General Conformity Certification

• Certificate required with each shipment

Self-certification of general conformity applies to all products with requirements enforced by the Commission under any of the statutes it administers (including

children’s products, which later become subject to additional third party testing

requirements)

• Pool and Spa Safety Act

Third Party Testing Requirement

• Children’s products will require testing by an independent “Conformity

Assessment Body” (lab)

• Children’s product: Intended or designed for children 12 years old and younger

• No exceptions in the law for type of “children’s product”

Third-party testing requirement becomes effective for different children products over time

• Painted products (for lead paint)

• Cribs

• Pacifiers

• Products with small parts

• Children’s metal jewelry

• Baby bouncers, walkers and jumpers, etc

• All other current CPSC children’s product safety rules, including for lead content

CPSC will announce lab accreditation procedures for each of these Third party testing

is mandatory 90 days from the date accreditation requirements are announced

The dates the Act calls for announcing lab accreditation are as follows:

• Painted products (for lead paint), September 13, 2008

• Cribs, October 13, 2008

• Pacifiers, October 13, 2008

• Products with small parts, November 12, 2008

• Children’s metal jewelry, December 12, 2008

• Children’s products other than metal jewelry are subject to the 300 ppm

lead content limit of §101 of the CPSIA, May 16, 2009

• Baby bouncers, walkers and jumpers, etc., March 12, 2009

• All other current CPSC children’s product safety rules, June 14, 2009

• Certificates showing evidence of testing by an accredited lab must be in English

• May be in an additional language

• Include manufacturer name, date and place of manufacturing

• Include testing laboratory name, date and place of testing

• Contact information for individuals maintaining testing records

Accreditation of Conformity Assessment Bodies (Laboratories)

New law gives CPSC authority either to:

• Accredit laboratories to test children’s products

• Or to designate independent accrediting organizations to accredit independent testing laboratories

• Only the Commission can accredit laboratories controlled by the manufacturer

or private labeler of the children’s product in question

• Government labs must meet “baseline” accreditation requirements plus

additional conditions specified in the legislation

Accreditation of Conformity Assessment Bodies (Laboratories) CPSC staff recommendation to Commissioners:

Painted Prodocts (for lead paint)

• ISO 17025 accreditation by an ILAC-MRA accrediting body serves as the baseline criterion for CPSC acceptance of any laboratory

• Additionally, for “firewalled” manufacturer-owned labs, documentation that is satisfactory to demonstrate compliance with statutory requirements:

The Commission is notified immediately of any attempt by the manufacturer, private labeler or other interested party to hide or exert undue influence over test results; and

Allegations of undue influence may be reported confidentially to the Commission

• Baseline ISO 17025 accreditation

• Additionally, compliance with statutory conditions:
