CHAPTER 1 THE RATIONALE OF TRANSPORT SERVICES FOR

IMPORT AND EXPORT GOODS 1.1 General overview of transport services for trading import and

export goods.

Transport is a human economic activity that aims to meet the need tomove objects from one place to another Objects to be moved can be people, goods, vehicles, tools

In the era of globalization, the demand for goods exchange betweencountries is growing, so the import and export freight transport service wasborn and became an indispensable part in the circulation process goods fromproduction to consumption Therefore, what is import and export transportservice ? What are the rights, obligations and responsibilities of the importand export cargo transport service provider?

1.1.1 Definition of import and export freight services

Services of transporting import and export goods are commercialacts, in which a transport service provider receives goods from aconsignor, prepares necessary documents, carries out customsprocedures, organizes transportation and warehousing, performingother services to deliver goods to the consignee under the consignee'sname

The freight forwarders may be hired by the exporter or importer, depending on the payment conditions With the rapid development oftechnology, it has helped the freight service become more and morespecialized and become an area of great interest

The field of international freight transport was born a long time ago,but it was officially marked by the establishment of VANSAI in Badilay,Switzerland This company was born with the role of performing forwardingand transporting import and export goods

The service of transporting import and export goods was born to helpgoods circulate quickly, safely, economically and reduce risks for both sellers

Trang 5

and buyers Means of transport are utilized to the fullest and effectively interms of both volume and weight, shortened rotation speed reduces the risk ofcosts and time In addition, when hiring the party to perform their owntransport services, both importers and exporters reduce unnecessary expensessuch as the cost of building warehouses, hiring vehicles and labor, withoutbeing able to make the most of.

1.1.2 The rights and obligations of service providers of import and export goods

a) Providers of transport services for import and export goods have the right:

The first, requires the tenant to provide the necessary information aboutthe goods to record on the waybill and be allowed to check the authenticity ofthe information provided by the customer

The second right, requires the tenant to pay all the charges, surcharges, transportation costs , has the right to claim compensation if the customerviolates the contract

Trang 6

1.1.3 Responsibilities of persons providing services of transporting import and export goods

The responsibilities of the service provider of import and export goodsare expressed through two subjects: the hirer and the law

For the lessee, the person providing the service of transporting importand export goods is responsible for ensuring the goods are transported to theright destination, at the right time, category, without being damaged, or anydamage with goods

For law, the person providing services of transporting import andexport goods shall make customs declaration, pay taxes and send goods forinspection in accordance with the provisions of law

1.2 Features of import and export freight services

1.2.1 Concept and characteristics of air transport services

Air transport service is a combination of economic and technicalfactors to exploit air transport effectively, this is the form of transportinggoods and parcels from one place to another a guest place by plane

Cargo transport is a nascent industry compared to other transportsectors At first it was born only for military purposes, but with the increasingdevelopment of technology, air transport has shown its role in transportingpassengers, goods and becoming an important sector for the world economy

in general for international trade in particular

Making the characteristics of the air transport industry with aircrafttransport means Goods transported by this route are usually perishable, rotten, live animals, letters, time-sensitive goods, emergency relief goods, andhigh-value goods be delivered immediately, and guarantee the lowest risk

Goods sent by air usually have small volume, small weight, but greatvalue Air transport ensures goods at low risk, ensures fast time so the freight

of this road is always the highest compared to other transport routes

Trang 7

Air transport plays an important role in the exchange between nations, and is a bridge between cultures among ethnic groups This is an importantlink to link transport modes with each other like air freight / sea freight, airfreight/ trucking

1.2.2 Concept and characteristics of sea transport services

Like air transport, sea transport is a collection of economic andtechnical factors to effectively exploit the shipping by sea, this is the form oftransporting goods and parcels from one place to another by ship

Sea freight was born in the 5th century BC, this is a form that cantransport all kinds of goods in international trade Transportation routes aremostly natural routes The shipping capacity of the ship is extremely large, itcan be considered to be the largest compared to other types of transport byroad

Sea transport has a large capacity, so it is suitable for transportinglarge, large tonnage goods that other types of transport cannot carry Theadvantage of this form of transportation is its low cost However, itsdisadvantage is that it is the most compared to other types of transport:shipping by sea depends very much on natural conditions, the speed of theship is still low, and the speed of rotation of the ship is also prolonged costlyand time-consuming, the risk of sea transport is very large: can be pirates, storms, natural disasters, high humidity makes goods perishable

1.2.3 Concept and characteristics of road transport services

Similar to air and sea transport, road transport is a collection ofeconomic and technical factors to effectively exploit the transportation ofroad vehicles, this is a form of cargo transportation goods, parcels from onelocation to another by road

There are many diverse types of road vehicles such as cars, trailers, container trucks, trains, etc

Trang 8

Goods sent by the rail transport service are usually raw materials,small-sized machinery, goods not folded in time This type of transportationhas the advantage of cheap cost, flexible transit time, but it has somedisadvantages of high risk, heavy dependence on road infrastructure, andnatural factors impact.

Road transport can cost extra expenses for tolls, parking fees thistype of expense is not borne by other types

1.3 Criteria for evaluating the quality of transport services for import and export goods

Transport services are assessed in the capacity of transportation, it isnot immutable as products and consumer goods Criteria for evaluating thequality of transport services for export and import goods:

 quickness and timeliness in transport: speed is assessed at theturnaround time of transport means, the turnaround time is as fast as possible.Timeliness is reflected in the goods arriving at the destination on time, which isvery important for import and export goods because it affects warehousing, carrental cost damage to businesses The carrier must make minimum shippingtime from the point of receipt to the point of delivery It depends on the means

of transport, the time of loading and unloading of goods, the time of servicefailure due to the influence of objective factors: weather, climate or theconnection of vehicles Download intermittent

 Ensuring safety for shipment during transport: the goods are notbroken, no loss of goods and the quality of goods is guaranteed as before

 Reliability of time and accuracy of location: ensure accuracy ofdelivery time and quality of goods transport services, ensure goods arrive in theright warehouse according to the contract

8

Trang 9

 Flexibility: when an unexpected problem arises, it is required to changethe mode of transport or place of discharge to suit the reality, requiring thecarrier to be very flexible to give directions conversion scheme to ensure asmooth shipment.

 Service price: good service quality always comes with a reasonable price, because it is the optimal choice of customers

1.4 Factors affecting import and export transport service activities.

1.4.1 Economic environment, import and export situation

The economic environment has a great influence on the operation ofthe business The volatility in the economy affects all businesses, but the level

of influence on each business is not the same When an economy is growing, despite fierce competition in the market, but business producers still findmany opportunities for development In contrast, when the economy weakens, unemployment increases, interest rates rise, sales decrease with the quantityand quality of services declining In such conditions, the competitiveness ofenterprises is very limited

Import and export cargo transportation service is a sector heavilyinfluenced by the overall development of Vietnam's economy, especiallyeconomic policy, GDP growth, operations and export-import efficiency.goods on the Vietnamese market With the development of foreign trade, thedemand for international cargo transportation will increase and thus theforwarding activities of import and export goods by sea will have a chance todevelop

Specifically, Vietnam's gross domestic product (GDP) in 2019achieved impressive results, economic growth in 2019 reached 7.02% TheGeneral Department of Customs has statistics on preliminary data, ending in

2019, the total import-export turnover of the country reached 517.26 billionUSD, up 7.6% (equivalent to an increase of 36.69 billion USD ) compared to

2018 In which, the value of exported goods reached US $ 264.19 billion, up

Trang 10

8.4% and imports reached US $ 253.07 billion, up 6.8% This result hascontributed to bring the country's trade surplus of goods in 2019 to a surplus

of 11.12 billion USD Thus, the total volume of import and export goods hasincreased, leading to an increase in the demand for international cargotransportation

1.4.2 Environment of competition

The competitiveness in the market has a great influence on the businessactivities of the business, affecting the profitability of the business Theperfect competitive environment is free to join and withdraw from the market.Businesses that enter the market and accept that the market price of thebusiness does not gain super profits, but only ordinary profits that correspond

to the opportunity cost of capital The more monopoly the market is, the morepower businesses have to control prices (raising selling prices or loweringbuying prices to gain super profits) In this market, the entry of enterprises isvery difficult Doing business in monopoly market or monopoly minority willbring high profit and great business efficiency for enterprises But this marketwill cause loss to society and not bring about socio-economic benefits

In our country, in the previous subsidized bureaucracy managementmechanism, market competition is distorted For a long time we sawcompetition as "big fish swallowing small fish" and only saw the negativeside of it In fact, competition is a two-headed mechanism, on the one hand, itpushes inefficient businesses to bankruptcy, on the other hand, it creates agood environment for businesses to master the "rules of the game" ofdevelopment Competition in the market among enterprises by economicsector is divided into 3 types:

- Competition among industries in freight services includes competitionbetween freight forwarding sectors by sea, air, rail and road Each industry has acompetitive advantage and has its own limitations

Trang 11

- Competition within the industry In essence, an extremely fiercecompetition between enterprises in the logistics industry Enterprises with morecompetitive advantages will gain more, gain more market share and vice versa.

In summary, in today's fierce competition environment, business owners arerequired to improve themselves, try in all areas, take advantage of theircompetitive advantage, service business activities most effectively

- Competition within the service of freight forwarding by sea In freightforwarding by sea, there are also many types such as freight forwarding works, project delivery, normal import and export goods

Unhealthy competition is the cause of the quality of import and exportfreight services Many units have appropriate positions at ports, airports, transportation companies have taken advantage of this to monopolize thebusiness of services, unilaterally set the price of services without customershaving the opportunity or the option

The government's policy of diversifying service providers in the markethas fueled competition in the industry Joint venture forwarders compete witheach other as well as compete with domestic transport service providers interms of service quality, delivery facilities and prices

1.4.3 Customers wishing to use import and export freight services

Previously, producers only focused on producing products or services, then considered selling those products and services Today, customers areseen as an important factor so business owners before production have tried tofind out the needs and tastes of customers, and closely follow that need to dobusiness In order to do business effectively and stand firm in a competitivemarket, businesses need to know which customers (owners of import andexport goods) have a need to transport goods, that is, determine the amount ofuse of customers line Customer's capacity depends on the type of serviceprovided, the number of consumers, the production and business situation of

Trang 12

the shipper and the relationship between the shipper and the business.

Business customers can be:

- Potential customers: may be individuals, businesses (goods owners ingeneral) participating in international trade but have never used the type ofservice of the business or those who have used it several times but stillwondering whether to continue or not

- Regular and regular customers of the enterprise are owners of goodswith long-term cooperation relationship who have used and used different types

of services of the enterprise

1.4.4 Mechanism of goods circulation - material and technical

facilities

As the trade develops, the amount of goods circulating and circulatingquickly increases the amount of warehousing goods but at the same time willreduce the time for renting warehouse for each shipment

Good, modern and appropriate technical and material facilities facilitatebusiness activities of forwarders Forwarding of import and export goods bysea is not less affected by the physical facilities of the seaport such as ports, ships, loading and unloading equipment Stemming from the demands of theincreasingly demanding development of high quality The amount of transportservices, this can not be effective when there is an outdated, inappropriateservice system

1.4.5 Cost of delivery

In Vietnam, there is currently no specific regulation of the competentauthorities on standard charge rates for delivery, which is mainly set by thedelivery units themselves Therefore, it is possible to divide delivery costs inVietnam into two parts: compulsory and incurred costs

This is part of the cost that import-export enterprises or authorizeddelivery agents pay to the delivery units when importing and exporting goods

1.4.5.1 Shipping charges

Trang 13

This is a business field requiring large investment, slow capitalrecovery and risky risks Therefore, in fact, the transport service businessfocuses on three objects: agents for shipping lines, aircraft, cars, trains -mainly to serve customers The second is: units and joint ventures, exportprocessing zones, and relatively high cost In addition, the third objectparticipating in the transport business is the private transportation enterpriseswith a large number of people, so the price is very low and competing withcustomers who are small import-export units of private or public.

