1 The urgency of the thesis topic
The public assets (PA) at the Office of the National Assembly (ONA) is important to the country's
PA system With very specific functions and tasks stipulated in the Constitution, the organization and operation of the National Assembly (NA) are different from other State agencies, thus, the arrangement and management of the PA serving for the NA's activities are distinctive One one hand, they have to comply with general regulations; on the other hand, they have differences, such as: must meet the requirements of national security, the main office building is a national symbolic work, people have the right to visit and attend, PA with many different types and uses, spanning many regions of the country The ONA is assigned to exercise the rights and responsibilities of the owner's representative for the PA block at the NA In recent years, this work has revealed many limitations and inadequacies; in many cases, it has not promptly met the operational requirements of the NA, agencies of the NA, and members of the NA, therefore reducing the role and effectiveness of the PA sector assigned to serve the activities of the NA The above situation is due to many reasons, but the main reason is that the management of PA at the ONA is facing many difficulties and obstacles but has not yet found an effective solution On the other hand, this work also faces the requirement to improve in order to renew the management of PA and renew the organization and operation of the NA to meet the requirements of tasks in the new situation
The above-mentioned issues pose urgent requirements and require study and solving fundamentally and build a scientific, reasonable, effective management mechanism for PA at the NA, and consistent compliance with the general regulations of the State, in accordance with the characteristics of operations, contributing to economical and effective use, meeting the operational requirements of the NA Up until now, there has not been comprehensive research on PA management
at the NA Therefore, PhD student has chosen the research topic "Management of public assets at
the Office of the National Assembly of Vietnam" as the thesis to defend the Doctoral degree in
Public Management
2 Objectives and tasks of the study
2.1 Purpose of the study
The thesis aims to build scientific arguments and assess the current situation of PA as well as the management of PA at the ONA, thereby proposing solutions and recommendations to improve the management of PA at the ONA, meeting the requirements of tasks in the new situation, in line with the process of renewing the PA management mechanism in Vietnam

the results achieved and limitations, and draw out the causes of limitations in the period 2018-2023
- Proposing orientations and solutions to improve the management of PA at the ONA in the
Regarding content: The thesis focuses on research on types of fixed assets that mainly serve the
activities of the NA (including housing and land facilities, public cars, working equipment, and tools) The analysis and management of the processes of formation, exploitation and use, and termination of PA are integrated into the analysis of policy formulation, implementation organization, examination, inspection, and supervision of PA management policies at the ONA
Regarding space: the thesis focuses on research on the management of PA in service of activities
for the NA, agencies of the NA, the members of the NA, agencies under the NA’s Standing Committee; at the same time, researching the experience of PA management in the NA (Parliament) of
a number of countries (which are the leading countries in the world in terms of quality, the efficiency
of PA management and have the same types of PA in the NA as in the NA of Vietnam)
Regarding time: the thesis researches the management of PA at the ONA of Vietnam in the period
from 2018 (the time when the Law on Management and Use of PA in 2017 takes effect) to 2023
4 Methodology and research methods
4.2.1 Secondary data collection methods
The thesis researches synthesizes data and materials from a large volume of published scientific documents, documents, and works, including:
- The system of documents of the Party, policies, and laws of the State related to the management of PA
- Published scientific works at home and abroad
- The NA's supreme supervision report on "The implementation of policies and laws on thrift and
anti-waste practices in the 2016-2021 period"; reports and results published from surveys and
inventories of assets, research data of the Government, the Ministry of Finance, etc report on the management and use of PA by the Government and the NA; audit report on the management and use of
PA at the ONA; National Database on PA; information from the website of the Ministry of Finance's
PA website
4.2.2 Primary data collection methods
Primary information and data are carried out in the process of research using sociological survey methods conducted by the author

On the basis of the collected information, data, and documents, the thesis will use specific methods such as statistics, comparison, quantification, analysis, synthesis, inference, etc., in order to evaluate and compare data, analyze differences between periods, analyze objective and subjective causes leading to such differences
5 Research questions and scientific hypotheses
5.1 Research Questions
- Question 1: What are the peculiarities and differences between PA and PA management at the
ONA compared to other State Agencies?
- Question 2: What are the contents of PA management at the ONA? What principles must be
followed, and what factors depend on the management of PA at the ONA?
