EXECUTIVE SUMMARY

The subproject of 220kV Cau Bong – Duc Hoa TL has a total line of 13.42km long, 43 supporting towers Its ROW is 22m wide, 11m from each side of line centre The line that starts from 220kV Cu Chi substation traversing Nhuan Duc, Trung Lap Ha, Phuoc Hiep, Phuoc Thanh and Thai My communes of Cu Chi district, HCMC and Duc Hoa commune, then ends at 220kV Duc Hoa substation, Tan My commune, Duc Hoa district, Long An province

Implementation progress: the subproject was executed on June 10, 2014 and expected

to be finished in September 2015 As of June 30, 2015, the work progress has achieved about 78.6 % of all works The progress in the second quarter was not remarkably made because of the delay in the compensation to the affected households

The environmental safeguard monitoring results in the second quarter of 2015 showed that the constructor’s environmental compliance is good The typical achievements in terms of environmental safeguard, results of resolving the environmental issues found

in the previous quarter and several shortcomings on the environmental performances identified in this period and measures recommended for overcoming them are summarized as follows:

 The main achievements

For implementations of the mitigation measures at sites, the contractor’s achievements were that they performed well in reducing dust, noise, vibration, landslides; not blocking water flows, protecting the natural environment by making the turbid water from foundation holes clear before discharging it into the water body and preventing the trees and works adjacent to the construction sites from any damages The contractors mostly rehabilitated the environment after construction, fully repaired and compensated for any damages and losses caused by the construction and have improved in collecting and classifying the construction wastes such as cement bags, iron materials and plastic cans to be reused or recycled; Dragging wire ensured safety and no negative Impacts on rice field and disturbance of public traffic

For protecting health and ensure safety for the workers and local communities, the contractors were in compliance with the regulations of CEMP, particularly:

- All migrant workers registered as the temporary residents to local authorities, respected local cultures and have a good relation with the community;

- Contractors installed a warning signal board surrounding the excavated holes of foundations and on the erected towers to prevent local people from any potential accidents;

- All workers have been educated to improve their awareness on social diseases especially HIV/AIDS;

- The contractors have issued the labor safety regulations and provided the workers with the labor protecting equipment and reminded them to use during the time of working at site

- The contractors have built the temporary camps for the workers at sites for guarding the construction materials at night time and taking a short rest at lunch time with the adequate provisions of portable water and first aid kits The

camps which are located at the ventilated and safe places are equipped with garbage bins and hygienic toilets

The progress and results of resolving the environmental issues found in the first quarter of 2015

In compliance with the Letter No 2260/AMN-ĐB dated 06 April 2014 requested all contractors to resolve the environmental issues identified in the first quarter of 2015, all contractors have resolved these issues within a period of 06 – 30 April of 2015 All contractors complied strictly to surmount all the shortcomings found in the first quarter of 2015 Concretely, IEC rehabilitated the irrigation canal crosses the entrance

to tower No 43 in Tan My commune, Duc Hoa district, Long An province by dredging the sedimentation, collecting and removing all construction residues of wood sticks, cement bags, so that grasses could grow, covering the banks of canal preventing

it from landslide and improving its water quality Contractor Song Da 11 was in compliance with implementation of the mitigation measure of keeping cement and blamable materials at least 20m far from the kitchen and sleeping place of workers to ensure health and safety for the workers staying in the camps Contractor Song Da 11 Thang Long dredged and removed all residues of stone and sand out of the lot of rice field next to the site of gathering the construction materials for constructing the tower

No 5 located in Bau Tron village, Nhuan Duc commune, Cu Chi district All the shortcomings were observed not to be repeated in the second quarter However, when NES interviewed the households whose lands are temporarily affected by the subproject and the wiring workers, several remaining points need to be further resolved were as follows:

- The lot of rice field located surrounding the tower No 4 of household Tran Van Nhuan, Bau Tron village, Nhuan Duc commune, Cu Chi district was contaminated with stone, sand and clays caused by drops during transporting materials to the tower and storing the excavated land, which needs rehabilitating (Song Da 11 Thang Long)

- The wiring workers were not provided a mobile tool kit with necessary medicines at sites to be ready to respond to urgent accidents;

Recommendations

- Contractor Song Da 11 Thang Long should restore the lot of agricultural land/compensate to the affected household with an amount for his self – rehabilitation;

- Both contractors of Song Da 11 Thang Long and Song Da 11 should equip their workers with a mobile tool kit including necessary medicines to ensure that the workers would be aided first before transporting to the nearest health station when an accident occurs at sites

1 INTRODUCTION

1.1 Project background

To carry out its plan to expand power generation, transmission and distribution capacity to meet the rapidly growing electricity demand throughout the country, the Government of Vietnam has requested the financial resource from a Multi – Tranche Financing Facility (MFF) funded by the Asian Development Bank (ADB) to invest the power development program The program will include the physical investments in transmission and distributions of power with an expectation to (i) facilitate power transfers, (ii) remove transmission bottlenecks and (iii) reduce transmission losses and voltage fluctuation

