Trang 4EMPLOYER'S REQUIREMENTS - GENERAL
These Employer's Requirements are divided into seven sections as follows:
(1) General: these apply throughout the Contract
(2) Functional: these include the specific requirements for the design, construction,
performance and function of the Works
(3) Design: these apply in respect of duties relating to the design of the Works
(4) Construction: these apply in respect of additional requirements relating to the
construction of the Works
(5) Manufacturing, Installation and Testing: these apply to the requirements
relating to manufacturing, procurement & delivery of plant and equipment and the requirements for testing and commissioning
(6) Particular Requirements: these provide general information and particular
requirements for Contract Package-1b
(7) Appendices: these provide further requirements relating to sections (1) to (6)
above
In addition to the words and expressions defined in the Conditions of Contract, further following words and expressions shall have the meaning assigned to them except where the context otherwise requires:
- “As-Built Documents”: means the set of drawings and records, which is
submitted during the Construction Phase in accordance with Clause 3(10) of the Employer’s Requirements – Design
- "As-Built Drawings": means those drawings produced and endorsed by the
Contractor as true records of construction of the Permanent Works The As-Built Drawings are subject to review and issue of a Notice of No Objection by the Employer’s Representative
- "Combined Services Drawings" (CSD): means drawings showing the locations,
layouts and sizes of all services including those of other contractors co-ordinated
so as to eliminate all clashes
- "Construction Phase": has the meaning identified in Clause 7 of the Employer's
Requirements - General
- "Construction Technical Drawings": means those drawings referred to in
Clause 3 (2) of the Employer's Requirements – Design
- "Construction Gauge": means the profile related to the designed normal
Trang 5co-ordinated axis of the track into which no part of any structures or fixed equipment (except for overhead catenary) may penetrate
- “Construction Design”: means a set of drawings and documents, which is
submitted in accordance with Clause 3(2) of Employer’s Requirements – Design
- "Construction Design Pack": comprises the Construction Technical Drawings,
Work Specifications, Working Drawings and all other associated documents necessary to supplement the design covered in the Technical Design and to comply with the Contract regarding the construction of the Works such as detailed Method Statement, Safety Risk Assessment etc The contents of the Construction Design Pack are as defined in Employer’s Requirements – Design and further detailed in Appendix 22
- "Design Manual": means the manual to be prepared and submitted by the
Contractor as part of the Inception Design and as described in the Employer's Requirements - Design
- "Design Segment": has the meaning identified in Clause 2(5) of the Employer's
Requirements - Design
- "Design Phase": has the meaning identified in Clause 7 of the Employer's
Requirements - General
- "Employer’s Outline Specification": has the meaning identified in Clause 5 of
the Employer's Requirements - General
- “Interfacing Contractor”: means the Contractor of an interfacing Contract
Package who, in turn, has an interfacing requirement with the Contractor in order
to fulfill the Employer’s Requirements of both Contracts in the Project
- “Inception Report”: means the set of drawings and documents, which is
submitted in accordance with Clause 2(2) of Employer’s Requirements – Design
- “Key Date”: means the date by which the Contractor completes a respective Key
activity Key Dates are subdivided into two categories:
(i) Key Date for the access of the Interfacing Contractor to the Contractor’s
Site, (ii) Key Date for Tests on Completion and the Time for Completion Date For all Key Dates, Liquidated Delay Damages will be subjected at the rate given in Appendix 1 to the Letter of Tender for the period of time that the Key Date requirement remains unachieved
- "Railway Envelope": means the zone or zones within the Works containing the
trackwork and equipment necessary for the operation of the railway
- "Services, Electrical, Mechanical Drawings" (SEM): means those drawings
produced by the Contractor showing the locations, sizes and details for openings
in structural elements for MEP building services and other related Interfacing Contracts
- “Service Provider”: means a person or entity approved by Implementing agency
Trang 6and national HIV/AIDS authority (i.e Ministry of Health, relevant national government to have responsibility for HIV/AIDS prevention) to provide the HIV Awareness and Prevention Programme
- "Technical Design": means a set of drawings and documents, which is submitted
in accordance with Clause 2 (4) of the Employer’s Requirements - Design
- "Works Specification": means the final Specification used for the construction of
the Permanent Works The Works Specification shall be developed by the Contractor based on the Outline Construction Specifications issued by the Employer as the minimum requirement
(1) The design and construction of the Works shall comply with Ministry of
Transportation (MOT) approved codes of practice and standards current at the time of submission of Tender
(2) The approved codes and standards for this project are the Japanese Ministerial
Ordinance providing the technical standards on railways with commentary enacted
by the Japanese Ministry of Land, Infrastructure, Transportation and Tourism (Ministerial Ordinance, MLITT-J), Design Standards for Railway Structures and Commentary issued by Railway Technical Research Institute, Japan (RTRI-J), General Specification for Standard Urban Railway System for Asia (STRASYA) issued by Japan Railway Technical Service (JARTS) and Vietnamese Standards Regulations made and requirements issued by the Vietnamese Government and
by relevant utility Authorities shall be followed and specified
Besides, all the design and construction standards approved for this Project are listed and explained in Appendix 28 to the Employer’s Requirements The Contractor does not need to get approval from Vietnamese competent organizations for the application of those standards
(3) In the event of a conflict between the provisions of the following relevant
documents the order of precedence will be:
- Employer’s Requirements
- Outline Design Specifications and Outline Construction Specifications
- Vietnamese and other International Standards referenced herein
- Vietnamese and other International Standards
(4) Alternative or additional codes, standards and specifications proposed by the
Contractor shall be internationally recognized codes and shall be, or be equivalent
to
(5) The Contractor shall be responsible for getting prior approval from the Ministry of
Transportation for any alternative or additional codes of practice and standards
(1) The Employer’s Drawings show the Employer’s Requirements in terms of the