- Question 3: What positive results have been achieved in managing PA at the ONA of Vietnam
over the past time? What are the main limitations and shortcomings in the management of PA at the
ONA of Vietnam?
- Question 4: How will the request to renew the activities of the NA of Vietnam and the renewal
of the PA management affect the PA management of the ONA of Vietnam in the coming time? What solutions are needed to improve the management of PA at the ONA of Vietnam, and can they be applied to other Central Offices?
5.2 Scientific hypothesis
(i) The PA at the ONA has specific and different points compared to the management of PA in
other State Agencies;
(ii) The management of PA at the ONA is both state management and internal management of all
types of PA;
(iii) The management of PA at the ONA of Vietnam has achieved positive results over the past
time, but there are still many limitations and shortcomings;
(iv) Requirements on the renewal of the organization and operation of the NA of Vietnam and the
renewal of the PA management, which greatly affect the PA management of the ONA of Vietnam;
6 New contributions of the thesis
- Providing experiences of some countries in the world on the management of PA in general and
PA management in the Parliament in particular, thereby drawing experiences that can be applied in the

a theoretical basis associated with reality in line with the current trend of PA management reform and orientation to innovate the operation of the NA of Vietnam
7 Scientific and practical significance of the topic
7.1 Scientific significance of the topic
Contributing to perfecting the theoretical basis for PA management in the State Administration in general and at the ONA in particular; have made practical contributions to public management science The thesis will be the first comprehensive research work and a reference in PA management at the ONA
7.2 Practical significance of the topic
- The research results help policy-makers have a comprehensive view and consider amending and supplementing regulations on PA management in the State Agencies in general and at the ONA State in particular
- The thesis has high practical value and provides viewpoints and experiences for reference, consideration, and application of the same to other Central Offices (including Office of the Central Committee of the Communist Party of Vietnam, the Vietnam Government’s Office, the Vietnam President’s Office) - advisory agencies on the principles and regime of financial and asset management
of the leading central agencies

1.2 General evaluation of research related to the thesis topic
The above research results are very important for the thesis to inherit and continue to develop, depth analysis, contributing to solidifying the theoretical basis for research on PA management Specifically, as follows:
in-Firstly, it has systematized the basic theoretical issues of PA and PA management (including
concept, characteristics, roles, classification of PA, content of PA management, and factors affecting the effectiveness of PA management at agencies and units)
Secondly, it has deeply analyzed the characteristics, models, mechanisms, and policies of PA
management in Vietnam in general and at some specific agencies (State Council, Civil Defense Council)
Thirdly, it introduced experience in PA management in a number of countries around the world
such as the UK, USA, France, Australia, China, etc On that basis, draw important lessons and experiences that can be referred to and applied in policy-making, creating a mechanism for managing
PA in Vietnam
Trang 8Fourthly, the current situation of PA management in the State Administration, Administrative
Population Union, or Civil Defense Agency in Vietnam has been evaluated over the past time, clarifying the results achieved and limitations and identifying the causes of limitations from different research angles of each topic
Fifth, solutions have been put forward to improve the legal system and organize its
implementation, making specific recommendations for each relevant entity to improve the efficiency of
PA management
1.3 Research gaps and problems posed
Firstly, the management mechanism and the organization of PA management in agencies and units studied have changed over time
Secondly, there is still no in-depth research at the doctoral thesis level on PA management at the
National Institute At the same time, the PA block here is an important part of the country's PA system;
it has many specific characteristics and is different from other PA in the State Administrative Bureau Other public units have high-quality requirements and are highly protected by security and safety measures This work reveals many limitations, difficulties, and obstacles, which require timely research, adjustment, and improvement to ensure that it meets the requirements of the task
Thirdly, the research period of the thesis focuses on the period 2018-2023, which is the time when
the Law on Management and Use of PA in 2017 takes effect Therefore, the research results of the thesis will clarify the inadequacies, obstacles, inadequacies, or lack of legal regulations
For the above reasons, the thesis topic does not overlap with previous research works and has high practical value
1.3 Thesis research orientation
The thesis continues to research and fundamentally solve the problems posed in which, focusing
on research and clarification of some of the following issues:
Firstly, inheriting the results that have been announced; at the same time, continuing to research,
