State of Maryland and Salisbury University Policies and Procedures for Drivers of Salisbury University/State Vehicles Revised: January 7, 2019... All accidents and damage to State Vehic

Scope

Salisbury University's policies and procedures govern all state-owned, leased, or rented motor and utility vehicles used for official university business, and are adopted pursuant to State Finance and Procurement Article §3-503 of the Annotated Code of Maryland.

Exceptions

Any exception to the Policies and Procedures for Drivers of State Vehicles must be approved in writing by the Director of Physical Plant and/or the Vice President of Administrative and Finance, or their designee.

1.3 FAILURE TO COMPLY WITH THE POLICIES AND PROCEDURES

Failure to comply with these policies and procedures may subject a University employee, volunteer, student, or any person authorized to operate a State vehicle to disciplinary action and/or possible legal action Salisbury University may revoke driving privileges for University Vehicles (owned, leased, or rented for University-related business) at any time at its discretion due to safety concerns or other valid reasons, including changes in the law or regulations, fleet management and availability issues, the driver’s accident or violation history, falsification of records, or any failure to comply with applicable regulations, directions from a supervisor, or the law.

2 DRIVER ELIGIBILITY AND USAGE OF STATE VEHICLES

Only authorized drivers may operate a State Vehicle Driving privileges are contingent upon full compliance with the State and Salisbury University Policies and Procedures for Drivers of State Vehicles.

Before operating a State Vehicle, every driver must sign the Acknowledgement Statement of the Policies and Procedures for Drivers of State Vehicles (Appendix 1) A signed copy of the Acknowledgement Statement shall be retained by the Motor Pool Office Drivers who do not sign the Acknowledgement Statement are not authorized to drive State vehicles.

Students may drive State vehicles if they are employed by the University, are at least 18 years old, and their job duties require driving, while meeting all other eligible-driver criteria Students who are not employed by the University may also use State vehicles for University purposes, but only after following the required procedure: the Department must submit a written request to the Motor Pool via email or memo and include the necessary information.

2 Name of the driver and their current valid driver’s license #

3 Duration and description of condition for vehicle use (i.e – describe the specific task they will be doing for the University)

4 Sign a Volunteer Agreement form, from Human Resources

5 Passed the driving record check and must have met any and all other criteria for eligible drivers

6 Motor Pool will validate and submit the request to the Director of Physical Plant for approval

7 Motor Pool will notify the Department of the decision

Volunteers Volunteers, if authorized, may drive State vehicles The following procedure must be followed by the Department when requesting vehicles for volunteers who are not employed by Salisbury University:

1 Volunteer must complete a Volunteer Agreement form, from Human Resources

2 The Volunteer Agreement must be approved and signed by the appropriate Vice President

To obtain a University vehicle, the requesting Department must submit a written request to Motor Pool (via email or memo) and include: the department name and account code; the driver names and their current valid driver’s license numbers; a description of the duration and specific task the vehicle will be used for; confirmation that the volunteer passes the driving record check and meets all other eligible-driver criteria; the volunteer’s signed Acknowledgement Statement for the State of Maryland and Salisbury University Policies and Procedures for drivers of Salisbury University/State vehicles; Motor Pool will validate the submission and forward it to the Director of Physical Plant for approval; and Motor Pool will notify the Department of the decision.

To be eligible to drive a State Vehicle, a driver must be at least 18 years old, hold a valid driver’s license issued by the State of Maryland or by another state appropriate for the vehicle class, and have five or fewer points on their current driving record.

Eligibility shall be immediately suspended for a driver who is charged with any motor vehicle violation for which a penalty of incarceration is possible while driving a State vehicle Motor vehicle citations for these violations will indicate that the violation is a “Must Appear” violation and that the driver must appear when notified by the Court Eligibility shall remain suspended until the Accident Review Board has reviewed the occurrence, and a decision regarding further action is made.

Pool vehicle drivers whose driving privileges have been suspended due to point accumulation, those charged with any offense for which incarceration is possible while driving a State vehicle, or those who receive a determination by the Accident Review Board or the Vice President of Administration and Finance shall be reimbursed for the use of a private vehicle at no more than one-half of the effective State reimbursement rate.

Drivers must promptly notify their supervisor and the Fleet Manager of any change in eligibility status or when their points reach six (6) or more Failure to report these changes may result in disciplinary action.

Driver eligibility may be suspended for a range of additional considerations, such as an accumulation of accidents, the severity of any incident, a decision by the Motor Pool, or a recommendation from the Accident Review Board.

Motor Pool will review the driving record of each authorized driver when the driver signs the Acknowledgement Statement and whenever information is received about points accumulated in the MVA’s License Monitoring System (LMS) or the Direct Access Records System (DARS), or any other data that could affect the driver's eligibility.

Drivers with out-of-state driver's licenses must provide a certified copy of their driver record to the Motor Pool when signing the Acknowledgement Statement, and must do so annually thereafter They must notify the Motor Pool and their supervisor within three days after more than five points are assessed on their driver record.

A disqualified driver may reapply for driver eligibility when their license is reinstated and/or their driving points are five (5) points or less and their driving record can be verified

2.3 PERMISSIBLE USE OF STATE VEHICLES

State Vehicles are to be used for official Salisbury University business within a 500-mile radius, and Motor Pool reserves the right to deny Fleet vehicle requests if the event is not approved or the usage is unsafe; in such cases, personnel should use personal or rental vehicles and request reimbursement from the Department Whenever possible, trips should be planned to align with other authorized driver travel to maximize efficiency and cost-effectiveness With the exception of State Officials who receive Executive Protection from the Maryland State Police and are provided driver services, State Vehicles—including Salisbury University vehicles—shall not be used for personal reasons, such as transporting friends or family State Vehicles are not to be used to attend celebratory events, and mileage using personal vehicles may be reimbursed if approved by the Department State Vehicles must not be left at airports, train stations, or bus stations while the driver and occupants travel to other destinations overnight Smoking is prohibited in State Vehicles Passengers in State Vehicles are limited to individuals being transported in connection with State business, and family members are not permitted due to insurance restrictions No pets or service animals are permitted in State Vehicles due to allergy concerns Individuals needing a vehicle for University purposes may rent a vehicle or use their own vehicle and submit an expense account to their budget administrator for approval Vehicles must not be driven off-road or on grass or landscaped areas; off-road use requires renting or using a personal vehicle, and parking is allowed only in designated or authorized areas on campus, according to the map in Appendix.

On campus, drivers must not park in loading and unloading zones, in HCP spots, in front of dumpsters, or on lawns or landscaped areas Utility vehicles are not permitted in the pergola or Secret Garden Parking in other areas is allowed only when the vehicle is necessary for the work being performed, such as outside event setups, light pole replacement, or trash and recycling pickup Vehicles must never block building entrances or sidewalks or park in designated fire zones, including blocking fire hydrants.

DRIVER ELIGIBILITY AND USAGE OF STATE VEHICLES

Driver Eligibility 6-7

To be eligible to drive a State Vehicle, a driver must be at least 18 years old, hold a valid driver’s license issued by Maryland or any state appropriate for the class of vehicle driven, and have five or fewer points on their current driving record.

Eligibility is immediately suspended for any driver charged with a motor vehicle violation that carries a possible incarceration penalty while operating a State vehicle Citations for such violations will be issued as “Must Appear” and require the driver to appear as notified by the Court The suspension remains in effect until the Accident Review Board has reviewed the incident and determines the appropriate further action.

Pool vehicle drivers whose driving privileges have been suspended due to point accumulation, or who are charged with any offense for which a penalty of incarceration is possible while driving a State vehicle, or who are determined by the Accident Review Board or by the Vice President of Administration and Finance, shall be reimbursed for the use of a private vehicle This reimbursement shall be limited to not more than one-half of the effective State reimbursement rate.