Trang 7concept, intent, function, purpose, structural form and architectural appearance of the Permanent Works The intended extent and location of structures and facilities, including passenger facilities, is shown In addition to the functional purpose, provision is made for integration with existing roads, buildings and future developments
(2) The Employer’s Drawings is a set of reference drawings Unless otherwise
specified in the Employer’s Requirements (Vol.3), Outline Design Specifications (Vol.4) and Outline Construction Specifications (Vol.5), the dimensions of specific elements and details and all other dimensions shown on the Employer’s Drawings are indicative only and shall be determined by the Contractor and, where relevant, coordinated with Interfacing Contractors
(3) The horizontal and vertical alignments have been developed and the Right of Way
has been defined accordingly Minor changes to vertical alignments will be allowed, to provide clearances to critical structures, on consent from the Employer’s Representative
(4) Where the Employer’s Drawings indicate the locations of existing utilities these are
for information only and are assumed to be approximate It is the Contractor’s sole responsibility to ensure that the precise nature and location of all existing utilities are ascertained prior to undertaking any related design or construction of the Works
(5) The Employer’s Drawings are listed in the Appendix 1 to the Employer’s
Requirements
In accordance with the provisions of these Employer's Requirements, the Outline Design and Construction Specifications contained in the Volume 4 and 5 respectively shall be considered as the minimum requirements for the Works The Outline Construction Specifications shall be developed into the Works Specification by the Contractor during the Design Phase and submitted as part of the Technical Design Submission When the Works Specification has received a Notice of No Objection from the Employer’s Representative it shall be used for construction and shall take precedence over other Specifications
The Contract shall utilize the SI system of units
(1) The Contractor shall execute the Works in two phases, the Design Phase and the
Construction Phase
(2) The Design Phase shall start from the Commencement Date and shall include the
completion and submission of the Inception Design and the Technical Design The requirements for the Inception Design and Technical Design are stated in Clause
2 of the Employer's Requirements - Design
Trang 8(3) The Design Phase shall be considered complete upon the issue of a Notice of No
Objection in respect of the last Technical Design Submission which comprehensively and completely forms the Technical Design for the whole of the Works
(4) The Contractor shall be responsible for further development of the conceptual
layouts of the stations indicated in the Employer’s Drawing and to develop the architectural, electrical and mechanical building services, station environmental control systems and tunnel ventilation, lifts and escalators Surface works will include station access, shafts, staircases and other facilities, including commerical areas and basic services to cater for bookstalls, telephone booths, etc., landscaping, modal-interchanges with road and pedestrian traffic, illumination, water supply, drainage, electric supply etc
(5) The responsibility for design, supply, installation testing and commissioning of lifts
and escalators, trackway exhaust and tunnel ventilation is that of the Contractor The Contractor shall also provide for passenger time-space facilities and fire safety modes, etc., including the electrical supply and interfacing control for these items in his design The Contractor shall lead the co-ordination with the contractors who have to execute these items Any related civil works, viz.; construction of sub-station rooms and buildings, shafts, cable gallery, earth mats, inter-modal transfer development, etc., shall also be executed by the Contractor for Contract Package -1b
(6) The Contractor shall be responsible for establishing the locations, depths, etc of
the existing structures, foundations, utilities etc to such accuracy as to enable the design and construction of the Works to proceed duly protecting these and adjacent structures Immediately on discovering and likely conflict with the Works, the Contractor shall inform the Employer’s Representative
(7) The Construction Phase for the whole or a part of the Works shall commence
immediately upon the issue by the Employer's Representative of a Notice of No Objection in respect of the relevant Technical Design Submission Such Notice may be issued by the Employer’s Representative in respect of a Technical Design Submission covering a major and distinctive part of the Works in accordance with the Design Submission Programme However, construction shall not be commenced until the appropriate Construction Technical Drawings and other documents forming the Construction Design Pack have been endorsed as "Good for Construction" in accordance with the procedures in Employer’s Requirements - Design
The Construction Phase shall also include the completion and submission of the Construction Design and the As-Built Documents and other handover records as specified The requirements for the Construction Design and As-Built Documents are stated in Clause 3 of the Employer's Requirements - Design
Trang 98 PLANNING AND PROGRAMME REQUIREMENTS
The Contractor shall prepare and submit his Initial and Final Works Programme to the Employer’s Representative for review in accordance with the Contract and as further
described in Appendix 15 to the Employer’s Requirements
(1) The Contractor shall utilize an efficient Project Management Information System to
transmit formal project correspondence, documents and information For this purpose, the Contractor shall apply Aconex, a web-based information management system, as required in Appendix 21 to the Employer’s Requirements (2) The Contractor shall transmit all submissions to the Employer’s Representative
according to the procedure laid down in Appendix 21 to the Employer’s Requirements
The Contractor shall establish and implement a Quality Management System for the design and construction of the Works as described in Appendix 11 to the Employer’s Requirements This Quality Management System shall be applied without prejudice to, or without in any way limiting, any Quality System that the Contractor already maintains
(1) During the design and construction of the Works the Contractor shall conform to
all requirements relating to the environmental protection as detailed in Appendix
12 to the Employer’s Requirements All applicable Vietnamese Environmental Laws and Codes and all current national standards established by the Ministry of Natural Resources and Environment (MONRE), Government of Socialist Republic
of Vietnam and other government agencies for control of environmental pollutants such as air, water, noise and visual impacts/aesthetics shall be strictly followed for compliance during the design and construction phases
(2) The Contractor shall prepare and submit the Site Environmental Management
Plan (SEP) to the Employer’s Representative as a part of the Inception Report submission SEP shall be consistent with the provisions of the Employer’s Outline Environmental Management Plan given in Appendix 13 to the Employer’s Requirements Upon receipt of the Notice of No Objection, the Contractor shall implement his SEP for the duration of the Contract
(1) The Contractor shall take all measures necessary to safeguard the health and
welfare of the general public, employees and all other persons entitled to be upon the Site and shall ensure that the Works are carried out in a safe and efficient manner
(2) The Contractor, his Sub-Contractors and all persons employed by him on the Site
Trang 10shall comply in every respect with the provisions of any relevant statutory regulations and/or with the requirements of Vietnamese Law as may be considered applicable to the Works
(3) As part of the Inception Report Submission, the Contractor shall prepare and
submit to the Employer’s Representative for consent his proposed Site Safety Plan which shall be based on and expanded from his Outline Site Safety Plan submitted with his tender and which shall address the requirements described in Appendix 14 to the Employer’s Requirements
To ensure the quality of software development process, the Contractor shall comply with the requirements of the BS EN ISO 9000-3:1997 “Guidelines for the Application of ISO
9001 to Development, Supply and Maintenance of Software” Where the software is to be supplied by an organization other than the Contractor, the Contractor shall pass on all requirements in their entirety and without modification The Contractor shall, however, remain responsible for the execution of the Works
The Contractor’s attention is drawn to the requirement that access to the Site or parts of the Site will, from time to time, have to be shared with interfacing contractors carrying out works on, or in the vicinity of the Site including, without limitation, works relating to:
- Contract Package 1a: Civil (Ben Thanh Central Station)
- Contract Package 2: Civil (Elevated and Depot);
- Contract Package 3: E&M, Rollingstock, Trackwork, Maintenance;
Contract Package 3 comprises the following Sub-Systems:
1 Train Control and Signalling and Maintenance
2 Telecommunication and Maintenance
3 Platform Screen Door and Maintenance
4 Facility SCADA and Maintenance
5 Rolling Stock and Maintenance
6 Power Supply System and Maintenance
7 Overhead Contact and Maintenance
8 Trackwork and Maintenance
9 Depot Workshop & Equipment and Maintenance
10 Automatic Fare Collection and Maintenance
11 Signage and Graphics and Maintenance The Contractor shall fully integrate and coordinate the Design and Construction of the Works with all Interfacing Contractors and Interfacing Bodies and Entities and shall
Trang 11actively seek out solutions to integration issues, and to anticipate, plan for, and comply with the needs of these Interfacing parties, which are properly required and consistent with the obligations under the Contract The Contractor shall comply in this respect with the requirements of Appendix 2D to the Employer’s Requirements Further details regarding the design related interface with others are given in Clause 4 of Employer’s Requirements – Design and Clause 2 of Employer’s Requirements - Functional
The Contractor shall make provisions for temporary utility services such as power, lighting, water, communications and drainage for Contract Package 3 (CP-3) Contractor The Contractor shall ensure that all temporary services to remain in place until the equivalent permanent service has been installed and commissioned, unless otherwise authorized by the Employer’s Representative The Contractor shall also ensure that the temporary services do not interface with the Permanent Works or prevent the installation and testing
of the permanent services by others Where necessary the Contractor shall temporarily divert or relocate the temporary services during the course of the works at the Contractor’s cost The detailed requirements are described in Appendix 6 to the Employer’s Requirements
(1) The datum used for the Contract shall be Mean Sea Level Datum of Vietnam (2) The grid coordinate system used for the Contract shall comply with VN2000
Coordinate System
(3) The Contractor shall carry out all further site investigations he deems necessary
for the design of the Works
The Contractor shall, both in the design and construction of the Works, take full account of the climatic conditions throughout the Site Indicative information on climatic conditions has been obtained from the South Regional Hydro-Metrological Centre in Ho Chi Minh and
is given in Appendix 17 to the Employer’s Requirements
(1) The Contractor shall have a competent team of managers, engineers, technical
staff, experts and support staff etc so as to complete the work in a satisfactory manner in compliance with the requirements of the Contract
(2) The designations of the various project organizations team members shall be
accepted by the Employer’s Representative before adoption
(3) A control room with round the clock radio communication or telephone switch
board links with all safety offices, works sites, site offices, batching plants, casting yards workshops, fabrication yard, off site offices, Employer’s Representative’s main office, Resident Engineer’s site office, etc shall be maintained and manned round the clock Residences of all senior project team members shall also be
Trang 12linked with the control room Vehicles for emergency use should be on stand-by
at the control room around the clock
The Contractor shall ensure that the Employer’s personnel and all local contractors and sub-contractors engaged on the Works are given the opportunity for the necessary training and skills transfer in the various areas of civil and building works, Mechanical, Electrical and Plumbing (MEP) building services, safety, quality assurance, environmental protection, installation procedures and repair and replacement of plant and works
The Contractor shall prepare and submit Public Relations (PR) Plan to the Employer’s Representative The Contractor shall also carryout PR activities and public consultation works with the instruction and guidance of the Employer’s Representative Further details
of the Publicity and Public Relations are described in Appendix 25 to the Employer’s Requirements
The Contractor shall design the total system in accordance with the Disaster Prevention Policy written in Appendix 26 to the Employer’s Requirement in Vol.3, which was approved
by the relevant Authorities
In addition to the above, during the design and construction stages, the Contractor shall follow the requirements to MAUR described in the letter No 407/PCCC-P3 dated May 12,
2009 issued by Bureau of Fire Fighting & Prevention, General Department of Police, Ho Chi Minh City (Refer to Appendix 26 to the Employer’s Requirement in Vol.3.)
