was successfullynegotiated in October 2015 between 12 countries including Vietnam that make importand export activities become more vigorous than ever So promote and priorities forthe export and import to create a competitive advantage is essential Therefore,forwarding services in Vietnam develop increasingly powerful It has led tocompanies frequently identify human resources
Vietnam Maritime University is a university that resonates in the training humanresources in the maritime sector as Maritime economic, navigation So I had theopportunity to study and acquainted about export and import factor During times Istudy in Vietnam Maritime University, I had a chance to internship at DH Logistics –Haiphong branch, one office of DH Logistics Co.,Ltd in the northern of Vietnam DHLogistics limited company is a company which specialized in road transportation,forwarding process, import and export from Vietnam to other country surroundingarea Now, I would like to present my dissertation about recommendations to improvecontainer forwarding services at DH Logistics – Haiphong branch

According to FIATA (French: Fédération Internationale des Associations deTransitaires et Assimilés), "forwarding service is defined as any kind of servicesrelated to transportation, consolidation, warehousing , loading, packing ordistribution of goods as well as consulting services related to the above services,including customs issues, finance, insurance, billing, collecting documents related.”
In Vietnam, Forwarding services was appear first time in the Commercial Law in
1997 In the article 163 of Vietnam Commercial Law 1997, forwarding services isdefines as a commercial activity Which the forwarders receive cargoes, organizethe types of transportations, warehousing, finish all the documents and relatedservices, packaging, loading and unloading… from the consignors to theconsignees
2 Freight forwarders
Freight forwarders or forwarders, forwarding agent is the person who conduct theforwarding services According to FIATA, "forwarder is the person whoendeavored to goods transported under trust contract and act for the benefit of thesettler The forwarder also responsible for all the services related to forwardercontracts as storage, warehousing, customs procedures, cargo check”
The forwarder can be ship owner (as ship owners on behalf of shippers performforwarding services), the shipper (when shippers undertakes work themselves itsfreight forwarding), the company handling or warehouse, freight forwarder or anyother professional person have business registered freight forwarding services
3 Forwarder responsibilities and rights.
In article 167 of Vietnam Commercial law, forwarder have the right to:
- Forwarders have the rights to get wages and other reasonable income
- Fully implement their obligations under the contract
- In the course of executing the contract, because of the legitimate interests ofcustomers, forwarder can perform in a difference way from the directed bythe client, they have to notify to customers as soon as possible
Trang 12Besides, there are some responsibilities that forwarders have to follow in article 167
of Vietnam commercial law:
- After contracting, if forwarders cannot follows the require of customers, theyhave to notify to customer immediately
- Forwarder must perform their obligations in a reasonable time if the contract
do not have the agreed on the time and obligations with customers
o If forwarder is an agent, they have to response to the mistake such as:
- Incorrect delivery instructions
- Shortcomings in purchase cargo insurance although there have beenguidance
- Shortcomings in customs procedures
- Transporting cargo to the wrong place
- Do not follow the necessary procedures of re-export or no refund
- Delivery but not collect money from the consignee
- Responsible for the damage caused to 3rd party in their activities, but notresponsible for the damage that caused by the 3rd party
o If forwarder is a carrier:
- Responsible for providing the services that customers demand
- Responsible for the damage that caused by 3rd party (the people thatforwarder hire to perform the contract with customer)
4 Forwarder liability
- The Liability of forwarder as forwarding agent:
Depending on the function of the forwarder, they have to responsible for:
- Delivery improper instructions
- Delivery to wrong receiver
- Delivery without collecting from the consignee
- Failure in purchase insurance for the goods despite instructions
- Failure in make customs procedures
- Transporting goods to the wrong place regulations Delivery withoutcollecting from the consignee
Liability to customs
Most of the nations that the person perform customs declaration must be responsible
to the customs authorities about compliance with customs regulations on the right todeclare the quantities and values commodity name to avoid losses to thegovernment If violated these rules, the forwarder will be fined but the fine was notreclaim from the customer
Liability to third parties
Trang 13Forwarders have to responsible to third party about:
+ Loss of material assets of third parties and the consequences of such loss
+ The third party injury or illness and the consequences of that
- Liability of forwarder in entrustment contracts:
The forwarders often act as entrustment contracts when collecting the LCL cargoes.Therefore, the forwarders must response for the loss of people's assets and the thirdparty that the forwarder caused
5 Legal basis framework
The allocation of import and export goods should be based on a legal basis fromboth international and Vietnam legal
- National law:
Maritime Code of Vietnam's first State Council promulgated in 1990 replacing theprevious bylaws (government declared 1977 to 1982 the territorial waters of width,Decree 30 / CP dated 29/01/1980 on the regulation on foreign vessels operating inthe waters of Vietnam), marking a new step in the process of codification ofmaritime law
In 2005, Congress enacted the Maritime Law No.40 / 2005 / QH11 substitution ofmaritime law in 1990, finishing more than the legal relations arising from maritimeactivities, including the provisions on ships, crew, port, maritime channels,maritime transport, safety and maritime security, civil liability of ship-owners,general average, resolve maritime disputes, prevent environmental pollution andother activities related to the use of sea vessels for purposes of economic, cultural,social, sports, public service and scientific research Code is built on the basis ofstudies prescribed by the law and international conventions related to marine as 24
of the Convention of the International Maritime Organization, 05 of the UNConvention - the rules of CMI and 03 of the UN Convention - UNCITRAL rules,

