KRONE Premis NET ®

SYSTEM WARRANTY CONDITIONS FOR END USER

The PremisNET System Warranty is subject to the

following conditions ENDORSED INSTALLER COMPANIES

and END USERS should both read these carefully If you

are in any doubt as to their meaning please contact the

Warranty Co-ordinator at KRONE in writing before

completing the WARRANTY REGISTRATION FORM.

It is a condition that the installation instruction sheets

and other written instructions have been adhered to

during installation ENDORSED INSTALLER COMPANIES

should contact KRONE where there is any difficulty with

your understanding of these.

1 DEFINITIONS

1.1 In these conditions:

END USER The company to whom the System

Warranty Certificate has been issued.

ENDORSED Means a company authorised in

INSTALLER writing by KRONE to be an

COMPANY ENDORSED INSTALLER COMPANY,

and to design and install a SYSTEM

to which the warranties herein shall

apply whereby such design and

installation is conducted by its staff

who are trained and certified to be

thus trained by KRONE.

PRODUCTS Means those KRONE PRODUCTS

listed in the KRONE WARRANTY

REGISTRATION FORM.

WARRANTY Means the form used to apply for

REGISTRATION the warranties herein.

APPLICABLE Means the published cabling

STRUCTURED standard(s) referred to in sub-section

current at the date of registration.

SPECIFICATIONS Means the performance

requirements defined in the

Applicable Structured Cabling

Standards and such other

performance requirements as are

specified in writing by KRONE and to

which the System has been tested.

SYSTEM Means any combination of the three

sub-systems of a structured CABLING

SYSTEM as defined in the

APPLICABLE STRUCTURED CABLING

STANDARDS (campus, backbone,

horizontal) and such variations

thereto as are specified in writing by

KRONE, and which are composed of

the Products.

WARRANTY Means up to 20 years from the date

PERIOD of completion of installation of the

SYSTEM.

1.2 Headings are included for ease of reference only

and shall not affect the interpretation of these

conditions.

2 PREMISNET SYSTEM WARRANTY

2.1 KRONE warrants to the END USER that the tested

SYSTEM in its installed state shall meet or exceed

the SPECIFICATIONS in force at the time of

installation for the duration of the WARRANTY

PERIOD.

2.2 KRONE warrants to the END USER that the

Products which comprise the SYSTEM shall be free

from defects in materials and workmanship for

the duration of the WARRANTY PERIOD.

3 APPLICATIONS ASSURANCE WARRANTY

3.1 KRONE warrants to the END USER that, for the

duration of the WARRANTY PERIOD, the system shall

be free from defects which prevent operation of:

3.1.1 applications specified by recognised standards

or user forums that use the APPLICABLE

STRUCTURED CABLING STANDARDS, and

3.1.2 any other applications specified in writing by KRONE.

4 ZERO BIT ERROR WARRANTY

4.1 KRONE warrants that the horizontal sub systems

of a GLOBAL LEADER SYSTEM shall have a “Zero Bit Error” rate of no greater than 10-12 for a period of five (5) years from the date of installation.

5 ENTERPRISE WARRANTY

5.1 The ENTERPRISE SYSTEM provides all the warranty assurances detailed above in Clause 2 – PremisNET System Warranty and Clause 3 – Applications Assurance Warranty.

6 GLOBAL LEADER WARRANTY

6.1 The GLOBAL LEADER Warranty comprises all the warranties detailed in Clause 2 – PremisNET SYSTEM WARRANTY; Clause 3 – Applications Assurance Warranty and Clause 4 – Zero Bit Error Warranty.

7 INSTALLATION OF THE SYSTEM

7.1 The warranties in Clauses 2, 3, 4, 5 and 6 shall apply only if the SYSTEM has been properly installed by an ENDORSED INSTALLER COMPANY.

8 ALTERATIONS TO THE SYSTEM

8.1 Any alteration/repair, modification and/or addition

to a warranted SYSTEM must be properly installed and tested by an ENDORSED INSTALLER COMPANY.

8.2 Any replacement or additional PRODUCT used is warranted free from defects in materials and workmanship for the remainder of the WARRANTY PERIOD applicable to the SYSTEM unless a new SYSTEM is installed in which case a new SYSTEM warranty certificate shall be issued, subject to the terms applicable at the time of notification to KRONE and approval by KRONE.

9 RECORDS AND TEST RESULTS

9.1 It is the responsibility of the END USER to store and maintain accurate initial and any subsequent installation layouts, drawings and test result data for the duration of the WARRANTY PERIOD.

9.2 KRONE shall only issue a SYSTEM warranty certificate after having examined and approved all documents.

10 HOW TO APPLY FOR THE WARRANTY

10.1 The KRONE WARRANTY REGISTRATION FORM must be completed by both ENDORSED INSTALLER COMPANY and END USER (where indicated) and sent to KRONE within 45 days of completion of the installation of the SYSTEM.

