SECTION 01000 - GENERAL PROVISIONS

DESCRIPTION

The “General Specifications” shall be applied complementarily to theConditions of Contract and the Technical Specifications

" Approval " or " Acceptance " used in this Specifications shall be

effective with written documents Verbal Approval or Acceptance shall beauthorized by the written documents later

In addition to the “Definitions and Interpretations” shown in Clause 1 ofthe General Conditions of Contract, the following abbreviations are used inthe General Specifications and Bill of Quantities and they shall beinterpreted as follows:

REQUIREMENTS

APPLICABLE STANDARDS

(a) The newest versions of currently applicable Vietnamese Standards,

codes in technical matters shall prevail to the Specifications If thereare any discrepancies in the requirements and statements in theSpecifications, the clarifications and/or the decisions by theEngineer shall prevail in any case of discrepancy, ambiguity orcontradiction

(b) Unless otherwise specifically provided in the Specifications, or the

Drawings, the standards, codes described on the materials,acceptance tolerance, measurement or payment methods etc., theEngineer shall advise the Contractor appropriate measures for thesolutions

(c) If the Contractor’s proposed materials are produced in compliance

with standards other than those specified above, then the

Contractor shall submit, for the Engineer’s review and approval, a

detailed construction statement including construction drawingsand engineering data, documentation including cross reference thatthe proposed standards of his materials are, at least, comparable tothose specified in the Specifications and are in compliance with theequivalent standards which are internationally recognized

(d) During construction period, the Contractor and Supervision

Consultants shall comply with “Standards applied for Survey andDesign of Noi Bai – Lao Cai Highway Project”, which was approvedvia Decision No.2223/QD-BGTVT dated 17 July, 2007 by Ministry ofTransport List of applicable standards is shown in the Table 2.1below:

Work is paid for directly or indirectly according to each respective Section

of work as specified in Sub-section “Measurement and Payment” of therespective Section, and some of specified items shall be adjustedaccording to Specification Section 01850 “Acceptance of Work”

The requirements established in this Specification Section are classifiedinto the following types:

Indirectly Paid

Work:

The requirements for those items for whichmeasurement for separate payment is not neededbecause they are deemed included in the rates andprices for other main items, or distributed among all thepay items listed in the Bill of Quantities

Directly Paid

Work:

The requirements for those items for which a separatepayment will be made based on the quantitiesmeasured and approved in accordance with thisSpecification Section

Inherently

Paid Work:

The items or requirements established or described inthese Specifications but not listed for payment asspecific Pay Items in the Bill of Quantities, are deemedincluded in or distributed among all the rates and pricesentered in the unit prices of the Bill of Quantities.Separate payment will not be made for these items andclaims based on miss-consideration of the same will berejected

SECTION 01050 - GENERAL WORKS

(a) No later than 30 days after issue of the Letter of Acceptance, the

Contractor shall prepare and submit to the Engineer a list ofdelivery forecasts for each significant material/equipment requiredfor the Project The listing shall show the target order dates,shipping and receiving dates and quantities of each requiredmaterial/equipment

(b) Unless otherwise specifically provided in the Contract, all items

incorporated in the completed work, such as equipment, materialsand other articles, are to be new and the most suitable grade forthe purpose intended Unless otherwise specifically provided in theContract, reference to any equipment, material, article, or patentedprocess, by trade name, make, or catalogue number, shall beregarded as establishing a standard or quality and shall not beconstrued as limiting competition, and the Contractor may, at hisoption, use any equipment, material, article, or process which, inthe judgment of the Engineer and Employer, is equal to that named.Unless otherwise specified or instructed, all proprietary materialsshall be used in accordance with the Manufacturer's instructions

If materials and equipment to be installed under this contract arelikely to be replaced or repaired as a part of future maintenance,the Contractor shall only use materials and equipment, which arereadily available in Vietnam or which are compatible with thereplacement parts readily available in Vietnam

Where required by the Engineer, the Contractor should submitevidence of his compliance with this requirement

When required by the Engineer, the Contractor, before placing anyorder for materials or manufactured articles to be incorporated inthe Permanent Works, shall submit for approval a completedescription of such items, the names of the firms from whom heproposes to obtain them, and a list of such of the items that he

proposes the firms should supply When so directed, the Contractorshall submit samples and certificates for approval.

(c) The dates in the list shall be in accordance with the approved

Contractor’s Program and Mobilization Plan (as mentioned in Clause2.2 of Section 01300) The Contractor shall update this list whenpreparing the certificate for payment, or at any time required by theEngineer

1.1.2 RECEIVING, HANDLING & DELIVERY

(a) All equipment, component parts, tools, spare parts shall be suitablypackaged against damage or deterioration during transit to andshort term storage in Vietnam

(b) Painted surfaces shall be protected against impact, abrasion,

discoloration, and other damage

(c) Grease and lubricating oil shall be applied to all bearings and similar

items

(d) Articles subject to damage or deterioration shall be repaired or

replaced by the Contractor at no expense to the Employer

(e) The Contractor shall provide required information concerning the

shipment and delivery These requirements also apply to any suppliers making direct shipments to the job site or the port of entryinto Vietnam

sub-(f) The project name, name of the Contractor, and the name of the

Employer must be clearly indicated on the air waybill or bill oflading

1.1.3STORAGE

(a) Storage Facilities:

Materials shall be stored so as to ensure preservation of theirspecified quality and fitness for the work They shall be placed on ahard, clean surface and, when required, they shall be placed undercover Stored materials shall be located so as to facilitate promptinspection Private property shall not be used for storage purposeswithout written permission of the owner and lessee and payment tothem, if necessary

The Contractor shall provide and maintain storage facilities withinthe limits of the Site The Contractor shall submit to the Engineer forreview complete details of the type of temporary storage facilitiesproposed with his Mobilization Program

5 Pipe fittings and valves may be stored outdoors but must beplaced on wooden blocking and protected from weather.

6 PC tendons, sheath and related parts shall be kept in warehouse

in the manner specified by manufacturers

7 PVC pipe, geotextile membranes, plastic liner and other plasticmaterials shall be stored off the ground on pallets andprotected from direct sunlight

8 Pumps, motors, electrical equipment, and all equipment withantifriction or sleeve bearings shall be stored in weather-tightstructures Electrical equipment controls, and insulation shall

be protected against moisture and water damage

9 Equipment having moving parts, such as gears, bearings, andseals, shall be stored fully lubricated with oil, grease, etc.,unless otherwise instructed by the manufacturer TheContractor shall carefully follow the manufacturer’s storageinstructions

10 Off-site storage arrangements shall be subject to the approval

by the Engineer for all materials and equipment notincorporated into the Works but included in applications forpayments Such off-site storage arrangements shall bepresented in writing, and shall afford adequate and satisfactorysecurity and protection

1.1.4 SPECIAL LOADS

(a) On the preparation of “Traffic Control Plan” specified in Section

01600, where Special Loads necessitate the strengthening, altering,protecting and/or improving any bridge, culvert or road, theContractor shall provide to the Engineer complete details of theContractor’s intended procedure

The Contractor shall observe the requirements of Clause 4 of the

General Conditions of Contract and is responsible for carrying

out any necessary investigations at his own expenses and theobtaining of approvals, licences, escorts and any other necessaryfacilities in order to enable extraordinary traffic to be moved on theroads in the project area

(b) The above-mentioned details shall include the following:

1 Details of Constructional Plant, Plant and/or Temporary Works to

be moved including the total weight of load;

2 The proposed date and time of such movement;

3 The starting location and destination;

4 The proposed route;

5 The bridge(s), culvert(s) and/or road(s) which require(s)strengthening, altering, protecting and/or improving;

6 Full details of any such strengthening, altering, protectingand/or improving, including any and all necessary designcalculations;

7 Traffic safety measures while the load is in transit; and

8 Evidence that the Contractor has liaised with and obtained allnecessary permissions, permits and the like from allappropriate authorities

PROJECT MEETINGS

The Contractor shall be responsible for making all the necessaryarrangements and incidentals for preparing and supporting the meetingsfor the Project

1.1.5 PRE-CONSTRUCTION CONFERENCE

(a) A Pre-Construction Conference shall be held at a time and place

designated by the Employer, prior to the commencement date

specified in Clause 8 of the General Conditions of Contract.

