REPORTS ON STOWAWAY INCIDENTS

Issued quarterly (July to September 2004)

1 Reference is made to FAL.2/Circ.50/Rev.1 of 9 November 1999 adopted by the Facilitation Committee at its twenty-seventh session (6 to 10 September 1999)

2 In pursuance of the provisions of resolution A.871(20) - "Guidelines on the Allocation of Responsibilities to Seek the Successful Resolution of Stowaways Cases", by means of which Governments were invited to develop, in co-operation with the industry, comprehensive strategies to prevent intending stowaways from gaining access to ships, the Facilitation Committee invited Member Governments and international organizations to provide the Organization, on a monthly basis, with:

.1 statistical data on stowaway incidents which occurred since the date of adoption of

FAL.2/Circ.50/Rev.1, using the reporting format presented in the annex; and

.2 information on their experience gained with the Guidelines and the measures taken

for, and obstacles encountered with, their implementation

3 Member Governments and international organizations were further invited to encourage shipping companies, shipowners, ship operators, ship masters and industry organizations concerned

to report, in the aforementioned format, any relevant information, for the purpose of assisting the Facilitation Committee in its further work on the Guidelines The reporting party may submit any relevant information collected to either Member Governments or international organizations for onward transmission to the Organization

4 Attached is information received since June 2004 The total number of stowaway incidents

so far reported to the Organization is 2,359, an increase of 17 since 30 June 2004

On 30/08/04 at 05:15 hrs., local immigration authorities of Bilbao boarded the ship along with two stowaways of 25 and 28 years old According

to the authorities the stowaways left the ship in the morning and were caught by immigration The stowaways claimed that they travelled on board of the Sargodha, but the crew was unaware of their presence Both stowaways are on board of the ship under Master’s Custody and will be disembarked for repatriation as soon as their nationality and identification is confirmed and travelling documents are delivered by Iranian Embassy Assistance of P& I Club has been sought The ship sailed from Bilbao on 07/09/2004 for Antwerp and also sailed from Antwerp to Bremen on 14/09/2004

Allegations were made that while the ship was docked at Dalian on 3 January, two suspected crew members sneaked the stowaways on board

The crew members were arraigned in a United States Court and each faced a maximum sentence
