The Government of Vietnam and the Asian Development Bank have agreed to implement the Central Regions Rural Water Supply and Sanitation Sector Project (CRRWSSSP) scheduled to be completed by 31 December 2016 The Project has a total budget of US$ 50 million and is expected to provide access to clean water and hygienic sanitation for about 200,000 rural people in 14 communes in the six coastal central region provinces of Vietnam: Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Nam and Binh Dinh
The Loan Agreement was signed on 2nd February 2010 On 26 July 2011, the National Centre for Rural Water Supply and Environmental Sanitation (NCERWASS) of the Ministry of Agriculture and Rural Development (MARD) signed a Contract for Consulting Services for Project Implementation Assistance with CDM International Inc in a joint venture with Nippon Koei Co Ltd and national consultant Vinaconsult JSC (PIA Consultant) The PIA Consultant mobilized its team members on 25th August 2011
This Safeguards Monitoring Report - January-June 2014 covers main findings of the monitoring of safeguards issues of construction activities carried out during the reporting period from January to the end of June 2014 This report is based on review of weekly and monthly records of Construction Supervision Consultant (CSC) and observations made by PIA Consultant during supervision missions to the Subproject area

Trang 131 INTRODUCTION AND PROJECT OVERVIEW
1.1 Introduction
The water supply and sanitation Pilot Subproject located in Thach Bang, Thach Kim and Thinh Loc communes of Loc Ha District, Ha Tinh Province is one of the 6 Pilot Subprojects of the Central Regions Rural Water Supply and Sanitation Sector Project (Project) to be implemented under the Loan Agreement No 2609 - VIE (SF) between the Socialist Republic of Vietnam (GoV) and the Asian Development Bank (ADB)
The implementation of the Project will result in better health and living conditions of people living in rural areas in the Project provinces of Thanh Hoa, Nghe An, Ha Tinh, Thanh Hoa, Quang Nam and Binh Dinh The Project will construct a piped water supply systems, and sanitation facilities and to promote safer hygiene practices by the commune’s residents The Project’s components are the following: (i) Operational and sustainable piped water supply system; (ii) Improved household and public sanitation; (iii) Improvement of hygiene awareness; (iv) Strengthened sector planning and implementation capacity; and (v) Improved project management capacity
In accordance with the Safeguards Policy Statement 2009 (SPS 2009) and the Memorandum of Understanding (MOU) agreed between the ADB and the CPMU, the Ha Tinh Pilot Subproject needs to adhere to preparation of semi-annual safeguards monitoring reports This semi-annual report is the first one for Ha Tinh Pilot Subproject and covers issues in the first half-year of 2014
The Ha Tinh Pilot Subproject is located in Thach Bang, Thach Kim and Thinh Loc communes of Loc Ha District (the Subproject) The Subproject is designed to improve rural water supply and sanitation facilities and to promote safer hygiene practices by the rural communes Water supply includes construction of piped water supply schemes with treatment facilities The Subproject will include construction of school and public latrines where school and public health education programs are being carried out
The Subproject will also include grey water (sullage) disposal and small scale drainage improvements to properly discharge spill and grey water flows that will result from the water supply improvement works The overall progress of the sanitation package is 63%
The Design-Build package for Water Supply System of Thach Bang, Thach Kim and Thinh Loc communes of Loc Ha District, Ha Tinh Province was divided into two packages and commenced around mid July 2013 The overall progress of the water supply component is about 54%

The Subproject includes three construction packages:
(i) The design-build package for WTP, transmission pipeline to the booster station, distribution network of Thinh Loc commune (HT1/DB1/NCB) was signed on 15 July 2013, and is supposed to be completed within 15 months;
(ii) The design-build package for booster station, distribution network
of Thach Bang, Thach Kim, district’s administration area and Thach Kim seaport (HT1/DB2/NCB) was signed on 19 July 2013, and is supposed to be completed within 15 months; and
(iii) The design-build package of drainage system and sanitation for the whole Subproject was started on 29 June 2013 and is supposed to be completed within 12 months
2) Progress of Work
Main items of water supply component:
(i) Water Treatment Plant;
(ii) Transmission, distribution and service network; and (iii) Installation of service connections
The overall progress of the water supply component is 54%
Main items of sanitation component:
(i) Constructions of in-kind grant latrine substructures ; (ii) Construction of public latrines; and
(iii) Drainage improvement
The overall progress of the sanitation component is 63%
3) Changes of Surrounding Environment:
The land area of the WTP has been transformed from a green hilly landscape into construction area of a modernized water treatment plant (see figure 3 and

