DEPOSITS

A) The Renter shall pay the Owner/Agent the following refundable security deposit $ _ _ _ _ _ _ When the Renter moves out the Owner may use the deposit solely for the purpose of:

i Repairing damages for which the Renter is responsible,

ii Cleaning beyond normal wear and tear,

iii Paying due and unpaid rent and/or utilities

B) The Owner shall pay the Renter interest on all security deposits (Annual rate, simple interest, paid annually)

C) The Owner and the Renter shall conduct a pre-move out inspection of the rental BEFORE the Renter moves out at which time the Owner shall inform the Renter of needed repairs in writing Within three weeks after the Renter moves out, the Owner shall return the deposit

to the Renter with accrued interest, if any, less any deductions the owner is entitled to under this agreement If any deductions are made, the owner shall provide the Renter with a

written itemized statement of expenses and receipts for cleaning or repairs for which

deductions were made from the deposit

FAILURE TO PAY RENT OR UTILITIES

If total amount due rent for the room and parking spot rental is not paid within five (5) days after due date, the Renter agrees to pay a charge of $_ _ _ _ _ _ (not more than one day's rent) for late rent payment and/or each dishonored bank check, unless waived by written agreement If the Renter is unable to pay make the paymentrent when due, the Owner has the right to serve notice to pay rent or vacate within three (3) days

If utilities are not paid within five (5) days after due date, the Renter agrees to pay a charge

Note that this bedroom is not the “master bedroom” which features an adjoining bathroom All parts of the home are shared space EXCEPT the top floor, the two bedrooms on the second floor, and the bathroom adjoining the master bedroom

CLEANING

All roommates agree to share the responsibilities of cleaning and maintenance of the Rental

as well as the shared space, which includes the kitchen, living room, 1st floor and 2nd floor bathrooms (but not the bathroom adjoining the master bedroom) This includes cCleaning may include the kitchen, dusting, vacuuming, emptying trash, mopping floors, and wiping down countertop and other surfaces, cleaning bathrooms, and yardwork

HOUSE RULES

A) Smoking & drug use is not allowed on the Rental, including the bedroom occupied by Renter

B) No pets are allowed on the Rental

C) Notice to Owner/ Agent is necessary for parties, gatherings, or celebrations

D) Notice to Owner/ Agent is necessary for guests

E) Quiet hours are from 11 pm – 8 am

DAMAGES

Renter, identified above, shall at all times maintain the Rental in a clean and sanitary

condition and in the same condition as they were at the start of rental, reasonable use and wear excepted For any maintenance or repair of the Rental, Renter shall notify the Owner If Renter fails to notify the Owner of maintenance or repairs, as agreed, the Owner shall have the option to make such repairs Renter agrees to pay for the cost of repairs and

maintenance from damages s/he causes and will owe the amount due by the time next

month’s rent is due Renter shall not paint or wallpaper any part of the Rental nor shall Renter make any interior or exterior alteration or change in the Rental nor shall Renter

change any lock or re-key any lock Renter shall not install any washing machine, dryer, air conditioner, space heater, waterbed, or fixture No object shall be thrown from any porch, balcony or window nor kept on any windowsill Renter shall be liable for any misuse of any plumbing fixture or equipment, including disposal or garbage that damages any fixture or clogs any pipe At the termination of the Roommate Agreement, Renter shall surrender the Rental with all keys to the Homeowners in the same condition as they now are, reasonable use and wear excepted Should Renter fail to turn over all keys at the end of the rental period, the Homeowners shall be permitted to replace the locks and keys immediately at Renter’s sole cost and expense Renter shall be responsible for all damage or loss caused to the Rental during the tenancy, whether by Renter or by any invitee or guest of Renter,

excluding acts of God or any injury or loss caused by the Homeowners or for which the

Homeowners are statutorily liable

VACATE NOTICES

Both Renter and Owner/Agent shall give thirty (30) days written notice in the event that the rental is to be vacated

TERMINATION OF TENANCY

Tenancy may be terminated by any of the following:

A) Owner’s or renter’s discretion

B) Failing to make rent payment

C) Failing to pay for household expenses

D) Failing to make parking space payment

E) Failure to make bill payment

F) Violating an obligation under this agreement