The Contractor shall be responsible for co-operating with the Service Provider in implementing the HIV Prevention Programme among the Contractor’s Employees for the duration of the Contract commencing as soon as practicable after the Contractor’s Employees arrival at the Site in conjunction with occupational health staff of the Contractor and the local health authorities involved in HIV/AIDS prevention Details of the Contractor’s role are described in Appendix 27 to the Employer’s Representative

Trang 15EMPLOYER'S REQUIREMENTS – FUNCTIONAL
(1) The purpose and function of the Contract is the design, construction, completion,
testing and commissioning of the Works by the Contractor in the manner and time stipulated by the Contract and to achieve the standards, performance and functionality specified in the Contract In full recognition of this purpose, and with full acceptance of the obligations, liabilities and risks that may be involved, the Contractor shall undertake the execution of the Works and handover to the Employer in a condition in which the Employer can immediately use the Works for the intended purpose, and/or to make them available to an Interfacing Contractor who can commence and carry out its work without delay or disruption
(2) The design and performance of the Works shall comply with the specific requirements contained in these Employer’s Requirements
(3) The design of the Works shall be developed in accordance with these Employer’s Requirements, the Contractor’s Technical Proposals and the other requirements of the Contract
(4) The Works shall be designed and constructed to the highest standards available using proven up-to-date good practice The Works Specification shall in any case not specify standards which, in the Employer's Representative's opinion, are less than or inferior to those described in the Outline Design Specifications, Outline Construction Specifications and other requirements contained in the Contract Documents
(5) The Building Services shall be designed, manufactured, supplied, installed, tested and commissioned in accordance with the requirements defined in Outline Design Specifications and Employer’s Requirements – Manufacturing, Installation and Testing (MIT)
(6) Construction shall be carried out in accordance with the procedures established by the Contractor in his Quality, Safety and Environmental Management Plans, and other requirements contained in these Employer’s Requirements
(2) Design and construction of two underground stations including all necessary
Trang 16structural, civil, architectural and building services works, two cut and cover tunnels, two single-track shield-driven running tunnels, station access tunnels and the structures associated with ventilation, draught relief, Traction Sub Stations, AC plant room, pump houses and any other associated facilities
(3) Design and construction of access passages, entrances, ventilation and cooling towers
(4) Design and provision of fire detection and suppression and emergency lighting
systems
(5) Design, manufacture, delivery and installation, functional testing, and handover of
a working earthing & lightning protection system
(6) Design and construction of first trackbed concrete to bored tunnel inverts
(7) Design and install well-functioned and maintenance-friendly drainage system for
foul, waste and storm water including all associated facilities
(8) It is the intention of the Employer to plan for the maximum commercial
underground space that is practical in conjunction with the Opera House station at concourse level The designer should identify and make provision in the temporary and permanent works with self bearing structural elements for a smooth connection to CP-1a later without disturbance of the CP-1b’s operation
(9) Design and manufacture, supply, installation testing and commissioning of all Mechanical, Electrical and Plumbing (MEP) building services including;
- station and tunnel ventilation and track exhaust systems; The ventilation
system shall satisfy the final stage requirements after completion of CP-1a
- air conditioning and station environmental control systems;
- elevators and escalators;
- Plumbing (PLMB) and drainage system; duly taking into consideration the
water inflow/leakage from the inclined connected tunnel part of CP-1a
- Low Voltage (LV) and Middle Voltage (MV) power supply including
emergency power supply with Uninterruptible Power Supply (UPS);
- lighting system under normal conditions;
- remote monitoring & operation (as necessary) for designated equipments;
and
- stray current corrosion control (installation only, to be designed and
provided by the CP-3 Contractor) (10) Coordination:
- With Contract Package 2 Contractor for the integrated design of the
transition from CP-2 Works and this Contract Works in accordance with the Interface Requirements of Employer’s Requirements - General Clause
14 and Employer’s Requirements – Design Clause 4;
- With designer of CP-1a for the integrated design of the transition and
interface between CP-1b and CP-1a works
Trang 17(11) Detection and disposal of Un-Exploded Ordnances
(12) Execution of Subway Environmental Simulation (SES) analysis and Passenger
Flow Simulation (PFS)
(13) All Temporary Works associated with construction of the Works including
temporary decking over cut and cover structures under roadways to allow uninterrupted flow of traffic
(14) Such additional survey and geotechnical investigation that the Contractor deems
to be required
(15) Survey, instrumentation, ground treatment, ground and building monitoring, risk
analysis, settlement prediction, preventive and corrective actions
(16) Underpinning and protection of existing buildings and structures wherever required (17) Traffic management along the worksite including works connected with traffic
management
(18) Diversion and support of utilities during construction except those proposed to be
done by the Employer through separate agency
(19) Restoration of roads, utilities and other services dislocated during construction (20) The related miscellaneous works are scheduled in Appendix 25
(21) Operation and Maintenance of Environmental Control System (ECS) and
Elevators/escalators for underground stations and tunnels for two (2) years after the date of Taking–Over Certificate
(22) Supervision of maintenance works for civil works, architectural works, building
service works, facilities and plants constructed or installed under the Contract for two (2) years after the date of the Taking-Over Certificate
(23) All other works and services ancillary or related for the full completion of the Works
and other obligations under the Contract
(1) The alignment shall be as shown in the Outline Design Specifications and Employer’s Drawings The alignment has been developed by the Employer to meet operational and technical criteria The Contractor is not required to evaluate the alignment for compliance with these criteria, but shall review it with respect to his own design and construction proposals and shall satisfy himself that there is
no conflict with existing structures which are to be preserved
(2) The Contractor is not permitted to propose deviations in horizontal alignment The Contractor is permitted to propose minor deviations in vertical alignment to suit his construction proposals, but he must demonstrate that any such deviations shall comply with the alignment requirements of Outline Design Specifications including vertical clearance requirements and obtain the consent from Employer’s

(1) The Works shall not infringe the Construction Gauge as shown on the Employer’s
Drawings
(2) The Works shall provide for the installation by the CP-3 Contractor of operating
equipment for the railway without infringement of the Construction Gauge
(3) Railway clearances:
(4) Various clearances shall be provided as per the schedule of dimensions approved
for the HCMC Line 1 (5) Construction limits:
The limits of land for the Works are shown on the Right of Way Drawings The Contractor shall design the Works to be contained totally within these limits, respecting the regulations and/or all relevant Laws
(6) The location and the size of the area for Opera House Station’s Ventilation Shaft is
shown in the drawings; 1/AR/1025 and 1/AR/1032 Especially, there is Commercial space for public in front of the shaft on the ground level The size and the height of the space are shown in the drawings as described above This Commercial space shall be developed by HCMC
(1) The Works shall be designed and constructed such that, if maintained reasonably
and in accordance with the Contractor's statement of maintainability contained in the Contract, they shall endure in a serviceable condition throughout their minimum design lives as described under Clause 4 of the Outline Design Specifications
(2) The Works shall be designed and constructed so as to minimize the cost of
maintenance whilst not compromising the performance characteristics and ride quality of the railway
(3) Electrical and mechanical equipment for Building Services shall be of a quality and
durability fully to meet the operational requirements described in the Outline Design Specifications
Trang 19fundamental objective and as a priority, ensure that passengers, staff and the public will, throughout the operational period of HCMC Line 1, and within the confines thereof, be provided with as safe an environment as is reasonably possible The Contractor's attention is directed to Clause 13 of these Employer's Requirements - Functional
(3) The design of the Works shall be met without congestion occurring and without risk to the safety of passengers or railway employees including during any emergencies All station entrances, pedestrian walkways and other access structures shall be designed to accommodate easy access to the stations from all key points of pedestrian densities The passenger number, densities and peak flow rates are given in Clause 38 of the Outline Design Specifications
(4) The vertical and horizontal alignments for the main line trackwork shall accord with the following limits:
- Minimum Horizontal Radius 300 meters
- Maximum Vertical Grade 3.5 % (5) Particular attention shall be paid to locations where flooding could enter or otherwise damage the railway
(6) Entrances and all other points of access to the underground stations and tunnels shall be adequately protected against flooding
(7) During construction the Contractor shall be responsible for providing and
maintaining adequate flood protection to ensure protection of the Works
(8) Stations, trackways and tunnels shall be so designed that proper conditions of
train operation and safe passenger evacuation in emergency can be secured in coordination with the design of ventilation systems
Maintenance requirements are described in Appendix 18 to the Employer’s Requirements The Contractor shall follow the requirements
(1) The Works shall be designed to achieve high aesthetic character
(2) All structures shall share a common aesthetic that identifies them as component
parts of the UMRT
(3) Consideration shall be given to incorporating both desirable local architectural
traditions and international modern design
(4) Allowance shall be made for identifying and implementing a design commonality
that includes, but is not limited to, materials, finishes and components
(5) The architectural requirements given under Clause 23 of Outline Design
Specifications shall be taken into account in the design of the Works

The Contractor shall note that it is likely that the Employer will engage a railway inspectorate to inspect the Works from time to time for the purpose of determining whether the Project complies in terms of operational safety with recognized current international standards Notwithstanding other provisions of the Contract, the Contractor shall ensure that the Works comply with the reasonable requirements of the railway inspectorate
(1) Certificate for Safety of Site against UXO
The Contractor is informed that the whole area of the construction Site within the right-of ways including Depot Area had been certified safe against unexploded ordnance (UXO) by the Engineering Brigade 25 / Military Zone 7 assigned by the Ministry of Defense, in accordance with Vietnamese Law at Decision No 639/QD-BQP dated 17th March 2009 through conducting ordnance survey on the said area Name of organization: Engineering Brigade 25

(2) Measures against UXO
Notwithstanding the certificate for safety against UXO as mentioned above, if and when the Contractor encounters UXO or accident thereof at the Site during the execution of the Works, he shall immediately stop the work, evacuate all people from the accident spot, administer first aid if wounded and report to the Employer’s Representative
Investigation and treatment of UXO will be carried out by Engineering Brigade 25 / Military Zone 7 of the Ministry of Defense through the request and at the expense
of the Employer The Contractor is strictly instructed not to detect nor touch UXO The construction works on the spot and its vicinity should not be resumed until Engineering Brigade 25 / Military Zone 7 has completed investigation and treatment of UXO and issued a safety certificate on such area again
(3) Cooperation of the Contractor
To help the activity of Engineering Brigade 25 / Military Zone 7 at the Site, the Contractor may be asked to provide his materials and Equipment on the premise
of ensuring the safety of his staff and operators, if and when the Employer so requested For such assistance, the Contractor will be paid by daywork basis
(1) The Contractor shall provide physical models for 1) Opera House station and 2)
Ba Son station… within 6 month after the Commencement Date, or other date agreed by the Employer’s Representative
The scale of the physical models shall not be less than 1 in 200, and these models shall include tunnel section of a minimum 10 cm length in scale at the both end of station, and a minimum 2 set of physical models of trains for each physical model (2) The Contractor shall provide physical models for Shield Machine within 6 month of
the date of Notice to Proceed, or other date agreed by the Employer’s Representative
The scale of the physical model shall not be less than 1 in 20
(3) The dimensions, necessary components, and cases & covers of the physical
models shall be agreed by the Employer’s Representative
(4) These physical models shall be displayed in a dedicated room of the Employer’s
Representative’s Main Site Office

Trang 24EMPLOYER'S REQUIREMENTS - DESIGN
The Works, including the Temporary Works, shall be designed and constructed in accordance with the Contract and shall conform to the Employer’s Requirements and the obligations of the Contract generally
(1) The Employer's Requirements - Design, specifies the requirements for the
preparation and submission of the design of the Works These requirements are subdivided into those that are to occur during the Design Phase, those that are to occur during the Construction Phase, and those that are of general application (2) The Contractor shall, in accordance with Clause 5.1 of the Conditions of Contract,
engage a Designer who shall undertake and prepare the design of the Works including the Temporary Works The Contractor shall establish an office for his core design team at the Site in Ho Chi Minh City The core design team shall function from this office and all meetings and discussions relating to design shall
be held in this office In addition to the express requirements herein, the Contractor shall, whenever the Employer's Representative so requests, provide information and participate in discussions that relate to design matters
(3) The Contractor shall ensure that the Designer continues to be represented in Ho
Chi Minh City at all times by staff whose seniority and experience are to the satisfaction of the Employer's Representative and whose representative is available on the Site as necessary or as required by the Employer's Representative