(b) The conference shall be attended by:

1 Employer’s Representative

2 Engineer’s Representatives

3 Contractor’s Project Manager

4 Contractor’s General Superintendent

5 Contractor’s Project Engineer

6 Contractor’s Quality Control Manager

7 Contractor’s Safety Representative

8 Governmental representatives, as appropriate

9 Stakeholders or others, as requested by the Employer, theEngineer, or the Contractor

(c) The Contractor shall provide and explain the following at the

conference:

1 The construction Program and respective schedule

2 The schedule of values for progress payment purposes

3 The schedule of construction drawings and other submittals(d) The Engineer will, in advance, advise the full agenda of theConference, will preside it, and will arrange for keeping anddistributing the minutes to all attendants

1.1.6 PROGRESS MEETINGS

(a) The Engineer shall schedule and hold Progress Meetings

regularly either monthly, weekly or at any other time asrequired by the Engineer or the Contractor The Contractorshall provide sufficient support to the Engineer for organizingsuch meetings, but not be limited to the following:

1 Weekly Returns

At weekly intervals the Contractor shall supply to theEngineer returns of labour, materials and Contractor’sEquipment, and a schedule of the main work items in eachsection of the Works showing quantitative progress duringthe previous week and cumulative progress to date On thelast day of each week the Contractor shall issue to theEngineer details of his intended programs of work for theweek ahead

2 Monthly Returns

At monthly intervals, and not later than the last date of themonth, the Contractor shall submit to the Engineer progressreport documentation for the month, which shall include,but not be limited to the following:

 a program marked up with any agreed amendments andshowing the actual percentage completion of each of themain items of work, so that comparison can be madewith the scheduled percentage completion of each item;

 weather and other conditions, including dailytemperature range, humidity, rainfall, wind speed anddirection, river levels etc.;

 summary of staff and labour employed on the Site;

 schedule of Contractor’s Equipment on Site with dates ofarrival and departure as appropriate; and periods ofstandby breakdown

 schedule of principal material items with dates of placingorders, progress of manufacture, dates of delivery toSite etc.;

 record of Site safety and environmental protection;

 record of documentation;

 photographs and video CDs as described in Clause01150-Contractor’s Submittals.

(b) The purpose of the meetings is to improve aspects related to

coordination, and to review the progress of the Works,monitoring all the approved Programs, plans and schedules forthe work, submittals, Quality control, etc

(c) The meetings shall also be held to prepare, update and

monitor the problems, or potential problems, that are affecting

or could affect the Project

(d) The Engineer will preside the meetings and take care of

keeping and distributing the respective minutes

(e) The Contractor’s Project Manager, Quality Control Manager,

Safety Officer, Scheduler and other key personnel as required

by the Engineer or as necessary for presentation of relevantinformation and data, shall attend the Progress Meetings

1.1.7 MEETINGS WITH INSTITUTIONS AND ENTITIES CONCERNED

(a) The Contractor shall provide sufficient support to the Engineer for

preparing and holding periodic meetings for coordination andreporting with all the Project’s stakeholders concerned

(b) The pertinence and necessity of these meetings will be determined

by the Engineer at his discretion

1.1.8 SUBMISSION OF RETURNS/ REPORTS

Three copies (01 original and 02 copy) of all progress returns /reports shall be submitted to the Engineer, and two copies shall besubmitted to the Employer The submission of progress returns /

reports shall not relieve the Contractor of any responsibilities inrespect of notices, records, particulars, documents, or drawingsrequired by other clauses of the Conditions of Contract andSpecifications.

PROJECT CEREMONIES

The Contractor shall be responsible for making all necessaryarrangements and incidentals in preparing and supporting the ceremoniesfor the Project following his duty as description on Condition of Contract orSpecifications

INSURANCE AND WARRANTY

(a) These requirements shall be read and applied complementarily, and

without detriment, to the requirements and provisions stated inrespective Sub-clauses in relation with the insurances instructed inClause 11-Defects Liability and Clause 18-Insurance of the GeneralConditions of Contract or Specifications

(b) The Contractor shall provide evidence of insurance policies prior to

the start of work

(c) With each interim payment request, the Contractor shall submit

evidence consisting of receipts of payment or other verification asapproved by the Engineer that insurance policies are in effect

(d) The Contractor shall be responsible for all costs for and associated

with the warranty period of the Works in accordance with therelated provisions of the General Conditions of Contract

2.5 PROTECTION OF WORKS

(a) The Contractor shall carefully protect all work and materials from

injury by the weather, or by other external action If the event workdefects or injures are detected, these shall be repaired or replaced

at the Contractor’s expense, subject to the Engineer’s approval.

