Section 1 Introduction
<Client>, in a joint-venture with ABC, require a new fruit cups manufacturing facility in Vietnam to process fresh fruits into puree and fruits chunks, then filled into cups and pasteurized, to meet the required sales volumes and comply with local and international codes, regulations and guidelines for a safe food production
<CLIENT> seek the services of a highly qualified Contractor, herein referred to as the Turnkey Contractor, with experience on the Design and Build (DB) type of contract for The Design and Build of
a New Fruits Processing Facility for Fresh & Better International Inc at VSIP-IIA, Binh Duong Province, Socialist Republic of Vietnam (Package 1: Building (Core) And Site Works) at an area of 30,000 sqm
1.1 Objective of this Document
This “Request for Proposal” (RFP) is introduced to establish a concrete method of understanding the project, the Owner’s requirements and needs, and Turnkey Contractor a scope of work Consequently, the Design and Build (DB) has to be done by the Turnkey Contractor and they are bound to all criteria enclosed herein But they may recommend, suggest and introduce other areas
of interest that might enhance the project
The purpose of this document is to select a suitable Turnkey Contractor who have got expertise in design, and execute and complete the work in accordance with this RFP (which includes Civil, Structural, Architectural, Site Developments, etc.) as per latest food & beverages standards for buildings and construction (ISO 22000, FDA, EHEDG, GMPs, GEPs, etc.) for a New Fruits Processing Facility as per all the regulatory standards and latest engineering codes
The below summarizes all construction works required for this New Fruits Processing Facility which include all Civil & Structural works and Architectural Works, like:
a) Site Preparation (Site Clearance, Earthworks & etc.)
b) Work below Lowest Floor Finish (Foundation/Piling, pile cap, column stump,
ground beam, ground slab & etc.)
c) The Frame (Beam & Column)
d) Upper Floor (Upper floor slab, roof slab & etc.)
e) Roof Construction

1.2 Project information
The project is located at VSIP-IIA, Binh Duong Province, Socialist Republic of Vietnam, which should have the manufacturing plant, administration building, staff change room, storage warehouse, laboratories, site amenities, canteen and all other service as required for the entire manufacturing complex and as described herein after and detailed in the Basic Design documents transmitted together with this RFP
1.3 Project Scope
The Turnkey Contractor shall be responsible to Design and Build (DB) a main production building and ancillary buildings that include the following works:
a) Fruit Processing Facility:
Receiving, staging & ripening warehouse, production area (fruits chunks line, puree production line and fruit cups filling & packaging line), cold storage room,
Finished goods warehouse, loading dock with dock levelers, all walkways, all platforms, all staircases This excludes the process equipment
f) Lightning protection and earthing
This document sets the standards & rules to be followed by the Turnkey Contractor in order to achieve <CLIENT> goals and requirements to consider If the above-mentioned Turnkey Contractor does not provide a complete and functional project that can operate and be utilized, then the
Trang 4Turnkey Contractor has to prepare all additional services required to complete the project, free of charge Because as Client, we strongly believe the aim of asking a Turnkey Contractor is to provide complete services and to achieve all requirement for the successful completion of the project And the contract will be awarded to the Turnkey Contractor as a Lump sum project
Turnkey Contractor will be required to generate a broad search for the best design and execution solution to this particular prestigious project which should be approached with creativity and care for all Building regulations, Food & Beverage facilities standards, local and international building standards The major task lies in the successful integration of the project with the surrounding environment preserving and prevailing the identity of the project Turnkey Contractor shall give a high priority as well to internal functions, safety and security aspects

Section 2 Procedural Rules and Submittal Requirements
2.1 Contract types
You are requested to sign contract thru Trung Nam Design Construction Trading Co., Ltd (called
“Trung Nam”), whether you are general contractor or collaboration contract with Trung Nam In any cases, Trung Nam will do for the permitting and project management

All queries and other requested information, which any Turnkey Contractor may have between now until the 28th of August 2019 should be directed to Trung Nam as mentioned above, by

