1 PURPOSE: Pelham High School ("Facility User") will have use of the Pool in the Campbell Sports Center for Swim Practice on

3 CANCELLATIONS: In the event that Facility User cancels any or all of the reserved dates above, the
full payment is still required Sarah Lawrence College will make a reasonable effort to reschedule cancelled sess10ns
Sarah Lawrence College reserves the right to cancel any session should College demands require the use of the facility, or in the event of a facility shutdown due to maintenance reasons In the event that Sarah Lawrence College cancels a session, reasonable efforts will be made to reschedule the session or, if the session cannot be rescheduled, a credit will be issued Notwithstanding the foregoing, in the event that Sarah Lawrence College cancels a session due to weather, natural disaster, or other conditions beyond their reasonable control, no credit will be issued and reasonable efforts will be made to reschedule the session
Trang 24 PARTICIPANTS AND SPECTATORS: The coach or team manager authorized by the Facility User must be present at all session and must supervise team members at all times while they are in the facility Spectators are not allowed in the facility other than to facilitate pick up or drop off of participants
This contract covers a total of 40 participants In the event that the actual number of participants exceeds 40
participants, the College reserves the right to re-negotiate this contract
Facility rules of the Campbell Sports Center must be adhered to at all times Failure to so will result in termination of this contract
A certified lifeguard must be provided by Facility User and must be on the pool deck throughout each
practice session A copy of this person ' s certifications must be submitted to the Sarah Lawrence College Department of Physical Education & Athletics prior to the first session Sarah Lawrence College will
provide one lifeguard at all practices and meets
The locker room will be made available prior to and following each session A coach/monitor must
room
No locks or towels will be provided by Sarah Lawrence College Lockers may be used during contracted time but no belongings may be left overnight The College shall not be held liable for the loss of or damage
to any personal belongings
to Facility User Assessment of damage and repair cost shall be at Sarah Lawrence's reasonable and sole discretion
Cleaning will be provided by SLC, the cost will be billed at a rate of $200 per day
permits are not required; parking is on a first come, first served basis
Sarah Lawrence College maintains the right to reserve areas of the parking lot for other programs going on throughout the campus Additional parking lots will be made available if space is limited

employees, agree to indemnify, defend, and hold Sarah Lawrence College, its officers, employees, students and agents harmless from any and all costs, losses, expenses, damages, claims, suits, or any liability whatsoever, including attorney's fees, resulting from injury, including death, to person or damage to property arising out of, or in any manner connected with, their actual or proposed use of Sarah Lawrence College property or use of the pool
joint venture between the parties, nor shall either party have any right or authority express or implied, to create any obligation on behalf of or in the name of the other party or to bind the other party contractually in
Trang 3any manner whatsoever Under no circumstances as a result of this Agreement shall any faculty member, employee or student of either party be considered an employee, agent or servant of the other party
11 NOTICE: All notices to be given to or received by the parties hereto shall be in writing and shall be
delivered by (messenger or mailed by prepaid registered or certified first class mail) to any such party at its address which:

Any party may by notice change its address for the purposes hereof Any such notice shall be deemed to have been given, if delivered by messenger, email, or fax, on the date of its actual receipt, or, if delivered by mail, upon the date that it shall have been properly deposited in the mail
12 AMENDMENTS: This agreement cannot be amended or renewed except by a written instrument
duly signed by both parties
13 ASSIGN ABILITY: This agreement may not be assigned or otherwise transferred by either party hereto
without the prior written consent of the other party, and any purported assignment or transfer for which such consent has not been obtained shall be null and void