11 CLAIMS PROCEDURE

11.1 The END USER shall notify KRONE or the ENDORSED INSTALLER COMPANY that originally installed the SYSTEM within five working days of the discovery, by any person, of any alleged defect

in the SYSTEM or PRODUCT, but in any event, no later than the expiration of the WARRANTY PERIOD The ENDORSED INSTALLER COMPANY shall ascertain the nature of the alleged defect.

11.2 The END USER shall, if so requested, ensure that KRONE, the ENDORSED INSTALLER COMPANY or their authorised representatives are allowed free access to the premises on which the allegedly defective SYSTEM or PRODUCT is located for the purpose of inspection and testing as appropriate

No PRODUCT may be removed from the SYSTEM without KRONE’s prior authorisation.

11.3 The END USER shall, on request, make available to KRONE copies of any test reports.

12 WHAT KRONE WILL DO

12.1 If KRONE is satisfied, after inspection or otherwise, that the SYSTEM and/or PRODUCTS do not comply with the warranties in Clauses 2, 3, 4, 5 and 6 (subject to the other conditions and limitations herein), then, at KRONE’s sole discretion:

12.1.1 the defective PRODUCTS shall be replaced or

repaired, during the first five years of the WARRANTY PERIOD free of charge to the END USER, and thereafter at a cost to the END USER

in the proportion that the expired years of the WARRANTY PERIOD bear to the total duration

of the WARRANTY PERIOD, or 12.1.2 the purchase price of the defective PRODUCTS shall be refunded.

12.2 Subject to Clause 12.1, any defective PRODUCTS removed by KRONE shall be repaired at the premises at which they are located (in which case the END USER shall ensure that KRONE or its authorised representatives are allowed free access for such purpose) or at the manufacturer’s premises (as necessary).

12.3 If any PRODUCT has been upgraded, KRONE shall have the option to use such a product to satisfy its obligations providing that the functionality and performance of the upgraded product is at least equal to that set out in the specification for the replaced PRODUCT.

13 KRONE’S LIABILITY TO YOU UNDER THIS WARRANTY

13.1 The WARRANTIES in Clauses 2, 3, 4, 5 and 6 above shall only be applicable if:

13.1.1 the END USER presents the SYSTEM warranty certificate issued by KRONE and

13.1.2 new PRODUCTS were used in the SYSTEM at the time of installation and

13.1.3 the defect was not caused by incorrect or negligent handling, disregard of any reasonable instruction given by KRONE, any abnormal use (including the use of unsuitable or defective tools or equipment in connection with the PRODUCTS), overloading, unreasonable wear and tear or any other fault by the END USER, its sub-contractors, servants or agents and 13.1.4 the defect was not caused by any other external act or omission or circumstance beyond KRONE’s control occurring after delivery 13.2 Subject to the limitations in Clause 14.2 the remedy described in Clause 12.1 shall constitute the END USER’s sole and exclusive remedy for any breach of the warranties in Clauses 2, 3, 4, 5 and

6 hereof Except as specifically stated herein, it is acknowledged that neither KRONE nor the manufacturer of any PRODUCT has given any other warranties express or implied, other than statutory All implied warranties of

merchantability or fitness for a particular purpose are excluded.

13.3 Subject to the limitations in Clause 14.2 neither KRONE nor the manufacturer of any PRODUCTS shall be liable whether in contract, tort (including without limitation negligence), by way of indemnity or otherwise for any loss of revenue, profit, contracts, customers, business or goodwill

or any indirect or financial loss or incidental, special or consequential damages that may be suffered by a purchaser or user, including END USER, of any PRODUCTS nor shall KRONE’s or any such manufacturer’s liability for any claims or damages arising out of or connected with the warranties in Clauses 2, 3, 4, 5 and 6 of the manufacture, sale, delivery or use of the defective products exceed the purchase price of the defective products This clause shall survive failure

of an exclusive remedy.

14 ARBITRATION/CHOICE OF LAW

14.1 These conditions shall be governed by and construed in all respect in accordance with the law prevailing in the State of New South Wales, Australia.

14.2 Nothing in these conditions shall purport to exclude or restrict any liability the exclusion or restriction of which is prohibited by law.

This KRONE Warranty Registration Form may only be

used by KRONE ENDORSED INSTALLER COMPANIES.

This KRONE Warranty Registration Form must be

used to apply for the KRONE PremisNET System

Warranty This form should be jointly completed by

the ENDORSED INSTALLER COMPANY responsible for

the design and installation of the structured cabling

system, as well as the END USER This form should

then be sent to KRONE,

A System Warranty Certificate will be issued from

KRONE to the END USER via the PremisNET

Endorsed Installer Company once the following

steps have been completed.

This KRONE Warranty Registration Form

is correctly completed.

Installation meets the KRONE PremisNET

System Warranty Conditions.

The application is approved by KRONE.