4) On one side of the hill, trees were cut off to build access road to the WTP which connects to the existing main entrance Outside of the permitted land area, the surrounding environment remains unchanged

2 ENVIRONMENTAL PERFORMANCE MONITORING
2.1 EMP/EMOP Implementation and Compliance
During construction phase, the implementation of the EMP is the responsibility of the D-B Contractor The D-B Contractor’s responsibility includes the appropriate and timely application of the mitigating measures stipulated in the approved EMP/EMOP The application and implementation of the mitigation measures are to provide the safeguards that will control, reduce if not eliminate unwanted effects during the Subproject implementation
Regarding raw water quality, D&B Contractor is responsible for taking water samples and quality analyses once during Detail Design Stage to point out whether there are any changes of raw water quality needed to have adjustment to the water treatment process of the water supply scheme, and to establish the baseline raw water quality; and another in the end of construction when the WTP is already for operation to monitor any changes in raw water quality
2.2 Environmental Monitoring of CSC
The inspection, evaluation and recording of compliance to the EMP and EMoP as implemented by the contractors are among the tasks undertaken by the Construction Supervision Consultants (CSCs) in the field with the assistance of the PIA Consultant The weekly and monthly inspections and records maintained by the CSCs are the D-B Contractor’s implementation of the mitigating measures and activities prescribed in the approved EMP and EMOP of the Subproject
These inspection, evaluation and records are consolidated by the CSC as in their Quarterly Environmental Monitoring Report The CSC’s collation and synthesis of the D-B Contractors’ compliance to the requirements of the EMP and EMOP are summarized in matrix attached with the report to be submitted to CPMU and PIA Consultant within 15 days after the end of each quarter
2.3 Monitoring Activities Carried out by PIA Consultant
PIA Consultant has provided support and advises to CSC and D-B Contractors in implementation of EMP/EMOP and assisted CPMU in compiling monitoring reports for submission to ADB
Inspection of environmental performance is undertaken by construction supervision consultants (CSCs) daily at the subproject sites and by PIA Consultant’s Construction Supervision and Environmental Specialists during field visits and/or as required During the 1st and 2nd quarter of 2014, the PIA Consultant conducted 03 field trips to the subproject The on-site visits were made to check the progress and quality of the construction works and compliance with contract documents including safeguards issues
After each on-site review a meeting with PPMU, CSC and Contractor staff was held to give them recommendation/advises to the Subproject implementation and to discuss and find resolutions to the emerged issues Specific site to monitor the environmental compliance of Pilot Subprojects consisted of the following activities:
(i) Validation of physical progress of the construction works and pipe laying activities
on routes of the designed pipeline network and point out non-compliance with the
Trang 18approved EMP and EMoP (e.g Realignment of pipelines/distribution lines to avoid cultural/ historic structures or cutting down big trees, and relocation of construction sites);
(ii) Overseeing safety of the construction workers;
(iii) Inspection of the environmental condition and sanitation of construction sites;
(iv) Inspection of construction diaries and record keeping at the construction sites; and (v) Random spot checking of households and public latrines;
Checking the subprojects’ construction works to gather and collate environmental monitoring reports and analyse the compliance of the pilot subprojects as defined in the subproject’s EMP and EMoP
The collation of the CSC’s quarterly monitoring report and PIA Consultant’s on-site visits
on the assessment of the D-B Contractors’ compliance to the requirements of the EMP and EMOP is summarized in environmental performance matrix of the Subproject attached
with this report as an Annex 1
2.4 Key Issues and Corrective Actions
The following issues were identified as non-compliance by the contractor to the provision
of the EMP/EMoP:
(i) The report on garbage and domestic waste water collection from construction camps and the proper disposal to the approved disposal area has not been recorded/reported in writing by the contractor The contractor was advised and prompted to properly comply with the reports on waste management as provided in the EMP including proper disposal of waste at duly approved by the local authorities;
(ii) Though most of the workers come from the neighbour communes, their families and children are living with them in workers’ camps at the construction site for the convenience of taking care of each other Many children at kindergarten or school age if not looked after carefully may be at high risk of health hazards caused by numerous activities at the construction site; and
(iii) The living condition of workers and their families is not sufficient as observed and primarily assessed by PIA Consultant The two camps seem not strong enough to stand against normal storms (see figure 7)
3 INVOLUNTARY RESETTLEMENT PERFORMANCE MONITORING
3.1 Summary of Compliance with RP Requirements
Ha Tinh PPMU has paid compensation to the affected households before ADB’s approval
of the Updated Land acquisition and Resettlement Plan (LARP) As consequence of said non-compliance, ADB issued Letter dated 21 January 2014 to stop construction activities
of Ha Tinh subproject
After ADB mid term review in May 2014, Ha Tinh PPMU informed that there are 05 new households affected on land and crops in the new location of the booster pumping station
Trang 19Therefore, the LARP had to be revised again PPMU also hold a public consultation on 26 May 2014 informing to Tien Loc CPC and 7 households who were to lose land and crops due to the planned location of the booster pumping station, that the mentioned previous
land is not used for project anymore and it will be used to build Mai Hac De monument (
Letter No 434/TB-ODA dated 26 May 2014)
The LARP was revised again accordingly and on 26 June 2014 Ha Tinh PPMU submitted
it to ADB for approval Through No Objection Letter dated 07 July 2014, ADB approved the Updated Ha Tinh LARP and allowed construction works to resume
As requested by ADB and CPMU, PIA Consultant undertook a review of LARP processes carried out and prepared Due Diligence Report and submitted it to ADB on 21 July 2014
Through CARB, PPMU has fully paid to 72 households affected households, in which, 5 households affected by land and crop; 67 households affected by crop only The total amounts paid to the affected people are 659,482,486 VND The redness grievance mechanism was established in communal, district and provincial levels to solve complaints from affected persons
On 29 and 30 June 2014, PIA went to Ha Tinh for Due Diligence Report, according to CARB up to now no complaints have been raised