Drivers must immediately inform their supervisor and the Fleet Manager of any change in their eligibility status or when their points reach six (6) or more This timely notification helps ensure compliance and operational integrity, and failure to report may result in disciplinary action.

Driver eligibility may be suspended for additional reasons beyond standard criteria, including an accumulation of accidents, the severity of any single accident, a decision by the Motor Pool, or a recommendation from the Accident Review Board.

Driver Record Review

Motor Pool will review the driving record of each authorized driver when the driver signs the Acknowledgement Statement and whenever information is received regarding points accumulated in the MVA’s License Monitoring System (LMS) or Direct Access Records System (DARS), or any other information that could affect the driver's eligibility.

Drivers with out-of-state driver's licenses must provide a certified copy of their driving record to Motor Pool when they sign the Acknowledgement Statement, and annually thereafter If they accumulate more than five points on their driving record, they must notify Motor Pool and their supervisor within three days of the points being assessed.

Permissible Use of State Vehicles 8-9

State Vehicles are to be used for Salisbury University official business within a 500-mile radius, and the Motor Pool reserves the right to deny Fleet vehicle requests if the event is not approved or the usage is deemed unsafe; in such cases, personal or rental vehicles should be used and an expense reimbursement request submitted to the department Trips should be planned to coincide with other authorized driver travel requirements to maximize efficiency and economy Except for State Officials who receive Executive Protection from and are provided driver services by the Maryland State Police, State Vehicles including Salisbury University vehicles shall not be used for personal reasons (e.g., transporting friends or family) and must not be used to attend celebratory events such as balls or parties; if such events are approved, personal vehicles should be utilized and mileage reimbursed by the department State Vehicles must not be left at airports, train stations, or bus stations while the driver and occupants travel to other destinations overnight There shall be no smoking in State vehicles Passengers in State automobiles are limited to persons being transported in connection with State business; family members are not permitted due to insurance restrictions/coverages Due to individuals with pet allergies, no pets or service animals are permitted in State vehicles Individuals needing a vehicle for University purposes may rent a vehicle or use their own vehicle with approval from their budget administrator and submit an expense account Vehicles are not permitted to be driven off road; departments must rent or use personal vehicles for these purposes, and vehicles are not to be driven on grass or landscaped areas Vehicles are to park only in designated or authorized areas or spaces on Salisbury University campus, following the map in Appendix.

2 When working on and around the Campus, drivers shall not park in loading and unloading zones, HCP spots, in front of dumpster, on lawns or landscaped areas, etc i Vehicles, to include utility vehicles, are not permitted in the pergola or Secret Garden j Vehicles are only permitted to park in other areas on Campus when performing work that requires the vehicle to be there i.e - outside event set-ups, light pole replacement, trash/recycling empting, etc Vehicles are never to block building entrances or sidewalks or in designated fire zones (ie- blocking fire hydrants).

Vehicle Mileage Log

Each State Vehicle or light-duty vehicle (LTV) must maintain a monthly Vehicle Mileage Log All drivers are required to complete the log, documenting all destinations with official and commute mileage; the University retains these logs for audit purposes, and Appendix 3 provides a Vehicle Mileage Log template Vehicle mileage logs are not required for campus vehicles that use the campus fuel system, where mileage is recorded at each fill-up.

Safety 9-10

All drivers operating State Vehicles must comply with the Motor Vehicle Laws of the jurisdiction in which the vehicle is driven and conduct themselves with safety and courtesy toward the public, while also adhering to Salisbury University’s Traffic Rules and Regulations Authorized drivers shall operate State Vehicles in accordance with any license requirements or restrictions, such as corrective lenses or daytime-only operation, and must take every precaution to ensure the safety of passengers.

