EXTEND A CONTRACT TO PROVIDE THE FURNISHING, INSTALLATION AND MAINTENANCE OF AN ELECTRIC VEHICLE CHARGING STATION IN THE
BOROUGH OF STONE HARBOR WHEREAS, the Borough Council has determined that it is in the best interest of the
citizens of Stone Harbor that the Borough provide electrical vehicle charging services to the public; and
WHEREAS, U-GO Stations, Inc is a Contractor with experience that is capable of the
installation and maintenance of an electric vehicle charging station for the Borough of Stone Harbor and entered into a contract with them on March 23, 2016; and
WHEREAS, U-GO Stations, Inc .has proposed an extension agreement, copy attached; and

has prepared a Professional Services Contract (copy attached) to provide Stone Harbor AA2021 For Rent & HR Program , Administrative Agent Services to the Borough in accordance with the provisions of the Fair Housing Act and Uniform Housing Affordability Control Regulations ; and
WHEREAS, tasks include but are not limited to Administrative Agent Services for
Rental Units, Housing Rehabilitation Implementation for Owner-Occupied and Rental Units, and
WHEREAS, the complete Professional Services Agreement was presented to
Council on May 18, 2021 and was approved, all of which are key components to the process, and all of which are attached hereto; and

WHEREAS, Richard Graver, Network Engineer of 118 Reading Avenue Tuckahoe, N.J
08250 supplies a service that is specialized and qualitative in nature requiring expertise, extensive

Unspecifiable Service not subject to public bidding; and
WHEREAS, the Borough Council is satisfied to engage Mr Graver for the purposes

authorize Change Order No 2 – Paint/Touch-Up Black Lettering on Tank; and
WHEREAS, Change Order No 2 will result in an increase of $ 3,600.00 to the
amended contract amount of $313,340.00 for a revised contract amount of $ $316,940.00

HARBOR, CAPE MAY COUNTY, NEW JERSEY, ENDORSING ITS
AMENDED HOUSING ELEMENT AND FAIR SHARE PLAN
Trang 6WHEREAS, on May 10, 2021, the Planning Board of the Borough of Stone Harbor,
County of Cape May, State of New Jersey, adopted an amended Housing Element and Fair Share
Plan; and
WHEREAS, the amended Housing Plan Element and Fair Share Plan addresses the
Borough’s Mount Laurel obligations as delineated in the court-approved Settlement Agreement between the Borough and Fair Share Housing Center (“FSHC”), executed on or around December
6, 2017, as amended by FSHC and the Borough on March 2, 2021; and
WHEREAS, the Borough of Stone Harbor remains committed to comply with its
constitutional Mount Laurel obligations by voluntarily providing its “fair share” of affordable housing
NOW THEREFORE BE IT RESOLVED that the Council of the Borough of Stone
Harbor, County of Cape May, State of New Jersey, hereby endorses the amended Housing Element and Fair Share Plan as adopted by the Stone Harbor Borough Planning Board on May 10, 2021; and
BE IT FURTHER RESOLVED that the Council of the Borough of Stone Harbor,
pursuant to the provisions of N.J.S.A 52:27D-301 et seq hereby authorizes its professionals to immediately file the adopted and endorsed amended Housing Element and Fair Share Plan and all other relevant documents with the Court; and
BE IT FURTHER RESOLVED that the Council of the Borough of Stone Harbor hereby
authorizes its professionals to take any and all actions reasonable and necessary to secure approval
of the City’s amended Housing Element and Fair Share Plan and to maintain the Borough’s immunity from any Mount Laurel lawsuits; and
BE IT FURTHER RESOLVED that, upon seeking approval of its amended Housing
Element and Fair Share Plan, all known interested parties shall receive notice of the Borough’s intent; and
BE IT FURTHER RESOLVED that that notice of the Borough’s application for approval
of its amended Housing Element and Fair Share Plan shall be published in a newspaper of regional circulation and the Borough shall otherwise provide all the notice Court deems appropriate as it determines whether the amended Housing Element and Fair Share Plan satisfies the Borough’s affordable housing responsibilities under applicable laws Said notice shall give the public sufficient time to review the Borough’s amended Housing Element and Fair Share Plan and offer any comments that the individual or entity may deem appropriate

A COUNCIL RESOLUTION APPROVING THE AFFIRMATIVE
MARKETING PLAN OF THE BOROUGH OF STONE HARBOR’S 2021
AMENDED HOUSING ELEMENT AND FAIR SHARE PLAN
WHEREAS, on December 6, 2017, the Borough of Stone Harbor (“Borough”) entered into
a Settlement Agreement with Fair Share Housing Center (“FSHC”) that established the Borough’s fair share obligation and preliminarily approved the Borough’s compliance mechanisms in accordance with the March 10, 2015 decision of the Supreme Court which transferred responsibility to review and approve housing elements and fair share plans from the Council on Affordable Housing (COAH) to designated Mount Laurel trial judges within the Superior Court; and
WHEREAS, on January 23, 2018, Honorable Nelson C Johnson, J.S.C (ret.), entered an
Order approving the FSHC Settlement Agreement finding it to be fair and reasonable to the region’s low- and moderate-income households; and
WHEREAS, on August 31, 2018, Honorable Nelson C Johnson, J.S.C (ret.), entered an
Order setting forth the process by which the Borough could secure its Final Round 3 Judgment of Compliance and Repose; and
WHEREAS, on March 2, 2021, the Borough Council authorized the Mayor of Stone
Harbor to execute an Amendment to its Settlement Agreement with FSHC;
WHEREAS, the Borough’s Planning Board adopted its amended Round 3 Housing
Element and Fair Share Plan consistent with the Court-approved Settlement Agreement, as amended, on May 10, 2021; and
WHEREAS, the Borough Council endorsed the amended Plan on May 18, 2021 at a
properly-noticed public meeting; and
WHEREAS, the adopted and endorsed amended Plan includes an Affirmative Marketing
Plan component, as required by the Council on Affordable Housing’s (“COAH”) rules at N.J.A.C 5:93-11, which is designed to attract renters of all majority and minority groups, regardless of race, creed, color,

RESOLUTION OF THE COUNCIL OF THE BOROUGH OF STONE HARBOR APPROPRIATING FUNDS OR BOND IN THE EVENT OF A SHORTFALL IN FUNDING
FOR THE BOROUGH’S AFFORDABLE HOUSING PROGRAMS WHEREAS, pursuant to In re N.J.A.C 5:96 and 5:97, 221 N.J 1 (2015) (Mount Laurel
IV), on June 30, 2015, the Borough of Stone Harbor (hereinafter “Stone Harbor” or the “Borough”) filed a Declaratory Judgment Complaint in Superior Court, Law Division, seeking, among other things, a judicial declaration that it Housing Element and Fair Share Plan, to be amended as necessary, satisfies its “fair share” of the regional need for low and moderate income housing pursuant to the “Mount Laurel doctrine;” and
WHEREAS, the Borough simultaneously, and ultimately secured, a protective order
providing Stone Harbor immunity from all exclusionary zoning lawsuits while it pursues approval
of its Housing Element and Fair Share Plan, which is still in full force and effect; and
WHEREAS, the Borough adopted an amended Housing Element and Fair Share Plan on or
about May 10, 2021; and
WHEREAS, the Borough has prepared a Spending Plan consistent with N.J.A.C 5:97-8.1
– 8.14 and P.L 2008, c.46; and
WHEREAS, in the event the funding sources as identified in the Spending Plan prove
inadequate to complete the affordable housing programs included in the Borough’s Housing Element and Fair Share Plan and any future amendments thereof; and to the extent permitted by law, the Borough shall provide sufficient funding to address any shortfalls
NOW THEREFORE BE IT RESOLVED, by the Council of the Borough of Stone
Harbor, in the County of Cape May, and the State of New Jersey, that the Borough does hereby agree to appropriate funds or authorize the issuance of debt to fund any shortfall in its affordable housing programs that may arise whether due to inadequate funding from other sources or for any other reason; and
BE IT FURTHER RESOLVED that the Borough may repay debt through future
collections of development fees and in-lieu contributions, as such funds become available; and
BE IT FURTHER RESOLVED that the Mayor, Borough Administrator, and Borough