(b) Prior to placing the facilities in any area, all clearing and grubbing

operations shall be done to the satisfaction of the Engineer Theground elevation of all temporary facilities shall be 30 cm inminimum above the adjacent existing ground The surface shall beadequately sloped to allow rainwater to adequately drain

2.6 PROTECTION OF UTILITIES AND EXISTING STRUCTURES

(a) Before commencing construction work the Contractor shall

undertake a survey to establish the detailed location of all utilitiesaffected by the Works Survey results shall be recorded in plan form

to the satisfaction of the Engineer and surface pegs fixed on the site

to indicate the location of all underground utilities These pegs shallremain for the duration of the Contract

(b) Where works are to be undertaken by the Contractor in the vicinity

of utilities, the Contractor shall provide adequate protective devicesand take precautionary measures

(c) The Contractor shall be responsible for locating all existing

structures prior to the start of construction Any delay or extraexpense to the Contractor shall not constitute a claim for extrawork, not for additional payment, not for time extension, and not forcompensation due to damage

(d) The Contractor shall maintain all existing fences until completion of

the Work They shall not be relocated or dismantled, until writtenpermission is obtained from the fence owner

(e) Damage to Existing Property:

1 The Contractor shall be responsible for all damage to streets,roads, railroads, curbs, sidewalks, highways, shoulders,ditches, embankments, culverts, bridges, or other public orprivate properties

2 Unless otherwise the Contractor could show the reasonablejustification, all of the damage shall be deemed to be caused

by the transport of the Contractor’s equipment, materials, orpeople to or from the Works

3 The Contractor shall repair or replace any damaged structures,works, materials, or equipment to the satisfaction of theEngineer, and at no additional cost to the Employer

2.7 MAINTENANCE OF EXISTING WATERWAY

(a) The Contractor shall take all necessary measures to remove water

including ground water flows from the area of his work whennecessary, and/or as required by the Engineer, to allow satisfactoryexecution of work in progress or for the protection of completedwork

(b) The Contractor shall maintain all of the existing drainage and the

irrigation channels entering, crossing or affecting the works thatshould be relocated or protected This shall include, where required

by the Engineer, the cleaning of upstream and downstream to anextent of 100 m beyond the construction limits and the Right-of-Way

(c) Payment for works specified in Clause 2.7 Section 01050 shall not

be paid separately but deemed to be included in other relatedworks in Division 3- Earthwork, and Division 4 – Drainage System ofthis Specification

Payment shall be considered to be full compensation for all expenses

involved in the work and the Contractor's estimate will be assumed

to be based on a thorough study of the work required and shallinclude, but not be limited to, the provision of pumps, temporarydams, temporary realignment of the flow, the construction oftemporary water courses, ditches and drains and shall be deemed

to cover the cost of working in any season of the year and forworking in flows of both storm water and sewage contaminatedflows.The Engineer may at any time withhold payments formaintenance of existing drainage and irrigation channels made bythe Contractor if, in the opinion of the Engineer, the requirements ofthis Specification Section are not duly complied

(b) Other Temporary Installations:

1 External Lighting: Suitable external lighting shall be provided

at the entrance to all buildings

2 Maintenance: During the performance of the Works the

Contractor shall maintain all temporary facilities in a suitablemanner to the satisfaction of the Engineer

3 Removal: Upon completion of the Works, or as otherwise

directed by the Engineer, all plant, temporary facilities andencumbrances used for the Works shall be removed, the areaaffected properly cleaned and repaired and, if necessary, theproperty owner paid

(c) Removal: Upon completion of the Works, the Contractor shall

remove from the Site all construction plant and equipment provided

by the Contractor, any subcontractor or supplier

(d) Employer not Liable for Damage to Plant: The Employer shall not at

any time be liable for the loss or damage to any of theconstructional plants and equipment provided by the Contractor orany subcontractor or supplier

MEASUREMENT AND PAYMENT

The work herein defined as “Indirectly Paid Work” shall neither bemeasured nor paid separately, and shall deemed included in the rates andprices for other main items, or distributed among all the pay items listed

in the Bill of Quantities

-SECTION 01100 – CONTRACTOR’S MOBILIZATION AND

Clause 4 “The Contractor”,

Clause 8 “Commencement, Delays and Suspension”,

Clause 10 “Employer’s Taking Over”,

Clause 11 “Defects Liability”of the General Conditions of Contract

MOBILIZATION PROGRAM

(a) The Contractor shall submit to the Engineer, for his review and

Approval, a detailed Mobilization Program This Program shall besubmitted as an attachment of the “Programme” specified in Clause8- Commencement, Delays and Suspension” of the GeneralConditions of Contract

(b) The Program shall include a schedule noting the anticipated arrival

of all construction equipment and facilities as well as the arrival ofall key personnel of the Contractor and subcontractors

(c) Moreover, the mobilization Program shall include a layout plan

noting the location, size and arrangement of all temporary facilities,including security fencing and entrance and exit gates, sewage andwater lines and systems, electrical supply and access and facilityroads

(d) The Contractor shall complete the construction of all temporary

facilities and the mobilization of all key personnel, equipment and

plant no later than 120 days after the date of the Notice to Proceed This completion date shall be established as a mile stone

specified in Section 01300

SUPERINTENDENTS AND ASSISTANTS

(a) The Contractor shall mobilize and keep all the key staff as required

in the Prequalification (PQ) Documents, General Conditions ofContract and the Specifications

(b) The Contractor shall not remove his staff from the site without the

express written permission of the Engineer Within fourteen (14)days of any such removal, or notice of intent of removal, theContractor shall nominate a replacement staff for the Engineer’sApproval

LAND FOR CONSTRUCTION PURPOSES, DETOURS, PLANT AND OTHER USES

(a) The Contractor shall acquire all additional working areas and any

additional areas required for construction purposes and access orother uses as stipulated in the Specifications

(b) Before entering the work site, the Contractor shall give written

notice to the Engineer The Contractor shall give separate notices toeach owner and occupier or authority having jurisdiction over thework sites

(c) Before entering any additional work areas the Contractor shall

obtain, and forward to the Engineer, a copy of the written consent

of the owner and occupier or authority having jurisdiction over theland, and shall state the purposes for which such land is to be used.The Contractor shall define the extent and period of occupation forwhich such consent is granted

(d) The Contractor shall select, arrange for and, if necessary, pay for

the use of sites for construction purposes, detours, plant and otheruses necessary for the execution of the Works

(e) Before using any land belonging to the Government or to a private

landowner for any purposes in connection with the execution of theWorks, the Contractor shall get the Engineer’s Approval for suchuse

(f) If any utility passing through the temporary site is affected by the

Works, the Contractor shall at his own expense, shall provide anappropriate plan for re-alignment or relocation of such utility in fullworking order to the satisfaction of the owner of the utility and theEngineer, before cutting or removing or relocating the existingutility

(g) On completion of the Contract, or earlier if so directed by the

Engineer, all plant, temporary facilities and any otherencumbrances shall be removed, the site and land use areas shall

be properly cleaned, all damage made good, and, if necessary, theland-owner paid for the use of the land

CONSTRUCTION EQUIPMENT AND PLANT

All construction plant and equipment provided by the Contractor shall,when brought on to the Site, be deemed to be exclusively intended for theconstruction and completion of the Works and the Contractor shall not

remove the same or any part thereof without the approval of the

Engineer

CONTRACTORS SITE OFFICE, SHEDS, STORES AND LIVING QUARTERS

The Contractor shall supply, equip and maintain for the Contract period allhis own living accommodation, site offices, sheds and stores necessary forthe execution of the Works, and shall make his own arrangements, subject

to the approval of the Engineer, with the owner of any land required and,

if necessary, pay for its use

CONTRACTORS WORKSHOP AND WAREHOUSE

The Contractor shall have on the Site a suitable workshop, adequatelyequipped and provided with utilities, to allow for repairs of the equipmentemployed to carry out the Works He shall also provide a warehouse forthe equipment spare parts, mainly for the parts that frequently fail or aredifficult to procure A chief foreman qualified for mechanical repairs, with

an adequate labor force shall be assigned for management and operation

of the workshop

SUBSIDIARY REQUIREMENTS FOR CONTRACTORS FACILITIES

1.1.1 TEMPORARY ROAD AND BRIDGE WORKS:

In accordance with his Temporary Roads and Bridges Plan (reviewedand approved by the Engineer) the Contractor shall:

Furnish, maintain, and remove on completion of the Works for whichthey are required, all temporary roads and road works such asstaging over roads, access and service roads, temporary crossingstructures over channel or unstable soil area for which the work isrequired Concurrently, they should be suitable for any means oftransport to bring construction manchines to the Site, to makeaccess roads for means of transports of the Contractor or otherpeople, or for whatever purpose Such temporary road works shall

be constructed to the satisfaction of the Engineer in accordancewith the actual traffic, and shall be maintained in practicalconditions all the times

