INTRODUCTION

1 The urgency of the subject

Industrial area has a defined geographical boundary, established to specialize in the production of industrial goods or support services for industrial production Industrial parks are established according to local conditions and regulations The State promulgates regulations to ensure the establishment of industrial parks in accordance with the order, procedures and economic nature of this specific type of entity Production and service activities in industrial parks will stimulate the development of supporting industries, improve the level of labor specialization, competitiveness at home and abroad, and modernize infrastructure, structure, and development of new economic urban areas

Currently, the National Assembly has passed many new legal documents such as the Land Law 2024, the Real Estate Business Law 2023, the Housing Law 2023 including many new regulations on management , industrial park land use However, not all new regulations are consistent with practice Furthermore, to effectively implement those regulations, it is necessary to have appropriate mechanisms

Research to develop and improve legal regulations on industrial park land to improve their operational efficiency needs to be done from both theoretical and practical research aspects In theory, it is necessary to clarify the nature and role of industrial parks and the legal status of industrial parks in land relations In practice, it is necessary to detect, analyze and evaluate the practice of implementing land regulations in industrial parks In practical research, choosing appropriate localities will help make more representative assessments Hanoi is the leading political, economic, cultural, social and service center of the country It is a locality with a long history, so it has a better infrastructure system and occupancy rate compared to other provinces In recent years, it has strictly complied with regulations on land in general and industrial park land in particular, but still cannot avoid problems and limitations in the management and use of industrial park land Many industrial parks have not yet come into operation, causing waste of land, the rights of some investors have not been guaranteed, and the State's land management in industrial parks is ineffective The thesis chose Hanoi as the main research location for its thesis for the above reason

From there, the doctoral student chose the topic “Law on land use and management in

Industrial parks from practice of Hanoi city” as her doctoral thesis in law

2 Research purpose and tasks

Research purposes

To create a comprehensive, comprehensive research project at the level of a doctoral dissertation in law on the law regulating land relations in industrial parks and between industrial parks and competent state agencies, with other land users to provide theoretical and practical bases for perfecting this area of law

Research mission

- Identify and analyze the connotations of concepts: industrial parks, industrial park land, laws on management and use of industrial park land , supplementing legal science with more accurate scientific aspects of these concepts

- The thesis researches the experiences of some countries around the world such as (Korea, China, Japan ) in building and enforcing laws on management and use of industrial park land in order to propose experiences for Vietnam

- The thesis evaluates the current status of Vietnamese legal regulations on the management and use of industrial park land with a focus on clarifying limitations and inadequacies based on the criteria of uniformity and feasibility , consistency

- The thesis researches the practical implementation of laws on industrial park land and

is evaluated based on research on the management and use of land in industrial parks in Hanoi city However, the thesis references the experience of implementing laws on industrial park

land of some other localities such as Thai Nguyen, Bac Giang, Hung Yen to compare and draw lessons for the common solution group

- Analyze directions and propose solutions to improve the law on management and use

of industrial park land and improve enforcement efficiency in Hanoi city

3 Scope and objects of research

3.1 Research scope

Scope of location

The thesis researches theoretical issues and legal status on the management and use of industrial park land in Vietnam The case studies are industrial parks in some Northern provinces but with a focus on Hanoi city Within the framework of the thesis, PhD students only select a number of important issues to research, specifically: Planning, land allocation, leasing, subleasing, industrial park land recovery, handling violations for resolving land disputes in industrial parks and the state management system in industrial parks, rights and obligations of subjects managing and using land in industrial parks

4 Research Methodology

- This thesis adds a number of theoretical aspects to complete the system of some concepts about industrial parks, management and use of industrial park land, and the connotation of the law

on management and use of industrial park land

- The thesis provides a comprehensive assessment of the current legal status of industrial park land management and use and implementation practices in industrial parks with research cases selected based on criteria: represent The thesis has identified and analyzed the inadequacies and limitations of current laws in our country on the management and use of industrial park land based on a number of criteria such as suitability, feasibility, and evidence from practical implementation in industrial parks

- The thesis proposes perspectives and solutions to improve and improve the effectiveness of law enforcement on industrial park land management and use Viewpoints and solutions are drawn from qualitative, oriented research and according to a number of specific research situations, so they have high scientific value and reliability

The article “Some thoughts on people's ownership of land” by author Nguyen Quang

Tuyen in the Journal of State and Law, No 01/2016 decodes the connotation of the concept

2009) is a noteworthy work when implementing the Research on industrial parks

Scientific research project at National University level: “Legislation on environmental

protection of industrial parks in Vietnam” (2016) chaired by Associate Professor Dr Doan

According to the provisions of the Investment Law 2020 and Resolution Decree No 35/2022/ND-CP dated May 28, 2022 regulating the management of industrial parks and economic zones defines : Industrial park is an area with defined geographical boundaries, specializing in the production of industrial goods which provide services for industrial production Industrial parks include: regular industrial parks, export processing zones, supporting industrial parks, specialized industrial parks, ecological industrial parks, and high-tech industrial parks

Industrial park land is an area of land determined by industrial development planning

to build a complex of diverse infrastructure and services for the operations of businesses to promote regional economic development

With the above definition, industrial park land has some of the following basic characteristics: The basic criteria for identifying industrial park land is the land on which concentrated industrial parks are built ; Industrial park land includes large areas of land planned to build many factories and industrial enterprises of a concentrated nature ; Industrial park land does not belong to the assets of businesses investing in industrial parks and is used under a lease regime, not transferred between investors who build and do business in developing industrial park infrastructure and investors
