Năm 2011 Chi cục Bảo vệ môi trường đã tiến hành biên soạn và in ấn “Cẩm

nang bảo vệ môi trường dành cho chủ Doanh nghiệp” để phân phối đến các

doanh nghiệp Trong năm vừa qua, các văn bản pháp luật về bảo vệ môi trường đã

có những thay đổi và các văn bản mới thay thế cho các văn bản trước đây Do đó, để kịp thời cung cấp các thông tin và các quy định mới của pháp luật bảo vệ môi trường đến chủ các cơ sở sản xuất công nghiệp, Chi cục Bảo vệ môi trường đã tổ chức biên soạn lại tài liệu này nhằm cập nhật các quy định mới nhất về bảo vệ môi trường mà doanh nghiệp cần phải biết, phải thực hiện kể từ khi chuẩn bị thành lập đến khi đi vào sản xuất ổn định

Đây là tài liệu hướng dẫn rất hữu ích dành cho các Doanh nghiệp để thực hiện các giải pháp bảo vệ môi trường cho cơ sở sản xuất của mình; đồng thời cũng là tài liệu tuyên truyền bổ ích dành cho các cán bộ làm công tác quản lý nhà nước về môi trường

In 2011, Environmental Protection Agency compiled and printed

“Environmental protection manual for business owners” to distribute to

enterprises In recent years, the legal documents for environmental protection have been changed and new documents replaced old ones Therefore, in order to update timely information as well as new rules of the environmental protection law to the owners of industrial production facilities Environmental Protection Agency has recompiled this document to instruct the latest laws about environmental protection issues that the enterprise need know and has to perform from established preparation

to production stably.

This guide-material not only is very useful for enterprises to implement measures

of environmental protection for their production facilities but also is helpful propaganda material for cadres working in State management about environmental field.

During compilation process, may have some uncompleted issues so the editorial board looks forward to receiving valuable comments of managers, environmental experts in order that the manual can be improvable in next editions.

PREPARATION PERIOD

Lưu ý: Nếu cơ sở SX, KD, DV đang hoạt động nhưng có nhu cầu cải tạo, mở rộng, nâng cấp, nâng công suất mà có tổng công suất (hiện hữu và mở rộng) tương đương với các DA được quy định tại phụ lục II của NĐ 29/2011/NĐ-CP thì lập ĐTM, ngược lại lập CKBVMT cho DA

đối tượng lập ĐTM hay CKBVMT

3 Thời điểm lập ĐTM hoặc CKBVMT:

- DA thăm dò, khai thác khoáng sản:

trước khi xin cấp, điều chỉnh giấy phép

Remarks: If an enterprise or entity (manufacturing, business, services) has the need to modify, expand, upgrade, increase capacity and the new production capacity (including the existing one plus the expanded one) meets the capacity requirements as listed in the Annex II of Decree 29/2011/NĐ- CP), the enterprise would need an EIA, otherwise, only CEP is needed for the expansion project.

I WHAT SHOULD AN ENTERPRISE DO DURING THE CONSTRUCTION PERIOD?

1 Make an EIA or CEP and

29/2011/NĐ-CP to see if an enterprise/project

needs an EIA or CEP or not

3 When to make the EIA or CEP?

- Mineral exploration and production

projects: before applying for or before asking approval on the modifications of the Mineral Exploration and Production License

- Projects with construction works: before applying for Construction License and before asking for approval on the modifications of the Construction License

- Other projects: before the investment decision is made

4 Where to submit the EIA/CEP

- EIA: to the DONRE or MONRE as regulated in the Annex III ‘List of projects under the MONRE’s EIA review and apprpval ” issued together with the Decree 29/2011/NĐ-CP

- CEP: to the District’s People’s Committee where the project takes place

1 Hồ sơ đăng ký đối với DA đầu tư không

thuộc đối tượng phải lập ĐTM gồm:

- Ba (03) bản CKBVMT theo mẫu quy định

tại Phụ lục 5.1 và 5.2 của TT

26/2011/TT-BTN-MT

- Một (01) bản DA đầu tư (báo cáo nghiên

cứu khả thi) có chữ ký và đóng dấu của chủ DA

2 Hồ sơ đăng ký đối với các DA không thuộc

đối tượng phải lập DA đầu tư và không thuộc

- Ba (03) bản CKBVMT theo mẫu quy định

tại Phụ lục 5.3 của TT 26/2011/TT-BTNMT

- Một (01) bản thuyết minh về phương án SX, KD, DV được chứng thực bởi chữ

ký của người đại diện có thẩm quyền và và đóng dấu của cơ sở SX, KD, DV

3 Thời gian xác nhận: 05 ngày làm việc

2 Thời gian thẩm định: 45 ngày làm việc

Lưu ý: Trong quá trình triển khai DA đầu tư, hoạt động sản xuất, kinh doanh nếu có những điều chỉnh, thay đổi về các nội dung của ĐTM, CKBVMT và biện pháp BVMT đã được phê duyệt, xác nhận: phải có báo cáo bằng văn bản gửi cơ quan đã phê duyệt, xác nhận và chỉ được phép thực hiện sau khi có ý kiến chấp thuận bằng văn bản của cơ quan này.

Lưu ý: Trong quá trình lập ĐTM, chủ DA phải tham vấn ý kiến UBND cấp xã nơi thực hiện

DA và đại diện cộng đồng dân cư, tổ chức chịu tác động trực tiếp của DA

III LÀM THẾ NÀO ĐỂ LẬP CKBVMT?

1 A set of documents (for those who are

not required for the EIA) include:

- Three (03) CEP using the template

specified in the Annex 5.1 and the Annex 5.2

of the Circular 26/2011/TT-BTNMT

- One (01) investment project (feasibility

study report) with the projects owner’s

signature and stamp

2 A set of documents (for those which are

not required for the Investment project and for

the EIA) includes:

- Three (03) CEP using the template as regulated in The Annex 5.3, Circular 26/2011/TT-BTNMT

- One (01) Report describes the details of manufacturing, business, and services signed by authorized representative persons and stamped with the enterprise’s chop

3 Approval time: 5 working days

EIA review at Binh Duong DONRE

1 Documents for review include:

- One (01) document asking for review/approval – using the template in the Annex 2.3 y the Circular 26/2011/TT-BTNMT

- Seven (07) EIA whose contents and structure are in line with the Annex 2.4 and 2.5 of the Circular 26/2011/TT-BTNMT

- One (01) investment project (feasibility study report) with the projects owner’s signature and stamp

2 Reviewing and approval time: 45 working days

Remarks: During the project implementation, if there is any modifications and changes

to the contents of the EIA Report and of the CEP Report, and to the approved environmental

protection measures, the project owners must notify and get approval of the authorized agencies

who have approved the Report before making any changes.

Remarks: During the EIA Process, the projects owner(s) need to consult the People’s Committee of the Commune where the project takes place and the local people representatives and organizations who will be directly impacted by the project.

- DA có một trong những thay đổi về

công nghệ, quy mô, công suất làm gia

tăng phạm vi gây tác động, gia tăng các

tác động xấu đến môi trường hoặc làm

gia tăng mức độ phát thải hoặc phát sinh

các loại chất thải mới, chất thải có thành

phần gây ô nhiễm cao hơn so với dự báo

trong CKBVMT đã được đăng ký nhưng

chưa tới mức phải lập ĐTM

1 Đối với ĐTM:

- Thay đổi địa điểm thực hiện DA hoặc

sau 36 tháng DA mới triển khai thực hiện

kể từ ngày ĐTM được phê duyệt

- DA có một trong những thay đổi về

công nghệ, quy mô, công suất làm gia tăng

phạm vi gây tác động, gia tăng các tác động

xấu đến môi trường hoặc làm gia tăng mức

độ phát thải hoặc phát sinh các loại chất

thải mới, chất thải có thành phần gây ô

nhiễm cao hơn so với kết quả tính toán, dự

báo trong ĐTM đã được phê duyệt

Lưu ý: Trường hợp không có sự thay đổi về công suất thiết kế, công nghệ và tác động đến môi trường thì chỉ cần làm văn bản giải trình với cơ quan phê duyệt, đăng ký để được điều chỉnh

IV TRƯỜNG HỢP NÀO PHẢI LẬP LẠI ĐTM/CKBVMT?

Expand or inrease the scales of

production

1 For the EIA:

- The project location is changed or the

project has not started within 36 months

since the date the EIA gets approved

- The project has one of the following

changes: technology, scale, and production

capacity which can increase the negative

environmental impacts such as increasing

the air emission level or generating new

wastes or wastes of higher polluting level

than initially calculated in the approved

EIA

2 For the CEP:

- The project is relocated or has not

started within 24 months since the date the

CEP is registered

- The project has one of the following

changes: technology, scale, production

capacity which can increase the negative

environmental impacts such as increasing

the air emission level or generating new

wastes or wastes of higher polluting level

than initially calculated in the approved

CEP but less than the levels required for the

EIA

Remarks: When there is no change in terms of designed production capacity, technology

and the environmental impacts, the project just needs to submit a document detailing the

changes to the approving/registration agencies for modification approval

1 Điều chỉnh DA đầu tư để đảm bảo phù

hợp với yêu cầu của QĐPD ĐTM

2 Lập, phê duyệt và niêm yết công khai kế

hoạch quản lý môi trường tại trụ sở UBND

cấp xã nơi thực hiện việc tham vấn ý kiến

cộng đồng để nhân dân biết, kiểm tra, giám

sát

3 Tổ chức thực hiện các biện pháp bảo vệ

môi trường trong giai đoạn chuẩn bị đầu tư và

giai đoạn thi công xây dựng DA theo yêu cầu

của QĐPD ĐTM

4 Thiết kế, xây lắp các công trình và thực

hiện các biện pháp xử lý nước thải, chất thải

nguy hại, chất thải rắn thông thường, bụi, khí

thải … theo ĐTM được phê duyệt

5 Vận hành thử nghiệm các công trình xử

lý chất thải phục vụ giai đoạn vận hành của

DA

6 Lập hồ sơ đề nghị kiểm tra, xác nhận việc

thực hiện các công trình, biện pháp BVMT

phục vụ giai đoạn vận hành của DA trước

khi đi vào vận hành chính thức theo mẫu quy

- Trường hợp DA được đầu tư theo nhiều giai đoạn hoặc có nhiều hạng mục độc lập, chủ DA được lập hồ sơ đề nghị kiểm tra, xác nhận việc thực hiện các công trình, biện pháp BVMT phục vụ giai đoạn vận hành của DA theo từng giai đoạn hoặc theo các hạng mục độc lập của DA

The contruction of wastewater treatment systems

1 Adjust the investment project

to ensure that it is in line with the

requirements specified in the decision

for the EIA Approval;

2 Make, get approved and publish

the environmental management plan

at the People’s Committee of the

commune where the public consultation

process has taken place to inform the

local people so that they can monitor

the implementation

3 Coordinate the implementation

of environmental protection measures

during investment preparation phase

and during the construction phase

in accordance with the requirements

specified in the decision for the EIA

Approval;

Remarks:

- For those who do not need environmental protection facilities for the operational period, the project’s owners are not required to make a file asking for the inspection and certification of envi- ronmental protection facilities for the operational period.

- In case the project has different investment phases or independent works the projects owners need to create a file asking for the inspection and certification of environmental protection facilities for each phase of the project or for each independent work.