For example, the transport cost from Noi Bai-Vinh Phuc of privatetransport companies is 300,000 VND/10 PL and 350,000 VND/15PL.However, the price is low about 30% for ASEAN countries and 45% for othercountries in the world

1.4.5.2 Loading and unloading fee

This is the cost that import, export or forwarding units must pay to theports or warehouse business units at the port This fee is relatively low Forexport products, if it is packed, the price is quite high, usually about1,000,000 VND to 1,200,000 VND / 10 PL and 2,000,000 VND / 15PL

For imported goods of VND 400,000 / 10PL and VND 600,000 / 15

PL, import and export goods owners actually have to pay another CFS (liftingand lowering fee) to forwarding companies as follows:

- Exporting goods is about VND 60,000 VND / 1CT

- Imported goods: about VND 300,000 VND /10 PL and 400,000 VND/15 PL

Trang 14

- Imported goods: about 200,000 VND to 500,000 VND / 1 shipment

1.4.5.4 Inspection fees

Collected by cargo inspection agencies with inconsistent levels, forexample at Vinacontrol as follows: tally fee: VND 420,000 / shipment, supervision fee: VND 200,000 / shipment

CIO fee: to be paid at the Vietnam Chamber of Commerce and Industry(VCCI) when applying for C / O and at the Ministry of Trade with C / O form

D With C/O form A, B, 0, T is VND 60,000 / set for members of VCCI andVND 80,000 / set for others With C / O form D: VND 60,000 / set

1.4.5.5 Charges for warehousing, port yard

According to the Ministry of Finance's decision, storage fee: USD 0.16/ ton - day Storage charge: USD 0.08 / ton - day Business units, portoperators based on market prices and the actual situation is adjusted to increase

or decrease 22% compared with the above-prescribed unit price

1.4.5.6 Quarantine fee:

To be collected at quarantine branches in each region

1.4.5.7 Forwarding service fee

Because the delivery market is so fierce today, delivery fees are oftenvery low or not shown in the offer and hidden in other fees called interestrates from working However, according to the normal level, it is prescribed

as follows:

Exported goods: about 250,000 VND to 500,000 VND / shipment

Imported goods: about 300,000 VND to 550,000 VND / shipment

This is a part of the cost that the import-export enterprises or authorizeddelivery agents pay to the import and export management agencies for theirgoods to be quickly released These costs have no invoices and receipts.Although it is called an optional fee, in fact most import-export or deliverybusinesses have to pay and be included in the cost of goods handling because

it determines the actual cost of the delivery service of yourself These

Trang 15

unnamed charges are the reason for Vietnam's delivery costs are often highand unstable compared to the region and the world.

1.4.6 Natural condition

Transportation service activities are greatly affected by naturalconditions But in the process of loading climate factors, weather such asstorms, hot and humid climate can affect the goods Therefore, the weather

is also one of the factors affecting import and export transport services

Above are some factors affecting service activities of transportingimport and export goods in Vietnam Based on these factors, we will go intomore limited issues and find solutions to improve the efficiency oftransportation services of Lotte Vinatrans Global Logistics Co., Ltd.(Vietnam)

1.5 Managing import and export goods delivery activities of the business.

1.5.1 Legal basis of forwarding of import and export goods

Enterprises' forwarding of import and export goods is governed bydomestic and international laws The Congress of Vietnam has issued anumber of documents regulating responsibility for the delivery and receipt ofgoods:

- Vietnam's Maritime Law No 95/2015/QH13 dated November 25,2015

- Vietnam Civil Aviation Law No 66/2006 / QH11 dated June 29,2006

- Commercial Law No 36/2005/QH11 dated June 14, 2005 Enterprisesimporting and exporting goods must also comply with international lawsincluding conventions, treaties and protocols Transport, insurance :

- In the field of goods trading, the 1980 United Nations Convention onthe purchase and sale of goods, which was signed in Vienna, is used to adjustinternational sales contracts When the parties select and specify in the

Trang 16

contract a reference under the Vienna Convention, the Convention will

govern the rights and obligations of the parties in the contract

- International treaties used in shipping contracts in the field of

maritime transport include:

+ The International Convention unifies a number of rules of the bill of lading - the Brussels Convention