5.1 Public Consultation and Meeting
Consultation related to Environment Issues
Ha Tinh PPMU held two public consultation meetings on 07 February 2014 at the meeting hall of Thanh Kim CPC for Thach Bang and Thach Kim communities and on 08 February
2014 at the meeting hall of Thinh Loc CPC for Thinh Loc community respectively The consultation meetings aimed to inform affected people of the project progress and environmental mitigation measures applied as well as to collect their opinions/ concerns
Participants at the consultation meetings included some affected people and other concerned stakeholders, namely:
Representatives of the subproject owner;
Representatives of design and build consultant;
Representatives of the local authorities such as the CPC;
Representatives of the local mass organizations such as Communal Fatherland Front Committee, Communal Women’s Union, Communal Farmers’ Union; and
Representatives of Subproject affected people
The number of participants excluding project staff was more than 19 people (1 female) at Thach Kim commune meeting and more than 11 people (3 female) at Thinh Loc commune meeting All attendants were Kinh people as there are none ethnic minority people in the subproject area
Issues and recommendations raised by the participants are summarized as follows:
Trang 23(i) The construction contractors are requested to comply with committed mitigation measures and apply reinstatement right after construction to ensure convenience for the local residents (by representative of Communal Fatherland Front Committee (CFFC) of Thach Kim commune, representative of CFFC of Thinh Loc commune and representatives
of Communal Vietnam Women’s Union of Thach Bang commune and Thach Kim commune etc.)
(ii) The contractors are expected to speed up the subproject progress as people are in high demand for clean water (by Leader of Hoa Thanh hamlet, Thach Kim commune and Leader of Binh Yen hamlet, Thach Bang commune and many other participants)
(iii) The local authority hopes that construction contractors shall comply with the procedure and mitigation measures as committed and promise to corporate with PPMU, CSC and contractor to resolve any issues if occurring (by Thach Kim CPC’s Deputy Chairman and Thach Bang CPC’s Deputy Chairman)
(iv) High consensus on immediate construction of water supply plant and early implementation of all other Subproject’s components
Up till now, the negative impacts of the project to the environment have been insignificant
The proposed mitigation measures have been accepted and agreed by the local residents
and mass organizations
Consultation related to Resettlement Issues
Public consultation meetings with affected households were conducted after basic design was prepared and another time after detailed design was approved Because of changing the location of booster pumping station, consultation meeting was conducted with new 05 AHs in new location of booster pumping station, as follows:

5.2 Information Disclosure
Environment
The IEE and SIEE have been posted on the Subproject CPCs’ notice boards for public
information (see Annex 3 figure 1 and figure 2)
5.3 Training – Capacity Building
PIA consultant organized a training course on social safeguards, resettlement and environment policies of ADB in Tam Ky city of Quang Nam province on 2-4 April 2014
There were 38 participants from CPMU, PPMUs, CSCs of pilot subprojects, FS consultants of batch-2 subprojects and commune/ district officials coming from 6 subproject provinces Four (04) out of 38 participants were female and only one among all trainees was from ethnic minority group (Co’Tu people) The participants from Ha Tinh province comprised of 02 PPMU staff and 01 district official from pilot and 02 district officials from batch-2 subprojects The training strongly improved understanding of practitioners at the local level in terms of ADB’s and GoV’s environmental and resettlement policies as indicated in the increase of the average score of the same test given
at the beginning and the end of the course (135% and 137% for environment and resettlement respectively)

Grievance Mechanism has been established at the Commune, District and Provincial levels The office and persons responsible for receiving complaints and grievances have been identified based on Letter 583/BC/ODA dated 30 June 2014 Members in charge of solving complaints in compensation of the subproject of Thach Bang - Thach Kim - Thinh Loc commune, Loc Ha district are:
7 CONCLUSION AND RECOMMENDATIONS
EMP/EMoP Implementation
The results of the implementation of the EMP/EMoP have indicated that most of the requirements of the EMP have been followed by the contractor Only some measures related to (i) no evidence on information sharing of sexually and socially transmitted infections; (ii) many children at kindergarten or school ages are living in workers’ camps and thus exposed to high risk of health hazards caused by numerous construction activities and (iii) poor conditions of the two workers’ camps that were not properly and timely
Trang 26complied as prescribed in the approved EMP/EMoP have not been implemented to prevent and minimize the impacts recorded in the subproject area
The impacts during construction works include reduced air quality from dust and dust annoyance; disruption of traffic caused by trench excavation activities and installation of pipelines; exposed soils and from hauling and transport of construction materials
The overall implementation/compliance of the Subproject contractor to the EMP/EMoP may be rated as satisfactory The CSC shall enforce that the contractor will comply with all the provisions of the EMP/EMoP and corrective measures will be properly and timely implemented
To prevent further impacts that will cause negative impacts to the environment, to local community and to the health and safety of the public and construction workers a close supervision of the construction activities and strict enforcement of the compliance of the contractor with the mitigating measures and requirements of the EMP/EMoP are required from the CSC
Although the submission of reports from the CSCs and PPMUs is satisfactory, the reporting can be improved by collating daily records (diaries) by the CSCs and the Environmental Officers of the PPMUs into weekly reports and the weekly reports into monthly reports to be submitted to the PIA consultant and the CPMU
RP Implementation
Ha Tinh PPMU has paid compensation to affected households before ADB approved the Updated Land acquisition and Resettlement Plan (LARP) As a consequence of the said non-compliance, ADB issued Letter dated 21 January 2014 to stop construction activities
of Ha Tinh subproject After that, Ha Tinh PPMU has updated LARP and submitted it to ADB for approval Through No Objection Letter dated 07 July 2014, ADB approved the Updated Ha Tinh LARP and allowed construction works to resume
As requested by ADB and CPMU, PIA Consultant undertook a review of LARP processes carried out and prepared Due Diligence Report and submitted it to ADB on 21 July 2014
with the following conclusions:
Compensation rates issued by the Provincial People’s Council Decision
No 472 QD-UBND dated 21 Feb 2014 and No.1691/QD-UBND dated 6 June 2014 , No 472 QD-UBND dated 21 Feb 2014 were based on replacement prices and these unit prices were used to compensate the losses
All Affected Households were satisfied with compensations paid
The Grievance Mechanism has been officially organized and disseminated
to communities, local authorities and other stakeholders