4 Design and install environmental

facilities including wastewater treatment, hazardous waste and non-hazardous waste management, air and dust emission treatment, etc as committed in the approved EIA;

5 Conduct the operational trials of the waste treatment facilities;

6 Create a file to ask for inspection and approval of the environmental protection

facilities before they are put into official operation The file must use the template

in the Annex 4.2, and 4.3, Circular 26/2011/TT-BTNMT

I WHAT SHOULD AN ENTERPRISE’S OWNER NEED TO DO AFTER THE EIA GETS APPROVED?

Tổ chức thực hiện các biện pháp giảm thiểu những tác động xấu đến môi trường trong CKBVMT đã được đăng ký.

1 Hồ sơ đề nghị xác nhận gồm:

- Một (01) văn bản đề nghị kiểm tra xác

nhận việc thực hiện các công trình, biện

pháp BVMT phục vụ giai đoạn vận hành

của DA thực hiện theo mẫu quy định tại

Phụ lục 4.2 TT 26/2011/TT-BTNMT;

- Một (01) bản sao quyết định phê

duyệt kèm theo bản sao ĐTM đã được

phê duyệt;

- Năm (05) báo cáo kết quả thực hiện

các công trình, biện pháp BVMT phục

vụ giai đoạn vận hành của DA thực hiện

theo mẫu quy định tại Phụ lục 4.3 TT

26/2011/TT-BTNMT

- Năm (05) phụ lục với các tài liệu kèm

theo quy định tại khoản 4 Điều 25 NĐ

29/2011/NĐ-CP

2 Thời gian giải quyết: 40 ngày làm

việc

Lưu ý: Nếu các công trình, biện pháp bảo vệ môi trường có thay đổi, điều chỉnh so với phương

án đã được phê duyệt trong ĐTM thì cần mô tả rõ các thay đổi, điều chỉnh đó (phương án, quy mô, công nghệ …) vào Báo cáo kết quả thực hiện các công trình biện pháp BVMT phục vụ giai đoạn vận hành để được xem xét, thống nhất

III LẬP HỒ SƠ XIN XÁC NHẬN ĐÃ THỰC HIỆN CÁC CÔNG TRÌNH, BIỆN PHÁP BVMT PHỤC VỤ GIAI ĐOẠN VẬN HÀNH NHƯ THẾ NÀO?

II CHỦ DỰ ÁN PHẢI LÀM GÌ SAU KHI CKBVMT ĐƯỢC XÁC NHẬN?

Các công trình xử lý chất thải

The projects owner needs to implement all environmental protection measures

as committed in the CEP to reduce the negative environmental impacts

1 The file must include:

- One (01) document asking for the

inspection and certification of environmental

protection facilities to be used for the projects

operational period using the template as

regulated in the Annex 4.2, Circular 26/2011/

TT-BTNMT;

- One (01) copy of the Decision of the EIA

Approval and one (01) copy of the approved

EIA;

- Five (05) Reports on the implementation

results of the environmental protection

facilities for the operational period using the

template in the Annex 4.3, Circular 26/2011/

TT-BTNMT;

- Five (05) Annexes with all related

supporting documents as regulated in the Item

4, Article 25 of the Decree 29/2011/NĐ-CP

2 Processing time: 40 working days

Remarks: If environmental protection facilities and measures have changed compared with what had been approved in the EIA, these changes need to be described in details (plan, scale, technology, etc.) in the Report on the implementation of environmental protection facilities for the operational period for consideration and approval.

III HOW TO MAKE A FILE TO ASK FOR THE CERTIFICATION OF ENVIRONMENTAL PROTECTION FACILITIES?