All occupants in a State vehicle must be properly restrained with a seat belt, and applicable children must be secured in an appropriate child safety seat; the driver is responsible for ensuring everyone is properly restrained Drivers must obey all traffic and parking laws, observe posted speed limits, and avoid driving at speeds unsafe for road conditions, with all traffic violations and fines (including late fees or penalties) charged to the driver and potentially subject to disciplinary action if not paid promptly State employees operating vehicles must comply with laws governing mobile communications devices, using a hands-free device whenever possible, and minimizing use while driving; use of a hand-held device is only permitted in emergencies, and this policy does not apply to law enforcement officers operating law enforcement or authorized emergency vehicles The driver of a State Vehicle must take all reasonable precautions to protect the vehicle and its contents, including locking the vehicle and taking the keys, except where a commercial parking garage requires leaving the keys with the vehicle Authorized drivers are personally responsible for the vehicles they operate.

If a state vehicle is damaged due to misuse or gross negligence, the operator may be required to make restitution to the State If the damage is beyond repair as a result of misuse or gross negligence, the operator may owe restitution of the difference between the salvage value and the then-current wholesale value of the vehicle, as reported in the National Auto Research Black Book Used Car Market Guide, MD Edition Drivers of state vehicles are prohibited from driving while under the influence of controlled substances, including alcohol, drugs, or medications that could adversely affect driving performance The use of alcoholic beverages and the transport or possession of illegal or banned substances is strictly prohibited in any vehicle owned, rented, leased, chartered, or used by Salisbury University.

Moving Violation Reporting

An authorized driver of a State vehicle who is charged with a moving violation or a must-appear violation must notify the Motor Pool Office immediately, and in no case later than the following business day The Motor Pool will notify the DBM in writing within two business days of receiving notice of the charge Failure to timely report the receipt of a moving violation or a must-appear violation may result in sanctions, including, but not limited to, disciplinary action, revocation of driving privileges, and other appropriate actions.

Vehicle Breakdown and Reporting

Policy Name: Motor Vehicle Operator Policy for Salisbury University/State Vehicles

These guidelines for the operation and maintenance of motor vehicles have been adopted to advance Salisbury University's commitment to a safe environment for students, employees, volunteers, visitors, and the public The policy is designed to safeguard people, protect equipment, reduce operating costs, and decrease the frequency and severity of accidents involving Salisbury University/State Vehicles (hereinafter 'State Vehicles').

University vehicles, whether on or off campus, are a privilege granted by Salisbury University; the university maintains a limited fleet and reserves the absolute right to determine the priority of vehicle use, and to deny or revoke driving privileges for any reason, including when the use of a State Vehicle could pose a risk to the university or the public The procedures governing this policy are part of the policy and may be amended at any time.

This Policy applies to every University employee, volunteer, student, or any person to whom the University grants the privilege of operating a State Vehicle

DRIVER ASSIGNMENT, COMMUTE, AND TAX LIABILITY

Assignment Criteria

State vehicles are assigned to authorized drivers solely for official use, ensuring the most efficient and economical use of the fleet In allocating State Vehicles, University fleet staff evaluate several factors, including the driver’s anticipated official mileage, the specific field assignment, and the need for specialized vehicle equipment required to perform the job.

Driver Commute Charge

Drivers assigned a State vehicle are typically subject to a commute charge, which is calculated based on their normal home-to-office commute at a per-mile rate set by the DBM This charge is collected via payroll deduction and will be amended by the University if the driver moves, is reassigned to a new office, or is assigned a higher-cost vehicle.

The assigned driver shall complete a State Auto Commute Charge Form MFOMS-17 prior to accepting assignment of a State vehicle This form will be provided by the Motor Pool office.

Commute Records

All commute miles must be recorded in the Vehicle Mileage Log If an authorized driver starts from home in a state vehicle and travels to the assigned office during the day, the normal one-way commute mileage shall be recorded as commute miles in the Vehicle Mileage Log; if the driver returns home the same day, the normal two-way commute shall also be entered in the Vehicle Mileage Log However, if the authorized driver leaves home to conduct business without stopping at the assigned office, mileage up to the driver’s normal round trip commute shall be recorded as commute miles, and only the miles in excess of the normal commute shall be recorded as official miles on the Vehicle Mileage Log.