supplement, and improve some basic theories on PA and PA management at the ONA, such as the concept of PA, characteristics, and classification of PA; concept, objectives, requirements, contents and factors affecting the management of PA at the National Office In particular, the thesis will clarify the differences and specificities of the PA block at the ONA compared to other State Agencies
Secondly, to study some international experiences on PA management in other countries' NA
(Parliaments), draw lessons and experiences to refer to the management of PA in the ONA of Vietnam
Thirdly, analyze the current situation of the PA block at the ONA of Vietnam and the current
situation of PA management at the ONA of Vietnam in the period of 2018-2023; clarify the achieved results, analyze the limitations, and point out the causes of the limitations based on the asset management process (management of the PA formation process; management of the PA exploitation process and use; manage the process of ending the use of PA) The analysis of the processes of formation, exploitation, and use, and the process of terminating the PA will be integrated with the analysis of the formulation of policies, the organization of implementation, examination, inspection, and supervision of the implementation of the PA management policy at the ONA
Fourthly, based on the Party's and State's views on improving the PA management, the
viewpoint of renewing the NA's activities in the coming time, the thesis proposes a number of
Trang 9specific groups of solutions and recommendations to relevant agencies to strengthen the PA management at the ONA through the improvement of laws, PA management mechanism, on consolidating the organization and management apparatus of PA, on improving the level of PA management team, on strengthening inspection, examination and supervision of the management and use of PA, on strengthening IT application
CHAPTER 2 THEORETICAL BASIS AND PRACTICAL EXPERIENCE
ON MANAGEMENT OF PUBLIC ASSETS AT THE OFFICE OF THE NATIONAL
ASSEMBLY
2.1 Public property at the Office of the National Assembly
2.1.1 Concept of public property
Property is a synthetic concept that includes wealth, material things and civil rights
accompanying material wealth; or means of production and means of daily life of economic value that can be dominated by the subject of civil rights, including all material materials that exist in nature and
are produced by human laborers including currencies and valuable securities
PA is a source of primitive material wealth that is formed, exists in nature or is created by man,
and the right to possess, use and dispose belongs to the State This is an important part of the total national property; the value and quantity of PA are large or small depending on the characteristics of the production relations of the socio-economic forms at each stage of each country The issue of PA or property owned by the whole people is a big content, so it is stipulated in the Constitution and major laws in other countries
2.1.2 The National Assembly and the Office of the National Assembly
In the Constitutions of many countries, the NA (Parliament) is the highest representative body of the People; at the same time, it also stipulates that the NA is an agency of state power In terms of organization, there are currently 02 types of NA organizational models in the world: (i) the single-chamber NA organizational model and (ii) the two-chamber NA organizational model
Regardless of the organization model, the NA has a department of assisting agencies (the ONA or the NA Secretariat) in the operation process In terms of functions and tasks, the ONA has the following roles: (i) advising and consulting, (ii) providing administrative support, operational processes and procedures, and (iii) providing financial support, security conditions, logistics, and technical support
2.1.3 Concept and characteristics of public property at the Office of the National Assembly
2.1.3.1 Concept of public property at the Office of the National Assembly
PA at the ONA is an asset in kind or with budget money that the State assigns to the ONA for
management and use to perform its assigned functions and tasks, including budget money, land used as working offices, land for construction of public non-business establishments; working offices, houses, works and other land-attached assets; means of transport (cars, specialized vehicles ); machinery, equipment, working facilities and other assets for the activities of the NA, agencies of the NA, members of the NA and the ONA
Trang 102.1.3.2 Characteristics of public property at the Office of the National Assembly
PA at the ONA has not only similar commonalities in other State Agencies, but also has unique and distinct features, which are reflected in the following points:
(i) Regarding specific points and differences
- PA at the ONA serves diverse types of activities: the NA, Committees of the NA (being elected bodies, regularly meeting and deliberating); ONA (which is an agency of the State Government); leaders of the NA, the members of the NA (individuals with the characteristics of having to go on business trips, meetings, and contact with voters); public sectors (with the characteristics of non-business activities with revenue)
- The PA must meet the requirements of safety and confidentiality and ensure national security because the NA is the central body, the highest state power agency, and considers and decides on many important national issues, with the content of national secrets
- The management of the NA 's headquarters building (the NA House) is different from the management of other office buildings because the NA is the institution of the elected body, the highest representative body of the people The NA headquarters in various countries are symbolic works for democracy, which are open to the public to visit, learn about and directly monitor the activities of their representative agencies