1 Lập hồ sơ đăng ký chủ nguồn thải CTNH

2 Kê khai và nộp phí BVMT đối với nước thải.

3 Lập báo cáo giám sát môi trường định kỳ

4 Tuân thủ các quy định BVMT đối với nước

thải, khí thải

5 Tuân thủ các quy định BVMT đối với CTR

6 Tuân thủ các quy định BVMT đối với tiếng

ồn, độ rung, ánh sáng, bức xạ

7 Hướng dẫn về lập Đề án BVMT và các điều

chỉnh ĐTM, CKBVMT

ENVIRONMENTAL MANAGEMENT AND PROTECTION DURING THE OPERATIONAL PERIOD

During the operation period, the enterprise

is required to do the following things:

1 Make a file to register the enterprise as a

hazardous waste generator;

2 Declare and pay the environmental

protection fee for wastewater;

3 Make periodic environmental monitoring

reports;

4 Comply with all environmental protection

regulations/standards regarding wastewater

and air emission;

5 Comply with all environmental protection

regulations/standards for solid waste;

6. Comply with all environmental protection

regulations/standards for noise, vibration,

light, and radiation

7 Guide the generation of the EPP and the

modifications of EIA and of the CEP

1 Hồ sơ đăng ký: 02 bộ hồ sơ gồm: đơn đăng

ký theo mẫu quy định tại Phụ lục 1A và các giấy

tờ theo hướng dẫn tại Phụ lục 1B của TT 12/2011/

- Phân loại, thu gom, lưu giữ và xử lý CTNH

theo đúng quy định tại TT 12/2011/TT-BTNMT;

- Ký hợp đồng thu gom, xử lý CTNH với đơn vị có giấy phép hành nghề quản lý CTNH;

- Nhanh chóng chuyển giao chất thải đi xử lý, có trách nhiệm theo dõi, giám sát việc chuyển giao và xử lý CTNH

- Thực hiện đúng quy trình kê khai và sử dụng chứng từ CTNH mỗi lần chuyển giao CTNH theo quy định

- Lập báo cáo quản lý CTNH theo mẫu quy định tại Phụ lục 4A của TT 12/2011/TT-BTNMT với kỳ báo cáo 06 tháng/lần;

- Khi chấm dứt hoạt động, phải thông báo bằng văn bản và nộp lại Sổ đăng ký chủ nguồn thải CTNH cho Chi cục BVMT

I LẬP HỒ SƠ ĐĂNG KÝ CHỦ NGUỒN THẢI CHẤT THẢI NGUY HẠI NHƯ THẾ NÀO?

Lưu ý: Việc lập hồ sơ đăng ký chủ nguồn thải CTNH không bắt buộc đối với một trong các trường hợp sau:

- Thời gian hoạt động cửa DA dưới 01 (một) năm;

Lưu ý:Trường hợp cần lưu giữ tạm thời CTNH quá thời hạn 06 tháng phải thông báo cho Chi cục BVMT bằng văn bản.

3 Several major responsibilities

of the enterprise’s managers:

- Segregate, collect, store and treat hazardous waste in accordance with all requirements in the Circular 12/2011/TT-BTNMT;

- Sign the hazardous waste collection and treatment contract with the licensed hazardous waste vendor;

- Quickly discharge hazardous waste for treatment, and be responsible for the supervision of hazardous waste collection, transportation and treatment

- Follow the hazardous waste declaration procedure and use the hazardous waste manifest for each hazardous waste transfer as regulated

- Make a Report on hazardous waste management using the template in the Annex 4A, Circular 12/2011/TT-BTNMT every 6 months;

- When the operation ends, the enterprise must notify and return the Hazardous Waste Generator Registration Booklet to the EPA

I HOW TO CREAT A FILE FOR HAZARDOUS WASTE GENERATOR REGISTRATION?

Remarks: Registration as Hazardous Waste Generator is not applied to the following cases:

- The enterprise’s operational period is less than a year.

- Regular generation of no more than 120 kg/year of hazardous wastes containing special hazardous substances exceeding the threadhold as regulated in QCVN 07:2009/BTNMT or no more than 600kg/year for hazardous waste containing other hazardous substances.

Remarks: In case hazardous waste needs to be temporarily stored for more than 06 months,

the enterprise must notify the EPA of this long-term storage in writing.