(4) There are four Design Stages covering the Design Phase and Construction Phase:
(i) INCEPTION REPORT (ii) TECHNICAL DESIGN (iii) CONSTRUCTION DESIGN (iv) AS-BUILT DOCUMENTS The requirements for each Design Stage are detailed in Appendix 22
(5) The Contractor shall submit all four stages of design in accordance with the
Employer’s Requirements herein and as further detailed in Appendix 22 to the Employer’s Representative, in accordance with Conditions of Contract Clause 5 for consent and issue of Notices of No Objection
Trang 25(6) The Employer’s Representative will review the submissions in accordance with the
Contract to be satisfied that the submittal covers the obligations, extent and intended purpose of the design of the Works and fully complies with the Contract The Design Stages and their relationship with Phases, construction activities and Contract dates are indicated below in Figure ERD-1

The principal requirements of the Design Phase are the production of the Inception Report and the Technical Design
(1) Within 45 days after the Commencement Date, the Contractor shall submit the
Inception Report as described herein and as further detailed in Appendix 22 to the Employer’s Representative for consent in accordance with Conditions of Contract Clause 5 and issue of a Notice of No Objection
(2) The Inception Report shall be based on the Contractor's Tender Design and
Technical Proposals and shall be sufficiently developed to define the main elements of the design and shall include the main documentation needed to prepare and develop the Technical Design and to demonstrate compliance with design requirements Full details of the contents of the Inception Report are given
in Appendix 22
(1) The Technical Design shall be the Inception Report developed to the stage at
which all elements of the Works are fully designed and specified and shall detail and illustrate, in full, the Permanent Works
(2) During the preparation of the Technical Design, the Contractor shall in particular:

(ii) delineate all main and all other significant elements;
(iii) complete all tests and trials and all selection of materials and equipment; (iv) take full account of the effect on the Works of the proposed methods of
construction
(v) complete all surveys, investigations and testing necessary to complete the
design of the Works in accordance with the Contract
(3) Engineering studies and comparative evaluations shall be performed to ensure
that the designs incorporate features to achieve optimum performance of all elements In particular, the MEP Building Services design shall be reliable, energy and cost efficient with due considerations to the local climate and conditions, safety, ease of installation, operation, maintenance and future replacements (4) The Technical Design shall include the Technical Design Drawings, Works
Specification, Technical Design Report, Method Statement and all other contents
of the Technical Design as detailed in Appendix 22 (5) The Contractor shall divide the Works into Design Segments in accordance with
the “Definition of Design Segments” given in Appendix 22 and shall identify the Design Segments in the Works Programme and the Design Submission Programme
(6) Major Temporary Works shall also be identified as a separate Design Segment
Major Temporary Works shall be identified and agreed between the Employer’s Representative and the Contractor in sufficient time to meet the Design Submission Programme
(7) If necessary to meet the Works Programme, the Contractor shall further sub-divide
the Technical Design of the Design Segment into Design Packages for submission and shall be identified in the Design Submission Programme The Design Packages are to relate to significant and clearly identifiable parts and shall address the design requirements as described herein The Design Packages shall facilitate the review and understanding of the Technical Design as a whole and shall be produced and submitted in an orderly, sequential and progressive manner
to suit the construction sequence and the Works Programme
(8) The issue of separate Notices for such sub-division shall be conditional upon the
Contractor having demonstrated, to the satisfaction of the Employer's Representative, that all loadings and load combinations including temporary loadings and the effect of each structure on other structures, utilities, etc., and the effects of Interfacing Contracts for the whole Design Segment has been fully accommodated in the Technical Design Package
(9) The Contractor shall submit the Technical Design as described herein, and as
detailed in Appendix 22, to the Employer’s Representative for consent in accordance with Conditions of Contract Clause 5 and issue of a Notice of No Objection The design review process is shown in the figure below

The principal requirements during the Construction Phase are the production, submission and consent of the Construction Design, the As-Built Documents and the O&M Manuals
(1) Upon the issue of a Notice of No Objection in respect of a Technical Design
Package the Contractor shall produce the respective Construction Design Pack which shall include, inter alia, the Construction Technical Drawings, Work Specification, Working Drawings, and all other associated documents necessary
to supplement the design covered in the Technical Design and to comply with the Contract regarding the construction of the Works such as detailed Method Statement, Safety Risk Assessment etc and as further detailed in Appendix 22 (2) The Construction Technical Drawings shall be derived directly from the Technical
Design Drawings by the Designer and shall be identical to the Technical Design except for the amendments that may be necessary to resolve and respond to any comments attached to the Notice and shall be upgraded to Construction Design in accordance with the CADD Standards Similarly the other documents of the Technical Design are likewise revised, upgraded and included in the Construction Design Pack The Construction Technical Drawings shall form part of the Drawings to be used for construction purposes
(3) The Working Drawings shall be additional drawings developed by the Contractor
as necessary to supplement the Construction Technical Drawings and to specify additional details and procedures for construction of the Works, such as shop drawings, fabrication drawings, erection drawings, Temporary Works drawings, bar bending schedules, bar reference drawings, and the like All such drawings shall comply with the consented Technical Design and other requirements of the Contract
(4) The Construction Design Pack shall be prepared as required under the Contract
and shall be fully checked and certified by the Third Party Verifier as being in accordance with the Technical Design and compliant with all requirements of the Contract The Contractor shall then endorse the original paper drawings and

(5) The Contractor shall certify the Construction Design Pack by signing and attaching
the Construction Design Pack Certificate (Form CDPC,) as the covering document Forms, further details and other requirements of the contents of the Construction Design Pack are given in Appendix 22
(6) The Contractor shall submit the Construction Design Pack as described herein,
and as further detailed in Appendix 22, to the Employer’s Representative, in accordance with Conditions of Contract Clause 5, for consent and issue of a Notice of No Objection
(7) Only those drawings and documents that have been endorsed and certified and
have received consent as above shall be issued to the Site The Construction of the Works shall be strictly in accordance with the Construction Design Pack (8) If the Contractor identifies the need for any change to the design due to site
conditions or other reason, then the Contractor shall produce a Design Change Notice or Field Change Notice in accordance with procedures described in Appendix 22 Section 4
(1) The Contractor shall maintain all records necessary for the preparation of the