Some forwarding principles in Vietnam.
Trang 14- The allocation of import and export goods at the port due to port conducted on thebasis of contracts between shippers and shippers who are entrusted with the port.
- For those goods not through the port (no storage at the port), it could be duedirectly entrusted with the carrier (ship) by shippers or shippers who are recognized(new regulation from 1991) In that case, shippers or shippers who are entrusted tothe direct cost to the carriers and only deals with the port about loading andunloading sites, payment of related expenses
- The loading and unloading of cargo within the port due to port implementation Incase owners wish to take the means to unloading must agree with the port and paythe fees and expenses related to the port
- When receiving the goods entrusted to exporting ships, port of loading by the rightmethod of delivery by that method
- Port is not responsible for the goods when the goods were out of warehouses andports
- When receiving goods at the port, the shippers or consignees must present thevalid documents identifying the right to receive goods and to receive a continuum in
a certain time goods voucher For example, the original bills of lading, letter ofrecommendation by the agency
- The delivery may be performed by shippers (directly) or ports (follow trustees)
- International law:
The UN Convention on Contracts for the International Sale of Goods (CISG, theVienna Convention in 1980) is a treaty that provides for a sale of goods lawinternationally agreed As of August 2010, it was ratified by 77 countriesaccounting for a significant proportion of world trade, making it become one of theinternational law the most successful uniform Benin is the most recent stateratifying convention CISG allows exporters to avoid the problem of choosing law,CISG provide "acceptable content rules which the contracting parties, courts andarbitrators may be based on"
CISG was developed by the United Nations Commission on International TradeLaw (UNCITRAL), and was signed in 1980 CISG sometimes known as the ViennaConvention (but not to be confused with the Other agreements were signed inVienna) It operates as a multilateral treaty on January 1, 1988, after being ratified
by 11 countries CISG has been regarded as a success for UNCITRAL, because eversince the convention was adopted by the country in many different geographicalareas, each stage of economic development and all legal systems law, social andeconomic big " The country has ratified the CISG is mentioned in the treaty as"The Contracting States " Unless excluded by the terms of a contract expressed, theCISG is considered to be incorporated into (and replace) any domestic law does notapply if a transaction concerning goods between parties from different Contracting