Authorized drivers whose duties are primarily field assignments, who report to the designated office on average once a week or less, and who have a DBM-approved commute exemption (see Section 3.4) are not required to record commute miles Commute miles are defined as the mileage from the driver's home to the first work location of the day and from the last work location of the day back to the driver's home.

Commute Exemptions

In a limited number of situations, upon request and approval by the Vice President of Administration and Finance, an assigned driver may be exempted by DBM from paying the commute charge These exemptions are limited to situations in which (1) the assigned driver does not commute in the vehicle, (2) the vehicle is assigned to field personnel who report to the assigned office one day or less per week, (3) the assigned driver is a law enforcement officer, or (4) the assigned driver responds to emergency situations and requires highly specialized equipment to perform the driver’s job The decision to grant an exemption rests with DBM or the Vice President of Administration Questions concerning eligibility for an exemption should be directed to the Motor Pool fleet manager

Assigned drivers eligible for an exemption must complete the Certification of Exemption, State Motor Vehicle Commute Charge MFOMS-18, obtain their supervisor’s signature, and submit the form to the Agency fleet manager for review and processing; the Motor Pool fleet manager provides this form.

Tax Liability

All employees who commute in a state-owned or leased vehicle must report the vehicle’s use as a fringe benefit for income tax purposes This reporting duty applies to authorized drivers who pay the state commute charge as well as to those whom the state exempts from paying the commute charge An exception applies to employees who commute on an occasional or infrequent basis.

Each individual is personally responsible to the IRS for submitting accurate information to his employer, and the taxable fringe benefit will be calculated based on IRS guidelines and reported on an Auto Fringe Value Calculation/Reporting Form, with a sample available in Appendix 7 For certain reporting categories, these benefits include all capital costs and expenses incidental to the operation of the motor vehicle, including salaries, fringe benefits, and other chauffeur expenses, less the amount paid to the State for use of the vehicle The Agency will notify authorized drivers annually of the reporting requirements and provide the necessary forms and instructions.

VEHICLE MODIFICATION

Modifications to State vehicles for personal reasons are prohibited If necessary for official State business, the Agency may approve the modification of a State vehicle Bumper stickers are prohibited.

FUEL

State Pool vehicles shall be fueled exclusively from the Statewide Automated Fuel Dispensing and Management System, except in emergencies or rare, unusual instances when this is not possible When available, alternative fuel shall be used in bi-fuel and flexible-fuel vehicles Salisbury University vehicles assigned to departments shall be fueled from Salisbury University’s Fuel Dispensing and Management System, located behind Maggs Gym Refer to Appendix 8 for the procedure.

MAINTENANCE AND REPAIR

Driver’s Responsibility

Authorized drivers of pool vehicles are responsible for reporting observed mechanical problems to the Agency fleet manager or their designee

Authorized drivers of pool vehicles must return the vehicle in the same condition it was picked up, with a reasonably clean interior, trash removed, and at least a full tank of gas.

Authorized drivers assigned a vehicle share responsibility with the Motor Pool fleet manager to ensure the vehicle is properly maintained They should discuss the University’s maintenance requirements and procedures, as well as their specific maintenance responsibilities, with the Motor Pool fleet manager or their designee to ensure compliance and safety.

Fleet Maintenance and Repair Services Agreement

Pool vehicle drivers away from campus must use the existing contract for emergency repair services and follow the instructions in the vehicle binder provided by the Motor Pool office The binder includes a 24-hour emergency phone number for immediate assistance The emergency repair card may be used only for expenses related to that State vehicle.

Campus service vehicles must report any mechanical problems to the Motor Pool office The Motor Pool will assess the issue and determine whether the repair or service will be completed by in-house staff or contracted out Departments must bring their vehicles in for service whenever requested by the Motor Pool office.