As-Built Documents In accordance with the Conditions of Contract Clause 5 the Contractor shall prepare and submit the As-Built Drawings and Records which, subject to the Employer's Representative's agreement, shall become the contents
of the As-Built Documents
(2) The As-Built Drawings shall be a full set of the latest revisions of the Construction
Technical Drawings (updated to incorporate all Design Change Notices and Field Change Notices) and as many Working Drawings as necessary to convey a full and true record of the as-built condition of the Works The As-Built Drawings shall show all changes from the Construction Design, all construction deviations and all other features relevant to the future maintenance and management of the Railway and it’s facilities The As-Built Drawings shall be endorsed by the Contractor as true records of the construction of the Works
(3) The As-Built Records shall include all record photographs, survey results including
geotechnical, all inspection records, and other documents as detailed in Appendix
22 and shall be endorsed by the Contractor as true records of the construction of the Works
(4) The Operation and Maintenance Manuals (O&M Manuals) shall be included as
part of in the As-Built Documents O&M Manuals shall be submitted within the dates specified in the Appendix 18 to the Employer’s Requirements
(5) The As-Built Documents shall be submitted to the Employer's Representative, in
accordance with Conditions of Contract Clause 5, for consent and issue of a Notice of No Objection
Trang 304 DESIGN INTERFACES WITH OTHERS
(1) The Contractor shall fully coordinate the design of the Works with the design of the
Interfacing Contractors and shall follow the interfacing requirements detailed in Appendix 2D
(2) The Contractor shall ensure that the requirements of each Interfacing Contractor,
such as transition structures for the adjacent civil Interfacing Contractor and the provision of builder’s work for the rail systems Interfacing Contractor including, inter alia, Overhead Catenary System (OCS) pole foundations, cable troughs and cableways, railway construction gauge and envelope, maintenance access and delivery routes for the installation and replacement of the plant, provisions of access facilities, including to and from the trackway, lifting hooks and beams, and personnel access and means of escape, are fully coordinated and provided for in the design of the Works Clarification of Provisions for Interfacing Contractors is given in Appendix 2E
The Contractor shall fully coordinate the design of the Works with all relevant bodies and entities, in particular Government Authorities, Departments and regulatory bodies, utility companies, and the consultants, Project Management Units and contractors of adjacent Projects whether ongoing or planned, in particular those along Dien Bien Phu Road and the Hanoi Highway, for example the Hanoi Highway widening Project The Contractor shall identify such Interfacing Parties in his Interface Management Plan (IMP) and other relevant requirements detailed in Appendix 2D to the Employer’s Requirements,
(1) The designs for all four Design Stages shall be submitted for review and consent
to the Employer's Representative The form and detail of the review shall be as determined by the Employer's Representative and will not release or remove the Contractor’s responsibility for the design under the Contract
(2) The issue of a Notice of No Objection will be without prejudice to the issue of any
future Notices
(3) The Contractor shall, prior to the submission of the Technical Design, obtain all
required and/or statutory approvals that relate to that submission including, where appropriate, the approval of the concerned government authorities and utility companies, and demonstrate that all required approvals have been obtained (4) Supplemental, supporting information to the design submission under review may
be requested by the Employer’s Representative The Contractor shall supply such information quickly and efficiently
(5) All submissions shall be accompanied by two original copies of a `Design
Certificate' (Form DC)and signed by the Designer and the Contractor and two original copies of a ‘Third Party Verifier Certificate’ (Form 3PVC) and signed by

(1) The Contractor shall prepare the Design Submission Programme which is to set
out fully the Contractor's anticipated programme for the preparation, submission and review of the Design Packages, the issue of Notices for all stages of design The Design Submission Programme shall cover all submissions during the Design Phase and the Construction Phase
(2) The Design Submission Programme shall:
(i) be consistent with and its principal features integrated into the Works
Programme, and shall show all relevant Milestones and Key Dates; (ii) identify dates and subjects by which the Employer’s Representative’s
decisions should be made;
(iii) make adequate allowance for periods of time for review by the Employer's
Representative and other review bodies;
(iv) make adequate allowance for the design and development of specialist
works;
(v) include a schedule identifying, describing, cross-referencing and
explaining the Design Packages into which the Contractor intends to divide the Technical Design; and
(vi) indicate the Design Interface and Co-ordination periods for each
Interfacing Contractor
(3) The Contractor shall submit the Design Submission Programme to the Employer's
Representative within forty-five (45) days after the Commencement Date, and thereafter up-dated versions thereof at intervals of not more than one (1) month throughout the Design Phase Such updates shall be included as an exhibit in the Contractor’s Monthly Progress Report
(1) Unless otherwise required by the Employer's Representative, calculations shall not
be submitted with the respective Design Package submissions
(2) Within two (2) months following the Notice in respect of the last Technical Design
Package and the last Construction Design Package the Contractor shall prepare and submit, in a form acceptable to the Employer's Representative, a comprehensive set of calculations for the whole of the Technical Design and the Construction Design respectively Should the design of the Works be revised thereafter and such revision render the submitted calculations superseded, then the Contractor shall prepare and submit revised calculations
(3) The Employer's Representative may require the submission of applicable software,
computer input and programme logic for prior to the acceptance of any computer output
Trang 32(4) The Contractor shall submit all calculations necessary to support proposals
relating to the construction methods
The Contractor is required to carry out the computer simulation analysis of the ventilation system for the whole of the underground section, including consideration of Interfacing Contractors' works such as the vehicles, traction power equipment The ventilation system shall be simulated, designed and installed to satisfy the final stage requirements including the CP-1a section In case the design of Ben Thanh Central station is not available in due time, the existing structures shown in the Tender Documents can be used for the simulation purpose
The Contractor shall submit a Initial SES Analysis to the Employer's Representative for consent within 60 days after the Commencement Date This Initial Report will provide a typical example of the use of the SES program together with a commentary on the results obtained and will be based on section of the works using typical or initial data inputs The detail requirements for SES are given in Appendix 22 to the Employer’s Requirements
The report shall outline the basic characteristics of station planning adopted by the contractor highlighting them in the order of importance The report shall include the specific characteristics of each station The report shall also include a computer simulated passenger flow module showing the peak flow, delayed and emergency conditions, for Opera House station The detail requirements for the passenger flow analysis are given in Appendix 22 to the Employer’s Requirements