CISG has been described as a great legislative achievements, and "internationaldocument the most successful so far," the law of international sale of goods unified,partly because of the flexibility Its operation allows countries signing the optionalexception for a certain number of terms This flexibility is helped to persuadecountries with different legal traditions register a different uniform regulations.Some countries have signed the CISG has declared and dedicated some provisionscovered by this Convention, although the vast majority - 55 of the 76 countriespresent signed - has opted Convention without any specific terms yet
Another international regulation is Incoterm 2010 standard interpretation of tradeterm in International Chamber of Commerce This basis defines the right, risk andobligation clearly between consignee and consigner in international trade
6 Related documents in freight forwarding services for import and export cargoes
Freight forwarding services by sea requires a lot of vouchers The classifieddocuments have important implications in the management and use documents Forsimplicity and ease of navigation, we can be divided into two categories:
- Export voucher:
When exporting goods by sea, forwarder is entrusted by the consignor for careabout their cargo from customs clearance until cargo are loaded onto the ships Thedocuments used in this process are as follows:
Customs documents:
a Customs declaration
Customs declaration is a document that are declared by shippers or carrier toproduce to the customs authorities before the goods or vehicles export or importthrough the national territory
International practices and Vietnamese law stipulates the customs declaration ismandatory for export or import vehicles through the national gate All violations asundeclared or dishonest declared will be handled under existing laws
b Foreign trade contracts
The foreign trade contract is an agreement between the involved parties thatheadquartered are in different countries, according to which the exporter is obliged
to transfer to importer a certain property called cargo Importer are obliged toreceived goods and pay for the purchase
c Certificate of business registration and certificate of businesses registration code

d Cargo list
Cargo list is the detailed documentation of goods in shipments It creates favorableconditions for the inspection of goods Also it has additional effects for the invoicewhen the shipment includes many kinds of different name and the different levels
Vouchers for ports and ships
Being entrusted by the shippers forwarder contact to ports and ships to trackhandling goods processes The documents used in this phase include::
- Ship’s stowage plan
a Instruction queue:
This is indicative of the shipper for shipping companies and port authorities,companies handling, provide full details about the goods to be delivered to port forloading on ships and the necessary instructions,
c Bill of Lading
Bill of lading is a transportation document seaborne goods by the carrier or theiragents for the consignor after the goods are loaded onto ships or after receipt ofgoods for loading
Bill of lading is an very important, fundamental transport document about theoperations of the consignor to the carrier, the consignor to the consignee It acts as aproof of commodity exchanges, a evidence of the contract of carriage

After delivery export cargo, the exporter must prepare a commercial invoice It isthe request of the seller requires the buyer to pay the amount they have beenrecorded on the invoice
c Packing list
The packing list is the inventory for all the goods contained in a shipment Thepacking list is used to describe how to package goods such as parcels are divided

e Insurance vouchers
Forwarder at the request of the exporter can buy insurance for the goods Insurancedocuments are the documents issued by the insurance agency for export and importunit for certifying the insured goods and proof of insurance contract Insurancevouchers is often used as an insurance policy or Certificate of Insurance
7 FCL and LCL
FCL: FCL is the abbreviation of the phrase "Full Container Load" is used in theshipping industry internationally for export and import goods for sea transport.This term is often used to describe an international maritime service designed forocean freight of the goods that an exporter, importer has exclusive use of a transportcontainer Dedicated marine loading (typically a 20ft container or 40ft) Containerfreight by sea usually are loaded and sealed at the base and then transported by acombination of sea, rail and / or road to last place
LCL: In the field of freight forwarding goods LCL abbreviation of the phrase: Lessthan Container Load This phrase describes how the transport of goods when thegoods are not enough to packing in an entire row of containers, so that it shouldmelding with some batches of the other shippers
Meanwhile, the company will combine retail shipments (LCL shipments), sort,classify and starred in the container, then arrange transportation from the port to thedestination port The combination packaging together so-called consolidation, orconsolidation
8 Freight forwarding general process
Export process:
Absolving: Enterprise must be licensed for export in competent authorities, askonce for multiple occurrences