REIMBURSEMENT FOR PARKING AND TOLLS

State employees shall be reimbursed for legitimate and documented parking and toll expenses incurred while conducting State business.

VEHICLE INSPECTIONS

The privilege of using a State vehicle requires all drivers to conduct a vehicle inspection each day

For the fleet vehicles, any damage to the vehicle should be noted on the vehicle log inside of the binder

For service vehicles or vehicles assigned to a department:

Each department must conduct regular inspections of all state vehicles to prevent misuse and maintain a professional appearance Departments that fail to perform these inspections or to keep vehicles in proper condition will have the affected vehicles removed from the department's fleet and reassigned to another department.

2 The primary driver will inspect the vehicle exterior each day for damage Any damage or problems with the vehicle should be noted on the vehicle inspection form (Appendixes 9 - 11)

Within fleet management, the primary driver is responsible for submitting a vehicle inspection form for each vehicle to their supervisor on a weekly basis The supervisor verifies the inspections and retains the records for future reference, ensuring compliance and easy access for audits and ongoing fleet safety monitoring.

When any vehicle problem or body damage is detected, the supervisor must submit a work order to Motor Pool to arrange the necessary repairs If there is physical damage to the vehicle, the driver must also submit the Motor Vehicle Accident Investigation Guide (Form FS-1) and the Accident Review by Supervisor form together with the submitted work order.

A written estimate for repairing vehicle damage, whether the work is performed by Motor Pool or by an outside body shop, will be submitted to the Department Head for payment authorization prior to beginning repairs.

FLEET VEHICLE PICK-UP AND RETURN

Reserving Pool vehicles All reservation of Pool vehicles will be completed by using the Motor Pool on-line vehicle reservation system

From Monday through Friday, 7:00 a.m to 5:00 p.m., pick up keys from the Motor Pool Office in the Maintenance Building, then collect the vehicle from the Avery Street Parking Lot and leave your personal car parked in the lot After use, return the vehicle to its designated spot in the Avery Street Parking Lot and return the keys to the Motor Pool Office in the Maintenance Building.

At all other times, pick up the keys from the University Police Dispatch in the East Campus Complex, then pick up the vehicle from the Avery Street Parking Lot (leave your personal vehicle parked in the lot) After use, return the vehicle to its designated spot in the Avery Street Parking Lot and return the keys to the University Police Dispatch Office in the East Campus Complex.

2 If necessary, notify appropriate emergency medical and/or fire rescue personnel

FUELING PROCEDURE OF STATE VEHICLES FOR THE FUEL

Located between Seagull Square and the Maggs Complex, Salisbury University's fueling station operates 24/7 for University employees to fuel state vehicles and state equipment Access requires a fuel key issued by Motor Pool to authorize fueling of state vehicles and equipment.

Before fueling a state vehicle or equipment for the first time, employees must contact the fleet coordinator and report their SU ID number to obtain fueling access.

When fueling state vehicles or equipment, employees should be familiar with the safety equipment available in case of an accidental spill The emergency shut-off valve across the roadway in front of the fuel pumps should be activated for a large spill Emergency spill kit items are stored in the chest on the south side of the storage building and should be used to prevent fuel from entering the storm drain located in the center of the lot For a fire, a fire extinguisher is located on the north side of the storage building facing the pumps If a large spill occurs during normal business hours Monday through Friday, please contact the Motor Pool office at (410)543-6211; should a large spill occur after normal business hours or on weekends or holidays, please contact University Police at (410)543-6222.

Procedures for fueling are as follows:

1 Step up to tower located between unleaded and diesel pumps, follow instructions indicated

2 Insert fuel key, press enter

3 Using touch pad, enter SU id number and press enter

4 Enter odometer reading of vehicle and press enter

5 Reinsert fuel key as indicated by the instructions

6 Select type of product needed – “1” for unleaded or “2” for diesel, press enter

7 Instructions will indicate that fueling may begin – allow a few seconds for pump to reset to

“0” gallons pumped This may take slightly longer colder temperatures