Detailed requirements regarding the number of copies of drawings and documents required for submissions, the acceptable file formats and content formats are given in the CADD and Documents Manual in Appendix 4 to the Employer’s Requirements

(1) The Contractor shall submit a Staff Organization Plan in accordance with the
Conditions of Contract This plan shall be updated and resubmitted whenever there are changes to the staff The plan shall show the management structure and state clearly the duties, responsibilities and authority of each staff member (2) The site agent and his associates/supervisors shall have experience and
qualification appropriate to the type and magnitude of the Works Full details shall
be submitted of the qualifications and experience of all proposed staff to the
Employer's Representative for his consent
The Contractor shall, prior to commencing the construction of the Temporary Works,
submit a certificate to the Employer's Representative signed by him certifying that the Temporary Works have been properly and safely designed and checked and that the Contractor has checked the effect of the Temporary Works on the Permanent Works and has found this to be satisfactory
for contractor’s works with solely contractor’s own expenses
(4) The Contractor shall comply with the requirements described in Appendix 23.1
The Contractor shall be responsible for the survey reference points The Contractor shall comply with the requirements described in Appendix 23.2
(1) The Contractor shall be responsible to take care of the Works during construction
and the finished Works
(2) The Contractor shall comply with the requirements described in Appendix 23.4
Trang 366 DAMAGE AND INTERFERENCE
(1) Work shall be carried out in such a manner that there is no damage to or
to be removed or diverted to enable the Works to be carried out Such items shall not be removed or diverted until the consent of the Employer's Representative to such removal or diversion has been obtained
(2) Items which are damaged or interfered with as a result of the Works and items
which are removed to enable the Works to be carried out shall be reinstated to the satisfaction of the Employer's Representative and to at least the same condition
as existed before the Work started
(3) The Contractor shall comply with the requirements described in Appendix 23.5
Followings are the major required items in Appendix 23.5;
- Utilities
- Structures, Roads and Other Obstructions
- Removal of Graves and other Obstructions
- Protection Adjacent Structures and Works
(1) The existing utility facilities identified within the Project's ROW, except drainage
system, shall, in principle, be relocated and/or diverted by the relevant Utility Companies at their risk and responsibility prior to the Contractor's possession of the Site The costs of relocation and/or diversion shall be paid by the Employer from the Project's counterpart budget, in accordance with the terms and conditions
of contract agreed between the Employer and the relevant Utility Companies
Trang 37(2) With regard to the Utility facilities which cannot or do not need to be relocated
and/or diverted prior to the Contractor's possession of the Site but require temporary diversion and/or protection during construction, these works shall be carried out by the Contractor as a Variation under Clause 13 of the Contract The costs of such works shall be paid by the Employer from the Contract physical contingency amount, in accordance with the cost estimate agreed between the Employer's Representative and the Contractor and approved by the competent authority concerned
(3) The utility facilities not identified prior to the Contractor's possession of the Site but
require temporary diversion and/or protection during construction, shall be carried out as a Variation under Clause 13 of the Contract This work shall be agreed beforehand by the Employer and the Utility Companies The costs of such works shall be paid by the Employer from the Contract physical contingency amount, in accordance with the cost estimate agreed between the Employer's Representative and the Contractor and approved by the competent authority concerned
Details on the execution and costs of diversion, relocation and/or protection of utility facilities are described in the Employer's Requirements - Appendix 23 Items 6.1and 6.2
The Contractor shall carry out the Works so as to minimize disruption to road and pedestrian traffic In order for that, the Contractor shall comply with the requirements and described in Appendix 23.7 Followings are the major required items in Appendix 23.7;
- Traffic Management Plan
- Mitigation of Traffic Disturbance
- Temporary Traffic Arrangement
- Use and Reinstatement of Roads and Footpaths
The Contractor shall provide, maintain and remove the site accommodations, facilities, etc deemed to be required by the Contractor The contractor shall comply with the requirements described in Appendix 23.8 Followings are the major required items in Appendix 23.8;
- Employer’s Representative’s Accommodation for off Site Work
- Contractor’s Site Accommodation
- Latrines and Washplaces
- Site Utilities and Access
- Submission of Particulars

The Contractor shall be responsible for the security of the Site In order to fulfill this, the Contractor shall comply with the requirements described in Appendix 23.9
The Contractor shall be responsible for all on-site and off-site testing and for all in-situ testing
Daily on-site testing shall be coordinated with the Employer’s Representative A programme of proposed tests shall be provided on a weekly basis, at least one week in advance of such events
Notification of required Factory testing (including Tunnel Boring Machine (TBM)) shall be made in writing to the Employer’s Representative, including full details of test requirement,
at least 15 days in an advance of the test
The Contractor shall note that the Employer and the Employer’s Representative (in total 3 persons) will witness TBM Factory Test and Segment Factory Test and inspection of Dot-Point Glass In addition, three inspections selected from Elevator, Escalator, ECS Chiller, Air Handling Unit, Smoke Exhaust Fan and Building Automation System will be witnessed The Contractor shall bear their costs for attendance
The Contractor shall comply with the requirements described in Appendix 23.10 herein
The Contractor shall comply with the requirements described in Appendix 23.11
The Contractor shall comply with the requirements described in Appendix 23.12
The Contractor shall construct the Works in full coordination with the Interfacing Contractors and shall comply with the requirements described in Appendix 2D
Unless otherwise directed by the Employer’s Representative, any areas disturbed by the construction activity, either inside or outside the Right of Way, shall be reinstated as follows:
All areas affected by the construction work shall be reinstated to their original condition, with new materials, including but not necessarily limited to, sidewalks, parking lots, access roads, adjacent roads, properties and landscaping Grass cover shall be provided for any bare earth surface areas, along with proper provisions for surface drainage
Landscaping design must be submitted to the relevant authorities and match the remaining areas In addition the Contractor shall carry out the design and construction of
Trang 39landscaping for all works areas and will submit his proposals to the relevant authorities for approval before commencement of landscaping works
Requirements for artwork, special interior decorations and landscaping at the stations shall
be as specified from time to time by the Employer’s Representative
The Contractor shall submit the Construction Diary to the Employer’s Representative in accordance with the Circular 27/2009/TT-BXD of Ministry of Construction, Vietnam, dated September 15, 2009