2.3 Communication
It is the intention of <CLIENT> to disseminate information to all Turnkey Contractors in an equitable manner Therefore, all communication between <CLIENT> (client), Turnkey Contractors (participants) of this project shall be routed through and directed to the Client thru Trung Nam only The Client, with consent from Client, may disqualify any Turnkey Contractor who does not comply with this communication procedure
In accordance with the schedule, and to be equitable, answers to all questions will be sent to all registered Turnkey Contractors and <CLIENT>, thereby becoming an official addendum and an integral part of the RFP documents
2.4 Modification of Requirements
<CLIENT> reserves the right during the Selection Phase to add, vary, change or modify their requirements In such an event, the Client shall notify the Turnkey Contractors thru Trung Nam of such a change and any time adjustment required for the submission
Trang 62.5 Submission Requirements
The Contractor’s proposal shall be prepared according to the requirements of the Request for Proposal The Turnkey Contractor is required to submit a proposal comprising two separate sections which include:
Technical Proposal Financial Proposal
The Technical Proposal shall comprise the Contractor’s discussion of project comprehension, work program; man-month input schedule and curriculum vitae of the project team members The Financial Proposal shall comprise the Turnkey Contractor’s commercial proposal
Two copies of each proposal shall be submitted both in hard and soft format The submittal requirements for each of the required proposals are outlined below:
a) TECHNICAL PROPOSAL
The Turnkey Contractor shall submit a Technical Proposal explaining his approach to the design and execution of this project as well as the following elements:
1) Revised Site Master Plan, based on Trung Nam’s Basic Design
2) Revised layout for the main production building and ancillary buildings,
based on Trung Nam’s Basic Design
3) Environment, Health & Safety Plan
4) Project Execution plan (PEP)
5) List of materials with brand details to be provided
6) Basic 3D model of the site and buildings
7) Work program
Discussion of Project Comprehension
This element shall consist of a concise but complete description of the Contractor’s Comprehension of the project divided into the following distinct sections:
Purpose of the project
Problems and issues related to the project
Technical and professional requirements of the project, including the following:
Codes, Regulations and Standards to be applied
Parameters governing design and special requirements, if any

The work program shall be presented in a simple bar chart form or Gantt chart This program shall identify the proposed work tasks (activities) for each project phase, duration of tasks, formal review period, and contacts with governmental agencies for the permitting procedure until final approval
The Turnkey Contractor shall produce a work program that realistically fulfills the requirements
of this RFP The program must be logically sequenced and adequately detailed to convey a clear understanding of the proposed requirements The Turnkey Contractor shall describe products and deliverables resulting from tasks
In setting out the work program, the Turnkey Contractor shall allow sufficient time for <CLIENT>
to review each phase of the works
Man-Month Input Schedule
The Turnkey Contractor shall submit a Man-Month Input schedule for each professional team member Also, the Turnkey Contractor shall submit a separate Man-Month Input Schedule for technical and support team, grouped according to their specialization and their total input for each phase Man-Month Input Schedule shall be coordinated with the work program and tasks developed by the Contractor
b) FINANCIAL PROPOSAL:
The Turnkey Contractor shall submit his fee proposal separately as per Table C below, as a fixed lump sum The Turnkey Contractor’s fee shall also consider direct staff salaries, office overheads, profits and direct expenses
The Contractor shall consider travel expense and accommodation of his staff as part of this agreement

Fees should include the below items:
Any costs associated with obtaining permits, performing site & traffic surveys, soil investigations, technical reports, studies, evaluations & tests, telephone, local taxes, fax, E-mail, postage, courier, shipping, computer plotting, supplies, reproduction/ photographic, and any others
2.6 Submittal Procedures
The Turnkey Contractor shall submit the two-part proposals (Technical & Financial) according to the formats and procedures described in section 2 in Two (2) copies of each and shall be submitted in one or more envelopes which are sealed, each enclosed inside a second sealed envelope The following must be written on the inner envelope of each proposal:
The submission shall be presented on A3/A2 for drawings and A4 for document size paper

2.7 THE EVALUATION PROCEDURE
The Turnkey Contractor's technical proposal with all agreed tender, design documents,
Trang 11construction, validation and commissioning documents once submitted will be evaluated first Evaluation criteria will be weighted heavily in favor of its adherence to the RFP
All material requested must be clear, concise and thorough Where restrictions or Formats are specific, they must be followed explicitly
The evaluation of the Turnkey Contractor will be exercised through a team consisting of project Department; any modification in the design will be reviewed and finalized before the selection of the Contractor
After tendering stage all phases will be directly reviewed by the Project Department that will be accountable for approving all the design and technical submissions by the Contractor
All the construction, validation and commissioning stages should be coordinated through the Project Department
Trung Nam will be together with Design and build contractor for the interview if any requests from the Client
2.8 POST-SELECTION ACTIVITIES
a) Award of Contract
<CLIENT> will enter into an agreement with the first winner provided that:
- The Turnkey Contractor and <CLIENT> shall reach a technical and commercial agreement based on mutually accepted terms and conditions
- It is the intent of <CLIENT> to enter into an agreement with the first winner
Should negotiations fail with the winner, <CLIENT> shall have the right to negotiate with the second ranked Turnkey Contractor, and upon failure in this instance, proceed no further than to negotiate with the third ranked Turnkey Contractor
b) Owner’s Rights (<CLIENT>’s Rights)
<CLIENT> reserve the right, for whatever reason, to disregard the evaluation results He may select to enter into an agreement with any one of the competing firms Also, <CLIENT> reserves the right for whatever reason not to enter into an agreement with any of the competing Turnkey Contractors
c) Rights and Obligations - Disqualification
<CLIENT> prior to deliberation may recommend that a Turnkey Contractor be disqualified on any of the following grounds:
