As we know, Vietnam’s Economy is developing day after day Vietnam has been estimated as a safe place for investment to foreign investors, not only in economic field but also in political one

We also know that Vietnam is a developing country This is true because the economy is healthier now than a decade ago, In that context, businesses of Vietnam and foreign investors played an important role, especially, companies, enterprises, investors in the country and abroad, For keeping process of national economy solid, Vietnamese Government need to havepolicies that encourage businesses in the country and attract foreign investors One of the policies is safe protection of their business activities, and another important problem is to protect intellectual property (IP) right for them, So I am lucky to do business about this field and I have seen the importance of IP of nowadays and in future This is also a good chance for my work, a field requesting high specialization skills about IP law At the moment in Vietnam, IP experts are not sufficient to supply for this field While the IP service needs business operations in the society nowadays Beside, Vietnam‘s IP law had been effective, however it still has limits to execution process , so it needs to be more complete in future, With the purpose

of researching the concern of companies, enterprises, Investors in protection of their

IP right, from that, we draw out lessons for our IP better activities Beside, from the opinion of enterprises given here, it has contributed to the improving better IP law in future

With the reasons being put out above, in process to research my thesis, I gave out the questionnaire for businesses relating to the answer of the main problems as follows: Degree concern of businesses about IP and IP service; Degree their know of businesses to our IP operation; Degree their invest of businesses to IP right protection; Businesses‘s difficulty when they apply for IP; Finally, the suggestion of businesses to IP service for it will be better in future

The data of questionnaire from research are collected and processed through the SPSS software so that we are able to know the problems mentioned above

In short: Customer development, improving IP law system, training of IP experts

Important base problems have made to research thesis, As we have known recent years, the economy of Vietnam keeps developing because of contribution of Vietnamese businesses Vietnamese government has tried to give out national laws and join international agreement to encourage businesses from home and foreign investors, and one of the problems is IP right protection

Especially Vietnam has become a member of WTO To create a healthy competitive environment between businesses in Vietnam Especially, that is a problem of copyright without permission, fake goods, goods infringing IP in the context of global integration economy

IP Crimes under Vietnam Criminal law, Infringing IP rights under Articles 156,

157, 158, 170 and 171 maximum 15 years in prison But production and sales of fake medicines and producing and selling poisonous or harmful foods – Maximum lifetime in prison (this can also be punishable by the death penalty)

Further, Vietnam's Administrative law, maximum fine of cash for the type of IP crime is 500 million VND and destroys all IP infringing goods However degree attend of customers and some of agencies involved said that this is not fine enough, that it is too low for this crime This is not only be concerning for government and Vietnamese’s businesses, it is also for international’s businesses and government on the world How to redce those problems? Beside of government policies, attention of business, we really need experts, organizations of IP services to help them

However, these types of services in Vietnam are being licensed by the government very low now (up to now in VN there have been about 60 service Organizations and 236 people were licensed (Data of Vietnam IP Department -2009) Beside the problem carry out policy and education about IP field of Government don’t concern much

So, enterprises in home and foreign investors concerned and worry in protection

IP right of them very much It is a part in their business investment

Last time, there were some researches about IP field, but mainly some people are working in IP government They research management of government about IP field, but research about IP service for Satisfaction to businesses which did not concern much, So that I decided to study “Developing Intellectual Property (IP) Services in the Global Integration Context in Vietnam”

I hope it will be helpful for solving problems mentioned above in VN in the context of global economy Process of development is strong for Vietnam’s businesses system nowadays

1.2 Reseearch Motive

With the number of VN businesses developing very fast and some other reasons mentioned above, so major objectives need to research that are IP service field in

Vietnam By studying real cases and data base my thesis, it evaluated IP service operation

at the moment and tries to solve the problem demand to this operations

This is also a good chance to us who are working in IP service field It supply to requests of society about human source for IP field, and to train IP experts in future By the way, I am working in IP field, it is easy to research this problem and finally it also helps us to expand more IP service So, detailed objectives of thesis are as follows: Concerning of enterprises about IP and IP service; Investment of business about protection their IP right; Suggest of businesses for IP service and IP law will be better in future

Subjects of thesis are all kind of companies, enterprises, individual, investors, so on… who have to concern to IP field in Vietnam

Research questions were gave out around of thesis here: 1 how degree Concern of businesses about IP and IP service is to? 2 How their investment about IP protection is? 3 Finally we what found out with suggests of businesses to IP service that wil be better in future?

1.3 Research Scope and Limitations

In shape and size of my thesis, because of the time and condition that have been limited, I only research IP service field with enterprises which are in HCM city and some provinces of The South of Vietnam

Chapter 2 Literature Review 2.1 Some Definitions about IP and Some Subjects of IP

2.1.1 Some concepts about IP

Intellectual property is a law which shows a work or in vention that is the result

of creativity, such as a manuscript or a design, to which one has rights and for which one may apply for a patent, copyright, trademark, etc… (dictionary of English)

“Intellectual property is a general term for certain intangible assets: ideas, patents, and know-how to do some things Typically, these intangible assets is useful in commerce

or in industry, agriculture, manufacturing , but not all ideas that are the intellectual

property For ideas to become "property” it must be protected by law, that is the idea that

the owner must have and must have the right to defend their ideas, such as the owner can protect their interests with other tangible assets (Paris Convention mentions the concept

The law of some other countries on the World recognize the intellectual property consists of four main categories: Trade Marks and other similar signs; Patents and designs; Copyright; The trade secrets

In Vietnam, by the legal IP system, the State recognizes and protects property rights, specifically defined:

Property: a term used to refer to human rights over the assets of which they are

called property rights Ownership includes three power: the right to possession, use rights and the right to dispose of assets respectively

Properties: the subject of ownership, including physical assets and intellectual property

Intellectual property: the products of the human mind created through creative activities, including literature, science, art (novel, poetry, works of sculpture, painting .) and the results of scientific and technical innovation (patents, utility solutions, industrial designs )

Intellectual Property: A concept refers to the rights of holders of intellectual property, respectively Intellectual property is divided into two main areas, including industrial property and copyright (Data of national office of intellectual property of Vietnam)

2.1.2 IP rights

IP rights are the rights of Organizations, individuals for their intellectual estates, it includes rights of author (copyright) and rights related to rights of author (copyright), rights of industrial property and rights to origin of plant (At Item 1, Article 4 Vietnam intellectual property law)

2.1.3 Some concepts of subjects about IP

Copyright in Vietnam has been provided in detail under the 2005 Civil Code, Law

on Intellectual Property and 100/ND-CP/2006 Decree of the Government detailing and guiding the implementation of some articles of Civil Code on Intellectual Property Law

on copyright and related rights Accordingly, Copyrights are the rights of organizations and individuals for their creative works or property, including the following rights: 1 Human rights body - Name of work – their real names or pseudonyms on the work, yet their real names or pseudonyms when the work is published and used, Protect the integrity of the work, not for others to repair, crop or distort the work in any way prejudicial to the honor and reputation of the author 2 Property rights - Make derivative works; -works Performing in front of public, Copy works - Distribution and import of the original or a copy of the work; Disseminating the work to the public by means of wireline, wireless, electronic communication networks or any other technical - Rent the original or copies of Art works, computer programs Works are protected by copyright as a works in the field of literature, science and art (According to wikipedia)

Copyright is a legal term describing the economic rights given to creators of liter - ary and artistic works, including the right to reproduce the work, to make copies, and to perform or display the work publicly Copy - rights offer essentially the only protection for music, films, novels, poems, architecture, and other works of cultural value As artists