Make all necessary arrangements, including payment if required,with the public authorities or landowners concerned, for the use ofthe land, (before constructing the works for temporary roads, and

obtaining the Engineer’s prior approval) The Engineer’s approval

shall depend upon the Engineer’s satisfaction with the Contractor’sproposals for items such as paving, signs installation, lighting andriding Quality of the temporary road together with the proposed

maintenance arrangements Such approval will not, however,

relieve the Contractor of his responsibilities under the Contract.Upon completion of the Works the Contractor shall clean up andrestore the land to the satisfaction of the Engineer

Where temporary traffic ramps are required, or if so requested bythe Engineer, the Contractor shall furnish all the labor andmaterials, construct and maintain such temporary traffic ramps tothe satisfaction of the Engineer

Temporary bridges and roads shall have width of lane andstructures satisfying demand and requirement for use and inaccordance with prevailing Vietnamese standards and Specification

at the time of design

The design, construction and maintenance of all temporaryapproach, access roads, temporary bridges and roads shall be theresponsibility of the Contractor

If single lane temporary bridges are provided, the Contractor shall

be responsible for controlling the traffic flow over the bridge, 24hours per day, seven days a week, including all holidays.Accordingly, flagmen equipped with two-way radios shall beprovided on each approach to each temporary bridge to coordinateand direct traffic flow on the bridge(s)

Upon completion of permanent bridges and approach roads, orearlier if so directed by the Engineer, the Contractor shall removeall temporary bridges, approach and access roads and reinstate theused areas to their original condition

The Contractor shall provide to the Engineer for review andcomment : Complete temporary bridge design calculations anddrawings Drawings shall fully detail all bridge constructionrequirements and note all material the Contractor intends to use;Complete temporary bridge approach and access road drawings,which shall note the road surface, proposed by the Contractor andall roadway drainage and proposed drainage structures

1.1.2 PROJECT INFORMATION SIGNS.

Within the mobilization period, the Contractor shall erect projectinformation signs at locations as required by the Engineer The sizeand material of the project information signs and the messagethereon, and style of lettering and color, shall be determined by theEngineer The Contractor shall maintain the signs and remove themupon completion of the construction period

1.1.3 SECURITY FENCING

Security fencing with at least three (3) strands of barbed wire shall

be constructed around all temporary facilities Fencing shall be atleast 1.8 meters high and provided with lockable gates at eachentry and exit point

1.1.4 TEMPORARY LIGHTING FOR ALL BUILDINGS AT SITE

(a) The Contractor shall provide temporary lighting for all buildings at

Site, to protect the Works and maintain suitable working conditions (b) The Contractor shall provide and install circuit and branch wiring,

with area distribution boxes located so that power and lighting areavailable throughout the construction site

(c) Generators with a suitable capacity shall be furnished by the

Contractor to cope with the cases of power supply cut-off

1.1.5 SANITARY FACILITIES

The Contractor shall furnish temporary sanitary facilities at the Site,

as provided herein, for the needs of all construction workers andothers performing work or furnishing services on the Project.Sanitary facilities shall have reasonable capacity, be properlymaintained throughout the construction period, and obscured frompublic view to the greatest practical extent If chemically treatedtype toilets are used, at least one such toilet shall be furnished for

every 20 people The Contractor shall enforce the use of such

sanitary facilities by all personnel at the Site

1.1.6 WATER

(a) All water required for and in connection with the equipment and

plant, devices, dust control, for settling of backfill material or forany other use as may be required for proper completion of theWorks, shall be provided by and at the expense of the Contractor.(b) In case of shortage of water for use in the construction works, the

Contractor shall draw water from a well or wells dug at theContractor’s expenses, after Approval by the Engineer

(c) The Contractor shall provide a sufficient supply of bottled drinking

water from an acceptable source to all of the Contractor’semployees, including all necessary devices for keeping the water ingood condition (hot and cold water)

1.1.9 CONTRACTORS WEIGH-HOUSE AND SCALE

(a) The Contractor shall provide a weigh-house and acceptable scales

or other weighing devices, which shall be part of the ConstructionalPlant

(b) Scale platform shall have a sufficient length to permit simultaneous

weighing of all axle loads of each hauling vehicle

(c) Each weighing device shall be accurate within 0.5 percent

throughout the range of use, and shall be inspected, tested, andsealed by the Contractor’s Independent Testing Laboratory, as often

as necessary and/or as the Engineer may deem necessary to assurecontinued accuracy

