PART 1: TOTAL NECCESITY OF PROJECT INVESTMENT

1 Legal basis of necessary setting up

- Pursuant to the Bidding Law No 61/2005/QH11 approved by the National Assembly of The Socialist Republic of Vietnam XI, 8th session on 29/11/2005, which takes effect of implementation on January 01st, 2006;

- Pursuant to the Decree No 58/2008/ND-CP of the Government on 05/05/2005 guiding the implementation of the Bidding Law and selecting the building contractors under the construction Law;

- Pursuant to the Decision No 2242/QD-EVN SPC of Southern Power Corporate on December 28th, 2011 about “personal labour protection equipment regulations promulgation in southern Power Corporate”;

- Pursuant to the “technical safety plan - labor protection in 2011” of Southern High-Voltage Electrical Network Company has been approved by the Director on March 03rd, 2012;

2 Investment necessity

- The labor protection is personal protective equipment including the tools and necessary means that during working, the employees are equipped to prevent the labour accidents and occupational diseases

- The personal protection equipment is the mandatory part of labor protection equipment that must be supplied for the employees every year

ART 2: INVESTMENT FORM

Technical Safety Department – Southern High-Voltage Electrical Network Company proposes that they were entitled to use the company’s capital of business expenses to purchase the personal protective equipment in the form of production and business development bidding

- Investment Capital: the costs of production and business of Southern High-Voltage Electrical Network Company

- As per the estimation, total investment capital: 2,429,300,000 VND (Two

billion, four hundred and twenty-nine million, three hundred thousand VND).

ART 4: PROJECT EXPLOITATION MANAGEMENT PLAN

1 Asset allocation plan: Southern High-Voltage Electrical Network Company will be responsible for allocation of the personal protective equipment quantity according to the actual needs at the units

2 Plan of exploitation, use and management responsibility for the personal protective equipment:

- The units are allocated, arranged with the storage, preservation of the personal protective equipment as per the instruction by the manufacturer, and set up the monitoring books about the allocation for the workers

- When the employees are equipped with the personal protective equipment, then they will be responsible for conserving the equipment carefully The employees

must use the equipment in accordance with the regulations when working, not for their own purposes

ART 5: TIME SCHEDULE OF PROJECT IMPLEMENTATION

Expected duration from 23/04/2012 to 30/06/2012

- Establishment and submission of the necessity: from 23/04/2012 to

25/04/2012

- Project assessment for approvement: from 25/04/2012 to 04/5/2012

- Bidding plan: from May 07th, 2012 to 31/05/2012

- Investment performance: June of 2012