(ii) Similarities
- The ONA only has the right to manage and use assets to perform assigned tasks, not for other purposes, unless otherwise provided for by law
- PA at the ONA is mainly formed from the state budget
- PA at the ONA includes assets for management, special-use assets, and special assets
- The PA at the ONA is a part of the national PA system and is protected by law
2.1.4 Classification of public property at the Office of the National Assembly
PA at the ONA is classified based on different criteria such as according to the use of assets, the value of the property, the nature and characteristics of the asset's operation, and the object of asset use
according to the economic nature of the property
2.1.5 The role of public assets at the Office of the National Assembly
(i) The PA is an important foundation, the first and indispensable material condition (working
headquarters, means of transportation, machinery, equipment, etc.) for the NA and agencies of the NA
to perform the functions and tasks prescribed by the Constitution and the law
(ii) PA is a necessary condition to serve the members of the NA to perform the role and tasks of
the representative of the will and aspirations of the People
(iii) PA creates conditions for voters and people to contact and reflect their aspirations with the
NA, agencies of the NA, and the members of the NA
(iv) PA is a condition for the pubic agencies of ONA to operate and organize the provision of
public services
2.2 Management of public assets at the Office of the National Assembly
2.2.1 Concept of management of public assets at the Office of the National Assembly
- Management is the organized and purposeful impact of the management subject on the
management objects and objects to make the most effective use of the organization's resources and opportunities to achieve the set goals in the ever-changing environment
Trang 11- State management is the exercise of state power by state agencies to maintain and establish a
stable social order, thereby developing society according to the set objectives Agencies in the state apparatus perform state management to perform the functions of external affairs and are ensured by the coercive power of the State
- State management of PA in the State Agencies is the exercise of state power carried out by the
State Authorities from the central to local levels in the field of organizing and implementing guidelines and policies on the management of the State Reserves in order to build and develop the State Savings Sector and ensure the Asset Management Sector to serve the activities of the State Agencies and the socio-economic development of the country
- PA management at the ONA means the organization and implementation of guidelines and
policies on PA management at the central level (ministerial level) in order to ensure that PA are assigned, invested in new construction, and procured at the ONA in accordance with regulations, regimes, norms, and standards; at the same time, ensuring that PA at the ONA are effectively used and liquidated thrift and well serve the functions and tasks the State assigns to the NA, agencies of the NA, members of the NA, and the ONA
2.2.2 Requirements for management of public assets at the Office of the National Assembly (i) To agree on mechanisms, policies, and regimes for the PA management in general, but it is
necessary to have separate mechanisms, policies, and regimes for the management and use of specific assets in service of specific activities of the NA;
(ii) Managing and using PA in accordance with the right purposes, standards and norms;
(iii) The management and use of PA must be carried out openly and transparently, ensuring thrift,
anti-waste, and corruption prevention and combat;
(iv) The management of PA at the ONA must be clearly assigned and decentralized the authority
and responsibilities of each agency and unit in performing the task of state management of PA;
(v) The management of PA at the ONA must be associated with the management of the state budget; (vi) PA at the ONA must be fully accounted in kind and value and maintained, repaired and
protected according to the prescribed regime
(vii) The determination of the value of assets in the relationship of purchase, sale, lease, lease,
joint venture, association, liquidation of assets or exploitation of financial resources from PA at the ONA must comply with the market mechanism
2.2.3 Contents of management of public property at the Office of the National Assembly
2.2.3.1 Regarding the promulgation and implementation of legal documents on the management and use of public property
The Chairman of the ONA is responsible for promulgating and organizing the implementation of the regulations on the management and use of PA assigned by the State and ensuring the use of PA for the right purposes, standards, norms, regimes, thrift, and efficiency Except for PA promulgated by the Government and the Ministry of Finance, the ONA shall provide detailed guidance on standards and norms for the use of special-use assets under its management; prescribe the regimes, standards and economic-technical norms of maintenance and repair applicable to PA under their management if specialized ministries have not prescribed the PA for regimes, standards and economic-technical
norms; organize the inspection of compliance with standards and norms for the use of PA
Trang 122.2.3.2 Regarding the management of the assignment of public property; investment in construction, procurement, lease, and contracting of funds for the use of public assets; Establishing the right of the whole people to own property