(d) The Engineer may permit the use of weighing devices for a

reasonable period prior to sealing, provided field-testing indicatesconsistent compliance with the limits of accuracy specified herein (e) The Contractor shall have on hand not less than ten (10) standard

weights of twenty-five (25) kilograms each The Contractor’sIndependent Laboratory shall be employed for testing the scales asoften a necessary and/or as required by the Engineer

(f) Standard scales, certified by the Government, or owned by a

responsible local authority, may be used subject to the Approval ofthe Engineer

(g) Truck platform scales for weighing bituminous products shall be

equipped with automatic printing devices to record time andweight, and one copy of each weight ticket shall be kept by theEngineer after each measurement of weight

FILLING-IN HOLES AND TRENCHES

The Contractor, upon completion of any part of the Works, shallimmediately, at no additional cost, fill up all holes and trenches that hemay have dug or excavated and are no longer required for the Project, orshall carry out such relevant work as required by the Engineer, and heshall clear away all rubbish and material that are no longer required forthe execution of the Works All costs related to this requirement shall bedeemed included in the Contractor’s Unit Prices for the applicable work

METHOD OF MEASUREMENT

Mobilization shall not be measured, but shall be paid as a lump sum

BASIS OF PAYMENT

Payment for Mobilization shall include:

(a) Transport of Construction Plant based on list of equipment and plant

which was submited in the Bids or whatsoever additional equipmentand plant required, from the port of unloading in Vietnam to thesites of bridges, tunnel and highway in construction process andinstallation of such equipment and plant;

(b) Supply, installation and maintenance of the Contractor’s vehicles,

accommodations, offices, laboratories (but excluding supply of theContractor’s Lab’s Equipments and Contractor’s SurveyingEquipment as described in Section 01750-Laboratory and LAB’sEquipment), workshops, stores, communication system, facilities,Project Information Signs, etc.;

(c) Construction, maintenance and removal of temporary road and

bridge works;

(d) Dismantling of the work site by the Contractor, with the removal of

all the installations, constructional plant and equipment, so that thesite is restored to the state it was in before the installations orplacing;

(e) Protection and restore land acquisition and right of way markers,

which have been handed over to the Contractor, in order torehanover to the Management Unit

(f) All the works including the costs for all incidentals works necessary

to comply satisfactorily with the requirements of this SpecificationSection

Payments shall be made in lump sum by the following installments:

30% (thirty percent) on substantial completion of items from (a) to

(c) and written acceptance of the Engineer and approval of the

Employer on the Contractor’s Site offices, Laboratories andMobilization Program

50% (fifty percent) on substantial completion of items (d) to (e) in

accordance and proportionally with the Contractor’s Mobilization

Program, and upon the acceptance by the Engineer; and

20% (twenty percent) in the Final Certificate on completion of all

necessary dismantling and restoration of the Site and acceptancewriting by the Engineer and approval of the Employer

No additional payment shall be made for any additional mobilization ofpersonnel, plant, equipment and materials

SECTION 01150 – CONTRACTOR’S SUBMITTALS

This Specification Section prescribes the form and contents of thedocuments or materials for the Works that shall be submitted to the

Engineer for review and approval, or for testing in accordance with the

requirements in the Specifications

REQUIREMENTS

SUBMITTALS CLASSIFICATION AND LIST

The submittals established are classified, and listed up, into the followingtypes:

(a) Directly Paid Submittals, including all related submittals, are

listed below:

List of Directly-paid Submittals is as follows:

- Schedule for preparing Drawings, Technical Drawings, Drawings (attached with Vietnamese translation), zero statedocuments of bridge and other similar items as specified inSection 01200 (Contractor’s Drawings) in these Specifciations

As-Built Program, Schedule, Cash-Flow including all the relatedsubmittals as specified in Section 01300 “Program of Works” ofthese Specifications

- Monthly Progress Reports, Quality Control Summary, SafetySummary, Equipment Report and all the related submittals asspecified in Section 01400 “Monthy Progress Report” of theseSpecifications

- “Construction Photographs and Video Recording” including allthe related submittals as specified in these Specifications

(b) Indirectly Paid Submittals: Submittals which are not paid directly

as they are deemed to include in proportion and unit price of therelated major work items or have been incorporated in the entire

work items listed in the BOQ

(c) Inherently Paid Work:

The submittals that may be required during the Contract execution,

or as required by the Engineer, but are not specifically specified ordescribed in the Specifications or the Bill of Quantities, shall bedeemed included in or distributed among all the rates and pricesentered for the unit prices of the Bill of Quantities; Separate

on miss-consideration of the same shall be rejected

REQUIREMENTS FOR THE CONTRACTOR’ SUBMITTALS

These requirements shall be applied complementarily to the submittalsspecified in the General Conditions of Contract

All the submittals specified in each Section of these Specifications, to bemade by the Contractor shall be submitted at the specified time

All submittals specified in these Specifications shall be provided in hardcopies with editable electronic files recorded on the approved software orapplications The standard submission requirements are:

Latest edition of all standards, regulations, guidelines,

specifications, technical papers, monographs, catalogues, and

other technical documents required

(b) Every month during construction implementation at each time and

each location designated by the Engineer, photographs shall betaken and submitted in attachment with monthly report of theContractor

Each month the Contractor shall select approximately 36 (thirty six)representative photographs to form an album of the monthsactivities Each photograph in the album shall be standard postcardsize and suitably captioned The Contractor shall supply threecolour prints of each of the photographs mounted in an album Thealbums shall be of acceptable quality and three copies and thedigital file shall be delivered to the Engineer at the start of thefollowing month

(c) Photographs at intervals of no more than 200 meters along the

route of the works shall be taken prior staring the work andsubmitted immediately to the Engineer The same view from thesame points shall be taken upon completion of constructionactivities for any work section and submitted together with theContractor’s Monthly Report or as otherwise specified by theEngineer

(d) Photographs shall be taken for every structure location with number

of photos as specified by the Engineer

(e) The Contractor shall take construction photographs by camera with

automatically recorded date-month-year and/or by digital camera sothat such photographs can be created on computer The Contractorshall supply both “hard” and computerized copies of photographs

as required by the Engineer The Contractor shall provide thenecessary software to the Engineer for computerized storage,editing and reproduction of photographs

(f) The use of film camera is not allowed

(g) Each photograph shall be suitably captioned

(h) The Engineer may at any time withhold payments if, in his opinion,

the provisions for construction photographs made by the Contractorare not in compliance with these requirements

(i) The photographs and digital originals shall form a part of the

records of the Employer and the prints of the same cannot besupplied to anybody else or published without the writtenpermission of the Employer

a) The Contractor shall keep a video recording of the construction

progress and salient features of the Project Upon completion of theWorks, the record shall be edited and compiled, based on thefollowing specifications:

(b) The Contractor shall submit the outline of the narration process

prior to the compilation of the video record, for the approval of the

Engineer The final video record shall be produced by a specializedcompany approved by the Engineer, and submitted to the Employerand the Engineer within 30 days after the issuance of the Taking-Over Certificate

MEASUREMENT AND PAYMENT

MEASUREMENT

The supply of submittals shall be paid as a lump sum

BASIS OF PAYMENT

a) Payment shall include:

 All costs necessary and required for the proper preparation,updating, and maintenance of the items comprising thesubmitted materials in accordance with the requirements andstipulations of this Specification Section

 all the supplemental documents, corrections, materials,expertise staff, computer applications, and any otherincidentals applied for the purpose

b) The Engineer may at any time withhold payments if (in the opinion

of the Engineer) submittals and materials specified herein are notprovided, or otherwise rendered, in compliance with therequirements and procedures of this Specification Section

c) Payments shall be made in the following three installments:

10% (ten percent) upon the issuance of the Engineer’s approval

of the documents or materials prepared for each respectiveitem as required herein and submitted by the Contractor forthe first time after commencement of the Works;

70% (seventy percent) over the duration of the Contract

Construction Period (counting from the accepted First InterimPayment Certificate by Employer to the last time in theContract) split in partial payments in proportion to the workprogress, upon the Engineer’s approval of the submitted items

to be paid for, and on the condition that no delays in thesubmittals were reported by the Engineer; and

20% (twenty percent) upon the issuance of the Engineer’s

approval of the completed item prepared (approval of all theAs-Built Documents and Zero Status Documents for Bridge)and submitted by the Contractor after completion of the Works,and for last time in the Contract