To deploy its master plan on the national power development, the subproject 220KV Cau Bong – Duc Hoa transmission line is invested under the Tranche II with a total budget of around 20 million USD1,2 NPT is the executive agency and SPPMB is the implementing agency for the subproject

1.2 Project scale and description

The subproject of 220kV Cau Bong – Duc Hoa has a total line of 13.42km long, 43 supporting towers Its ROW is 22m wide, 11m from either side of the line centre The line starts from 220kV Cu Chi substation and traverses Nhuan Duc, Trung Lap Ha, Phuoc Hiep, Phuoc Thanh and Thai My communes of Cu Chi district, HCMC and Duc Hoa commune, then ends at 220kV Duc Hoa substation, Duc Hoa district, Long An province A general layout is presented in Figure 1 and Table 1

According to the IEE of Cau Bong – Duc Hoa transmission line approved in December

2012, the subproject construction scale leading to the potential environmental impacts

in the subproject areas includes (i) excavating 46 tower foundation with the quantity

of excavated earth and rock is about 30,793 m3 and average of each tower is of 669 m3and all earth and rocks will be temporarily stored within the construction site and will

be used to fill back the tower foundation after the concrete reinforcement; Gathering construction materials such as irons, cements, sand, stones to sites for concreting the towers with the requirement of concrete in total is around 6,045.17 m3 and average of each tower requires 163.84 m33 The materials will be transported by trucks to prepared sites as closed as possible to the constructed tower based on its specific

conditions such as available bare land and access roads ect (ii) The area required for the RoW is 29,52ha and the number of houses within it is 37 satisfying with the safe clearance requirements All affected households are not required to be relocated but

617 houses with metal roof located from 36m of the line centre will be earthed; the area to be required for construction of 46 towers is 1.25ha and most of it is agricultural land so no affected households have to relocate; (iii) The transmission line route is mostly located within the outskirts of HCMC To minimize negative impacts on residential areas and facilities on the affected land, it crosses a number of existing grids, roads and canals The route intersects with the existing transmission line of 220kV seventy times at sections of G.1B - G4.1C (06 times), G4.1D - G4.2 (05 times), G4.2 – G4.3 (02 times), G4.4 - G4.5 (01 time) and G4.6 - G4.7 (03 times), going across the electric line of 110kV with 01 time at section of G4.6 - G4.7 The line transects over the highway with 01 time at section of G4.2 - G4.3, the provincial roads with 11 times at sections of G4.1 - G4.1A (01 time), G4.1B - G4.1C (06 times) and from G4.6 - G4.7 (01 time) The route crosses the canals with 11 times at sections of G4.1 - G4.1A, G4.1B - G4.1C, G4.1D - G4.2, G4.4 - G4.5 and G4.6 - G4.7 with 4, 3,

1, 2, and 1 times respectively;

In terms of biological environment, the status of land use in the subproject area consists of 64% of the rice field, 11% of Melaleuca and the remaining 25% including surface water and cemeteries There are no original habitats, significant wildlife, conservation areas and significant invasive species within the project area;

For physical cultural resources, there are several temples and other public infrastructures within the vicinity of the transmission line corridor However, the distances are quite far from transmission line and none of these structures will be affected by the project activities

1.3 The objectives of internal environmental monitoring

The objectives of internal environmental monitoring are as follows:

- Monitoring the environmental compliance with both policies of ADB and the Government of subprojects’ construction activities

- Monitoring the construction contractors to comply with the mitigation measures

in accordance with the approved EMP and CEMP

- Recommending measures to improve the effectiveness of mitigating the environmental negative impacts during the subprojects’ construction period

- Identifying the environmental impacts non-determined in the designing stage, based on which solutions for monitoring and mitigating the impacts shall be recommended

2 INCORPORATION OF ENVIRONMENTAL REQUIREMENTS INTO PROJECT CONTRACTUAL ARRANGEMENTS

2.1 Environmental law, regulation and standards

- ADB’s environmental safeguard put in effect on January 01, 2010;

- Law on Environment put in effect on January 01, 2015

- Circular No 22/2010/TT-BXD regulating on labor safety in executing constructions issued by Ministry of Construction on December 03, 2010;

- Decree No.59/2007/NĐ-CP on solid waste management dated April 09, 2007

- Decree No.14/2014/NĐ-CP dated February 26, 2014 regulating detail on the implementation of Law on Electricity and Power Safety;

- QCVN 26/2010/BTMT national technical standard on noise

- QCVN No 05/2013/BTNMT national technical standard on ambient air quality

- QCVN No.27/2010/BTNMT national technical standard on vibration

- QCVN No.08/2008/BTNMT national technical standard on surface water quality

- QCVN No.09/2008/BTNMT national technical standard on underground water quality

2.2 Environment Institutional Responsibilities

2.2.1 Duties of the related stakeholders in the institution

 SPPMB

- SPMB works as an implementing agency, appointing its Supervision Engineers (SEs) from the Technical Department, to have overall responsibility for supervising construction contractors in both civil works and implementing the EMP; assigning its Environmental officers (EOs) from its Resettlement Division to be responsible for implementing and monitoring EMP during the project phases Under the supports from IES, EO of NPT and NES, the SPPMB SEs and EOs will be in charge of the following duties:

SPPMB environmental officers (EOs)

 Supporting SPPMB to approve the CEMPs

 Introducing the contractors to sites;

 Supporting and gathering monthly reports prepared by contractors on compliance with the implementation of CEMP;

 Collaborating with the NES to conduct monthly regular site visits and conduct quarterly workshops on the compliance with the ES policies of the project and the improvement awareness of the project staff and contractors on occupational and communal health and safety

 Preparing monthly, quarterly and mid-year reports on coordination implementing the EMP and EMoP to be submitted to ADB, NPT;

SPPMB supervision engineers (SEs)

 Supervising the construction contractors both in technical works and the implementation of EMP;

 Reviewing monthly compliance report prepared by contractors before submitting it to SPPMB

 CONSTRUCTION CONTRACTORS

The construction contractors have the following duties:

- Mobilizing its human resources that include (i) Site Engineer (SiE); (ii) Environmental, Health and Safety Officer (ESHO) and (iii) Community Liaison Officer (CLO) and necessary materials and equipment to implement the mitigation measures effectively at sites;

- Developing its CEMP before starting civil works, which is to be submitted and approved by SPPMB;

- Meeting with SPMB SE & EO at sites to ensure that the contractor’s assigned staff have understood and committed to implementing the CEMP;

- Maintaining a Control Record available as requested for any inspection made

by SPPMB SE and EO;

- Promulgating and educating its workers on safety, health;

- Preparing monthly compliance report submitted to SPPMB

 NATIONAL ENVIRONMENT SPECIALIST (NES)

- Supporting SPPMB in compliance with the ES policies and in coordinating implementing the EMP and EMoP for the project

- Conducting capacity building on the implementation of the EMP and EMoP while improving the awareness on occupational and community health and safety for the workers and contractors;

- Supporting SPPMB EO in preparing the quarter and semi- annual internal monitoring reports on environment;

2.2.2 Layout of Internal monitoring arrangement

Based on the institutional arrangement for implementing the EMP and EMoP concurred by ADB in December 2012 (IEE, 12/2012), the layout on internal monitoring arrangement for ES is presented in Figure 2

The assessment of coordination implementing the CEMP in the Quarter 2 nd of 2015;

It is assessed that the coordination of implementing the CEMP of the subproject has well performed by SPPMB’ staff and its related contractors

- SPPMB’s technical department (SE) worked as a construction supervision unit that carried out their tasks in supporting the contractors in implementation of the construction measures and the environmental performances at sites, while signing in the monthly environmental compliance report prepared by the contractors before submitting to SPPMB

- Visited the construction sites on May 05-09, 2015 to follow up the contractor’s corrective action plan, resolving the shortcomings found in the first quarter monitoring trip; to find out environmental issues coming out in the second quarter of 2015 and propose measures to cope with them immediately

- Worked closely with contractors through the means of Email and Phones to collect the monthly environmental compliance report of contractors Analyzed the reports to identify both the environmental compliant performances and difficulties that the contractors had met when implementing the mitigation measures Based on that NES could facilitate them to carry out the measures effectively in the coming months

- The second site visit was conducted from 25 to 30 of June 2015 to all construction sites The mission was focused on observing the sites to find out the environmental performances that the contractors were in compliance and non-compliance with the EMP/CEMP NES has also interviewed the households whose lands are temporarily and permanently affected during the tower foundation construction, to identify potential environmental issues need a further discussion with related stakeholders to solve properly and timely in the coming time

- Summarized the environmental issues and work progress of contractors in April, May and June of 2015 to ADB’s environmental specialist; finalized the

2015 first quarter environmental safeguard internal reports and prepared the second quarter of 2015 and 2015 mid-year environmental reports to be submitted to SPPMB, NPT and ADB;

EO on the environmental safeguard and carrying out its corrective action plan

to resolve any shortcomings effectively;

- Prepared and submitted its monthly environmental compliance report to the NES and SPPMB in time;

In sum, the coordination of implementing the CEMP was properly performed among the assigned staff As a result, the constructor’s environmental compliance is good and

no complaints related to the environmental performances at sites have been made so far

2.3 The incorporation of environmental consideration into project documents

The environmental consideration has been incorporated into the project documents such as EMP/IEE and bidding and contract (B&C) documents as stated in Table 2

- Site is limited to reduce unnecessary clearing of vegetation

- Sanitary soakage areas from offices and camps to be sited so that effluent is treated

- No discharge of grey water or sewage allowed to surface water systems

- Workshops to be provided with oil and water separators

- Fuel storage areas not to be located within 20m of watercourse

- Contractor’s storage facilities may need to be surrounded by a security fence

- Concrete batching areas to be provided with bunds to control movement of runoff to waterways

All environmental requirements in the EMP/IEE have been integrated into the B&C documents and the CEMP
