Becoming a legal professional in the most countries require a structured

curriculum that is made up of high standards and academically rigorous classes People can start their path to a career in law as soon as they complete their legal training course This assignment is to analyze two of the most sophisticated legal education systems in the world under a comparative perspective, which are le gal education in Germany and legal education in the US To serve the aforementioned purpose I would choose the first topic: “Legal education in Germany an the US: A comparative perspective”

MAIN CONTENT

1 About the training program

Law training programs in the US and Germany as well as many countries

around the world focus on focusing on legal thinking skills for students and in each country there is a separate training method depending on the actual conditions and circumstances Since law is a difficult discipline, it requires a training program with its own methods In Germany and the US apply the general law training program to both the legal professions of lawyers, judges, prosecutors, differing only in the final stages of the training program

The training process in both countries is simultaneously combining

practice in these two countries still varies

4 About the standard to learn law

The standard for studying law is also highly required in both countries Those

who can study law must be those who already have a professional degree

Since they belong to two different legal families, law training in Germany and the United States has many differences:

1 Law school standards

In the U.S., students need a bachelor's degree in any science subject to be able

to apply to law school But law schools in the U.S recruit students very rigorously, with some law faculties selecting only one out of five or ten applicants

In Germany, in order to become a bachelor of law, students must be trained in law theory, trained in practicing law practice and undergo two tough exams Universities often take in a large number of first-year law students to prevent the gradual dropout of students due to the difficulty of studying law

2 Training process

In the U.S., when students who have obtained a bachelor's degree in a science subject are admitted to the law school, they will study for three years to obtain a J.D (jurist doctor) degree – a basic law degree in the US The average age for law

school graduates is 29, the age for people to perfect their personalities and stand firm in words and actions

Major law faculties in the U.S also offer post-graduate training but are primarily for foreign students rather than for Americans to grant master's degrees (LL.M) and doctoral degrees (SJDs)

In Germany, the entire training period is divided into two phases:

The first stage: legal training is at least three and a half years at the university

To complete this stage, the sing staff must pass a graduation exam with quite long and complex questions

The second stage: practical training in law practice lasts at least two years, training in practical legal knowledge This stage is also concluded with an exam If they do not pass this exam, law students will not receive a bachelor's degree, i.e they cannot enter the career path such as lawyers, judges, prosecutors,

3 Law subjects

In the U.S., specialized law subjects are taught without teaching general subjects such as philosophy, state theory, and law, as in Germany because the students in the US are those who have obtained a degree before.In Germany in addition to the general subjects, they also teach compulsory subjects related to the fields of law such as tax law, competition law, civil law, there are also elective subjects such as tax law, European community law, competition law, intellectual property law

4 Teaching methods

In the U.S., the method of teaching law is used quite appropriately for a diverse, complex and ever-changing society For more than a century, law

different from Germany but also different from the method of many countries in the world

With the situational method, the book used for each subject is not the basic syllabus of specialized law but the situation book containing selected cases Books are usually written about each subject separately on the basis of analyzing the selected case rules included in the book General legal principles are not presented through abstract theoretical lectures but rather will be drawn from the study of situations discussed in class In class, the faculty does not lecture about situations but asks students to report the situation, then will question the student to train their ability to react to the situation given – the "Socratic" method

In addition, there is another method being tested in law departments in the US

is to use an internship program whereby students are put into real work and they learn law by handling real-life situations Often these programs are implemented and comprehensively supervised by the clinical faculty

In Germany, the curriculum is mainly taught in the traditional method, theoretical teaching is the main There are now two different views: reformist views and conservative ones The reformist group argues that it is necessary to reduce academia and to include practical cases in the teaching of law subjects Conservative opinion groups argue that Germany's legal training regime has traditionally been very effective However, recent survey results show that many law faculties on the territory of Germany have focused on balancing the theoretical and practical content of law in the structure of subjects

5 Training criteria

In the U.S., students are trained to be able to practice, providing students with the skills to practice, how to practice and understand Law does not teach

CONCLUSION

There are differences in lawmaking in Germany and the U.S., but Germany and the U.S are both countries with advanced legal systems and training, teaching associated with practice increasingly proves its effectiveness when in Germany and the US there are constantly appearing prestigious bar associations, Good lawyers From this comparison we can have several applications for law training in Vietnam