Managing the PA formation process is the first and most important stage, and it is decisive for the
next stages
- For types of assets assigned by the State: The State shall assign assets in kind to the ONA in
case of lack of assets compared to standards and norms The ONA shall prepare dossiers on assets to serve as a basis for recording asset management books, accounting according to regulations, and serving the arrangement of exploitation, use, maintenance, and maintenance of assets
- For the type of assets formed by investment in construction and procurement: The procurement
of PA at the ONA is currently carried out by the following methods: (i) distributed procurement; (i) centralized procurement
2.2.3.3 Regarding the management of the use, protection, maintenance, and repair of public property; exploitation of financial resources from public property
a Registration of fixed assets: Before putting them into use, they must be registered to manage
and account for fixed assets
b Preparation and management of dossiers on PA: The ONA prepares and manages dossiers for
assets assigned for management Documents on PA include documents related to the formation and fluctuation of assets, reports on management and use, other reports on assets, and data on assets at the
NA in the National Database on PA
c/ Maintenance and repair of PA: The ONA shall be responsible for the maintenance and repair
of PA at the ONA; the State shall ensure funds for the maintenance and repair of PA according to regimes, standards, and economic-technical norms
d/ Lease, joint venture, or association of assets: in case some types of PA at the ONA (such as
halls, cars, etc.) have not yet been used to their full capacity, they shall be allowed to be used by the State Authority, units of the people's armed forces and other organizations A number of NAs and ONAs are allowed to lease, joint venture, or associate with assets assigned to manage and use when the assets are surplus, do not reach their full capacity and meet the State's regulations
2.2.3.4 Management of the recovery, transfer, conversion of functions, sale, liquidation, destruction and other forms of handling of public property
The process of ending the use of assets is the last stage in the management of the life cycle of assets In some cases, the ONA considers recovering, transferring, and rearranging assets for the purpose of managing and using assets for the right purpose, effectively and harmonizing assets under management among users
For assets that have expired, there are forms of handling, including recovery, transfer, sell, and use of PA to pay investors when executing work construction investment projects in the form of construction-transfer contracts, liquidation, destruction, handling PA in case of loss or destruction The entire amount of money collected from the disposal of assets after deducting relevant expenses, the rest shall be remitted into the custody account at the State Treasury
2.2.3.5 Regarding inventory and reporting of public assets
a/ Regarding statistics and inventory of assets: PA at the ONA must be promptly and fully
accounted for in kind and value in accordance with the law on statistics, the law on accounting and relevant laws
Trang 13b/ Regarding the reporting of public assets: to be carried out annually or as required in order to
effectively manage the PA at the ONA and help state management agencies grasp the situation of management and use of PA at the ONA, synthesize them into the common assets of the country, and at the same time, have new investment plans, transfer and handle assets in a timely and effective manner
2.2.3.6 Regarding the construction and operation of the Public Property Information System and the National Database on Public Property
The ONA is responsible for investing in infrastructure, IT, and training resources to manage and operate the information system on PA under its management; compilation and management of dossiers for assets assigned for management; at the same time, updating data on PA types into the national database on PA
2.2.3.7 Regarding inspection, examination, audit, supervision, monitoring, and assessment of the observance of the law on management and use of public property and handling of violations of the law
on management and use of public property
The ONA is responsible for inspecting compliance with standards and norms for the use of PA within the scope of its assigned tasks and powers It needs to organize the inspection in the entire process of investment in construction, procurement, assignment, lease, use and disposal of assets If detecting violations of standards and norms for the use of PA, the ONA must promptly handle them according to their competence or propose competent agencies and persons to handle them in accordance with law
2.2.4 Factors affecting the management of public assets at the Office of the National Assembly 2.2.4.1 Group of objective factors: objective factors such as natural disasters, enemy sabotage,

2.2.4.2 Group of subjective factors: awareness of the use of PA of agencies of the NA, members

to draw some relevant and applicable experiences in the management of PA in the Vietnam National
Assembly Office as follows:
- Apply a special PA management mechanism to the NA House
- Improve the PA management mechanism at the ONA
- Improve the PA management agency model
- Implement innovations related to the use of PA by the NA
- Develop and complete the database on PA of the ONA, strengthen the application of IT in PA management
- Strengthen publicity, transparency and inspection, examination and supervision of PA management
